Florida’s express lane rules come down to a few hard requirements: you must have an active, funded SunPass or compatible transponder mounted in your vehicle, you pay a toll that changes minute to minute with traffic, and you can only enter or exit at designated points. There is no cash option and no Toll-By-Plate billing on these lanes, so driving through without a working transponder is a violation that carries a mandatory $100 fine plus the unpaid toll.1Florida’s Turnpike Enterprise. Toll-By-Plate
The express lanes (sometimes called managed lanes) run on I-95 from Miami through Broward and into Palm Beach County, on I-595 in Broward, on I-4 through the Orlando metro, and on parts of I-75 in South Florida. Access points differ by corridor, but the rules below apply across all of them.
You Must Have a Transponder
Every vehicle in an express lane needs an active SunPass or other Florida-accepted transponder. This is the rule drivers miss most often. Regular Florida toll roads will photograph your plate and mail an invoice through Toll-By-Plate. Express lanes do not. Drive through without a transponder and you get a violation, not a bill.1Florida’s Turnpike Enterprise. Toll-By-Plate
Compatible transponders accepted on most Florida toll roads include SunPass, E-PASS, and LeeWay.2Florida’s Turnpike Enterprise. Interoperability A SunPass Mini costs $4.99 plus tax, sticks to the windshield, and is tied to one vehicle. A SunPass PRO costs $14.95 plus tax, moves between vehicles, works with motorcycles, and is accepted in more than 20 other states including anywhere E-ZPass operates.3SunPass. About SunPass You can buy either online at sunpass.com, at most Florida Walgreens and CVS locations, or at a SunPass service center. The transponder has to be registered to an active account with a positive balance before you use it. A transponder sitting on your dashboard with no account behind it will trigger violations exactly as if you had none at all.
How the Tolls Are Set
Express lane prices are not fixed. The posted toll changes throughout the day based on how many vehicles are using the lanes at that moment. When traffic is light, tolls drop. When demand rises, tolls climb, so the express lanes keep moving instead of jamming up like the general-purpose lanes next to them.4I-4 Express. Toll Collection
Florida law protects you if the system fails at its job. If your average travel speed from your entry point to your exit point falls below 40 miles per hour, you can only be charged the minimum toll for that trip.5Florida Senate. Florida Statutes 338.166 – High-Occupancy Toll Lanes or Express Lanes
Who Can Use the Lanes
Not every vehicle is allowed. On I-4 Express, only two-axle vehicles with an active transponder may enter. Vehicles with three or more axles and anyone towing a trailer, boat, or another vehicle are prohibited.6I-4 Express. What Vehicles Are Allowed in I-4 Express
Pre-registered vanpools and buses generally travel toll-free. Motorcycles are allowed; federal law requires managed lanes to permit motorcycle access unless the operating authority has obtained a safety-hazard certification from the U.S. Secretary of Transportation.7Office of the Law Revision Counsel. 23 USC 166 – HOV Facilities
Carpools
Florida eliminated its dedicated HOV lanes in 2025, but a carpool benefit still exists on the 95 Express lanes. Registered carpools with three or more occupants travel toll-free, and each member of a registered 3+ carpool also qualifies for Guaranteed Ride Home benefits.8South Florida Commuter Services. Carpools Travel in 95 Express Free The carpool has to be registered with South Florida Commuter Services ahead of time. Showing up with three people in the car does not make the system waive the toll; unregistered vehicles pay the regular dynamic rate.
Toll-Exempt Vehicles
Florida law exempts certain vehicles from paying tolls on all facilities, express lanes included:
- Law enforcement officers operating official vehicles while on official business
- Fire and rescue vehicles while on official business
- State agency employees using toll facilities on official state business for the agency operating the toll project
- Military personnel driving Department of Military Affairs vehicles for transporting personnel, stores, or property
- Persons with qualifying disabilities as specified by statute
FDOT may also permit public transit vehicles and funeral processions for active-duty military service members to use certain toll facilities without payment, on facilities where toll revenues are not pledged to bond repayment.
