Florida Driver’s License Requirements for Immigrants: Documents, Tests, and Fees

If you are not a U.S. citizen, the Florida driver’s license requirements for immigrants add one major step to the standard process: you have to prove you are lawfully present in the United States, and the license you receive will be tied to how long that status lasts. Everything else — Social Security proof, two Florida address documents, a required education course, and the vision, knowledge, and road tests — applies the same way it does to any first-time applicant. Bring every document in original form to a Florida Department of Highway Safety and Motor Vehicles (FLHSMV) office or county tax collector, because one missing item ends the visit.

Documents That Prove Lawful Presence

The FLHSMV splits non-citizen applicants into two groups, and the paperwork differs for each.

If You Are an Immigrant

Permanent residents, asylees, and refugees fall in this category. A valid Permanent Resident Card (Form I-551, the green card) is the main identity document for a permanent resident. An I-551 stamp in your passport or on your I-94 also works. Asylees bring an immigration judge’s order granting asylum together with a valid passport, or a USCIS Form I-797 notice showing the A-number and confirming the asylum grant. Refugees present an I-797 or another USCIS form confirming refugee status, along with a valid passport.1Florida Department of Highway Safety and Motor Vehicles. Immigrant

If You Are a Non-Immigrant

Temporary visa holders have more options. Florida Statute 322.08 recognizes an unexpired Employment Authorization Document (EAD), an unexpired foreign passport paired with a valid U.S. visa and I-94, or USCIS notices showing a pending immigration proceeding such as an asylum application, an adjustment of status application, or a scheduled immigration court hearing.2Florida Senate. Florida Code Title XXIII Chapter 322 – 322.08 Application for License

One practical note: FLHSMV offices and tax collectors generally require that your immigration document be valid for more than 30 days from your application date. Document a bit of lead time before the expiration.

Social Security Number Proof

You need to show proof of your Social Security number. Acceptable items include an original Social Security card, a W-2, a paycheck or pay stub showing the full SSN, an SSA-1099, or any other non-handwritten 1099.1Florida Department of Highway Safety and Motor Vehicles. Immigrant

Some immigration statuses do not qualify for an SSN. In that case, go to a Social Security Administration office and ask for written confirmation that you are ineligible. The SSA issues Form SSA-L676 (or SSA-L676-SP in Spanish) when it cannot process an SSN application.3Social Security Administration. Form SSA-L676 – Refusal to Process SSN Application Bring that letter to the FLHSMV with the rest of your paperwork. Getting the letter is usually a separate trip, so build the time into your plan.

Two Proofs of Florida Residency

You must present two different documents showing your current Florida residential address. At least one should be a household-type document such as a deed, mortgage statement, or residential lease. The second can be a supporting document like a utility bill, bank statement, insurance policy, employer documentation, Florida vehicle registration, or mail from a government agency. Most supporting documents must be dated within the last 60 days.1Florida Department of Highway Safety and Motor Vehicles. Immigrant

If nothing is in your name, a person you live with can complete a Certification of Address form for you. That person brings their own residency proof, and you both appear at the office together.

Traffic Law and Substance Abuse Education Course

First-time Florida driver’s license applicants age 18 and older must complete a four-hour Traffic Law and Substance Abuse Education (TLSAE) course before taking the knowledge exam. It covers Florida traffic laws, impaired-driving risks, and basic safe-driving practices. Take it from a state-approved provider and bring proof of completion. Online options from approved providers typically run $30 to $45. Applicants ages 15 to 17 take a longer Driver Education course instead.

Fees

The state fee for an original Class E driver’s license is $48.4The Florida Legislature. Florida Statutes 322.21 – License Fees Most people apply at a county tax collector’s office rather than a state FLHSMV office, and tax collectors add a service fee (commonly $6.25), which brings the real total to roughly $54 or $55. Retaking the knowledge or driving exam costs extra each time.

The Tests at Your Appointment

You take three tests in sequence: vision, knowledge, and road.