A previous Low Emission Vehicle exemption on the 95 Express gave toll-free access to qualifying hybrids and electric vehicles. That program stopped accepting new registrations and renewals on July 1, 2025. Existing exemptions remain valid until they expire and cannot be renewed.10South Florida Commuter Services. Entry, Exit, and Buffer Zones
Express lanes are separated from the general-purpose lanes by painted buffer zones and plastic delineator posts. You may only enter and exit at designated access points. Cutting across the barrier posts or weaving in and out is illegal and can bring fines and points on your license.1195 Express. Guidelines for Using Express Lanes If you miss your exit, continue to the next designated one rather than crossing the buffer.
Penalties for a Violation
Using any Florida toll facility without paying, express lanes included, is a noncriminal traffic infraction classified as a moving violation.12Justia Law. Florida Statutes 316.1001 – Payment of Toll on Toll Facilities Required; Penalties
The mandatory fine is $100 per violation plus the unpaid toll. You have a cheaper option: pay $30 plus the unpaid toll to the clerk of court, and adjudication is withheld with no points assessed to your driving record. If a plea arrangement is reached before an evidentiary hearing, the fine ranges from $50 to $100 plus the unpaid toll.13Florida Senate. Florida Statutes 318.18 – Amount of Penalties
Repeat violations escalate. A court can direct the state to suspend your driver license for 60 days if you are convicted of 10 toll violations within a 36-month period.13Florida Senate. Florida Statutes 318.18 – Amount of Penalties Submitting a false affidavit in connection with a toll violation, such as falsely claiming someone else was driving, is a second-degree misdemeanor and carries potential criminal penalties on top of the toll fine.12Justia Law. Florida Statutes 316.1001 – Payment of Toll on Toll Facilities Required; Penalties
What Happens If You Ignore the Notice
The real damage comes from doing nothing. After a Toll Enforcement Invoice goes unpaid by its due date, a second notice is mailed. If payment still is not received, the toll amount and administrative fees can be sent to a collection agency, which adds its own fees that can significantly exceed the original toll.14Florida’s Turnpike Enterprise. Unpaid Tolls
Any government entity, including a clerk of court, can report outstanding toll violations to the state. Once reported, you cannot obtain or renew a license plate or registration sticker for any vehicle you own until the violations are resolved.12Justia Law. Florida Statutes 316.1001 – Payment of Toll on Toll Facilities Required; Penalties A federal court has ruled that unpaid toll debts are not covered by the Fair Debt Collection Practices Act because tolls are treated as obligations in the nature of a tax rather than consumer debt. Third-party toll debt collectors therefore are not bound by the same consumer protection rules that apply to credit card or auto loan collectors.
Rental Cars and Out-of-State Drivers
Visitors with a SunPass PRO are covered: the transponder works in Florida, Georgia, Kansas, Oklahoma, North Carolina, Texas, and anywhere E-ZPass operates. As of late 2025, FDOT reported SunPass interoperability with tolling systems in 24 other states.15Florida Department of Transportation. FDOT Spotlights Major Infrastructure Projects Confirm your specific transponder is accepted on managed lanes before entering, because a transponder that works at a turnpike plaza will not necessarily register on an express lane gantry.
Rental cars are where costs quietly multiply. Most major rental companies equip vehicles with a transponder and charge daily convenience fees when you use a toll. Avis charges $6.95 per toll day up to $34.95 per rental. Enterprise charges $4.95 per day up to $34.65 per rental. Hertz rates vary by location but can run $18 to $28 per day. Those fees are on top of the tolls themselves. If you decline the rental company’s toll plan and then use a cashless lane, the company typically bills you the full undiscounted toll plus an administrative fee per usage day. The straightforward workaround is to buy a SunPass Mini for $4.99, register it to your own account, and mount it in the rental car. You pay the lowest toll rates and skip the rental company surcharges.3SunPass. About SunPass
Disputing a Violation
Mistakes happen. Florida’s Department of Highway Safety and Motor Vehicles acknowledges that the high volume of toll transactions combined with vehicle speed can produce inaccurate plate readings and billing errors.16Florida Department of Highway Safety and Motor Vehicles. Toll-By-Plate Information
If a violation notice looks wrong because your transponder was active and funded, the plate was misread, or you did not own the vehicle at the time, contact the toll agency named on the citation first. For disputes involving a Uniform Traffic Citation, you can request a hearing through the clerk of court. Your SunPass account transaction history logs every trip with timestamps, which is what makes these disputes resolvable.