Florida’s vision standard is a minimum visual acuity of 20/70 in at least one eye, with or without corrective lenses. If one eye is blind or tests at 20/200 or worse, the other eye must be 20/40 or better. If you need glasses or contacts to pass, your license carries a corrective-lens restriction.5Florida Department of Highway Safety and Motor Vehicles. Vision Standards

The Class E knowledge exam has 50 multiple-choice questions on Florida traffic laws, safe-driving practices, and road signs. You need 40 correct (80%) to pass.6Florida Department of Highway Safety and Motor Vehicles. Class E Knowledge Exam and Driving Skills Test Florida has shifted toward offering the exam primarily in English, so check with your local office or tax collector before your visit if you were counting on another language.

The road test uses a registered, roadworthy vehicle that you bring yourself. You will demonstrate maneuvers including a three-point turn, straight-in parking, parking on a hill with and without a curb, backing up 50 feet while looking over your shoulder, a quick stop, lane changes, turns, and signaling. The examiner also watches how you obey stop signs and signals, follow at a safe distance, and yield to pedestrians and emergency vehicles.6Florida Department of Highway Safety and Motor Vehicles. What You Leave the Office With

Non-U.S. citizens who pass every test receive a 60-day temporary paper permit (no photo) and a receipt.7Florida Department of Highway Safety and Motor Vehicles. Non-Immigrant The paper permit lets you drive legally while FLHSMV verifies your identity and immigration status through federal databases. Once verification clears, your REAL ID-compliant card is mailed to the Florida address on your record. The full process can take up to 60 days. If it drags past that window, contact your local FLHSMV office or tax collector; mismatches between USCIS records and your application sometimes slow things down, and catching the issue early prevents a gap in your driving privileges.

How Long the License Lasts

A standard Florida license runs eight years. A non-citizen license is deliberately shorter: it expires on the date shown on your immigration document, or after one year, whichever comes first.2Florida Senate. Florida Code Title XXIII Chapter 322 – 322.08 Application for License If your EAD expires in eight months, so does your license. If your immigration document shows no printed expiration date, the license defaults to one year.

Renewal is in person. Bring current immigration documents proving continued lawful presence, your Social Security proof, and two residential address documents.1Florida Department of Highway Safety and Motor Vehicles. Immigrant You skip the knowledge and road exams on renewal, but the vision screening happens again. Start pulling updated immigration paperwork together at least a month before your current license expires so you are not driving on an expired card while you wait on documents.

If you have applied to renew your EAD and the new card has not arrived, the USCIS receipt notice can extend the work permit’s validity for up to 540 days past the printed expiration date. Bring that receipt notice to your renewal.

A Warning About Out-of-State Licenses

Florida law invalidates certain out-of-state licenses once you drive here. Under Section 322.033, effective July 2023, any out-of-state driver’s license from a class of licenses issued exclusively to people who could not prove lawful immigration status is not valid for driving in Florida.8Florida Senate. CS/CS/SB 1718 That covers licenses from states that either issue them only to undocumented immigrants or mark the card to show the holder did not prove lawful presence. You can possess the license; you just cannot drive on it in Florida, and doing so is treated the same as driving with no license at all, a second-degree misdemeanor.

A standard out-of-state license that required proof of lawful presence when it was issued remains valid for driving in Florida as a visitor. If you take a job, start a trade, or enroll children in a Florida public school, you have 30 days to get a Florida license.9The Florida Legislature. Before You Walk In

Book an appointment online through the FLHSMV site or your county tax collector. Walk-ins are allowed but can mean several hours of waiting, and some offices seat appointment holders first. Bring originals of every document above. Most primary identification cannot be a photocopy or printout, though FLHSMV does accept printouts for residential address documents.

Finally, check that your name matches exactly across every document. A middle name on your passport missing from your Social Security card, or a one-letter difference between your EAD and your I-94, is enough for a counter rejection. If your name changed through marriage or a court order, bring the legal documentation for that change too.
