Florida Homestead Law: Tax Exemption, Creditor Shield, and Rules

Florida homestead law gives owners of a primary residence in the state two distinct benefits: a property tax break that reduces what you owe every year, and a constitutional shield that keeps most creditors from forcing a sale of your home. The tax side requires an application. The creditor side attaches automatically once the property is genuinely your permanent home. Both come with rules that catch people off guard, especially around inheritance, renting, and what happens if you move.

Who Qualifies as a Homestead Owner

You have to be a natural person. Corporations, LLCs, and other business entities cannot claim homestead, no matter what the property is used for. You must own the property and occupy it as your permanent primary residence with a genuine intent to stay indefinitely. Property appraisers look at practical signals: where your driver’s license is issued, where you’re registered to vote, and where your vehicles are registered.1Florida Department of Revenue. You must own the property by January 1 of the tax year you’re claiming. Close on January 2 and you wait a year. You also cannot be claiming a residency-based property tax break in another state at the same time. Property appraisers cross-reference Social Security numbers to catch duplicate filings.

Citizenship is not required. Permanent residents with green cards can qualify if Florida is their permanent home in good faith.2My Florida Legal. Eligibility of Alien for Homestead Exemption People on temporary visas generally cannot, because a visa with an end date contradicts the permanency requirement. Florida case law has allowed pending political asylum applicants to qualify, since their stay has no defined end date.

What the Tax Exemption Is Worth

The exemption reduces your home’s taxable assessed value in two layers. The first $25,000 of assessed value is exempt from all property taxes, including school district levies.3Florida Senate. Florida Statutes 196.031 – Exemption of Homesteads

A second layer kicks in above $50,000 of assessed value, but this one only applies to non-school levies like county, city, and water management district taxes. For 2026, the additional exemption maxes out at $26,411 after a CPI-based inflation adjustment.4Florida Department of Revenue. Additional Homestead Exemption Adjustment The gap between $25,000 and $50,000 gets no exemption. On a home assessed at $300,000, you’d owe school taxes on $275,000 and non-school taxes on roughly $248,600.

Additional Exemption for Seniors

Homeowners 65 or older by January 1 may qualify for an extra exemption of up to $50,000, but only if the county or city has adopted a local ordinance authorizing it.5FindLaw. Florida Statutes 196.075 – Additional Homestead Exemption for Persons 65 and Older For the 2026 tax year, total household adjusted gross income for 2025 cannot exceed $38,686. Seniors who have lived in the same home for at least 25 years and meet the income cap may receive an even larger exemption on homes with a just value under $250,000, potentially wiping out their non-school tax bill entirely. Check with your county property appraiser to see what’s offered locally.

The Save Our Homes Assessment Cap

The exemption gets the attention, but the Save Our Homes cap is often worth more over time. After the first year your home is under a homestead exemption, its assessed value cannot rise by more than 3% or the change in the Consumer Price Index, whichever is lower, no matter how fast market values climb.6Florida Department of Revenue. Save Our Homes Assessment Limitation and Portability Transfer The gap between assessed value and actual market value grows every year you stay, and the tax savings compound. Long-term owners often have assessed values far below what they could sell for.

Sell and buy another home in Florida, and you can transfer the accumulated Save Our Homes benefit. That’s called portability. You must establish homestead on the new home within three years of January 1 of the year you gave up homestead on the old one, and you file Form DR-501T alongside the regular DR-501 with the county property appraiser by March 1.6Florida Department of Revenue. The three-year clock is easy to misread. It runs from January 1 of the year you abandoned the old homestead, not from the sale date. Leave your old homestead after January 1, 2024, and you have until January 1, 2027, to establish a new one.

How and When to Apply

File Form DR-501 with the county property appraiser where the home is located.1Florida Department of Revenue. DR-501 – Original Application for Homestead and Related Tax Exemptions Most counties accept online applications; in-person and mail filings still work. You’ll need the legal description of the property, Social Security numbers for all owners, your Florida driver’s license number, vehicle registration details, and voter registration number if you’re registered in Florida.

The hard deadline is March 1 of the tax year you want the exemption for. Missing it isn’t necessarily fatal. Many counties allow late filings through mid-September, and if the property appraiser refuses one, you can petition the county’s value adjustment board. Rules and fees for late filings vary by county, so contact the property appraiser’s office quickly if you miss March 1.

Once approved, the exemption renews automatically each year, provided you still own the home and use it as your primary residence. Sell, move, or rent it out, and the exemption drops off.

Protection From Creditors

The creditor shield in Article X, Section 4 of the Florida Constitution is separate from the tax exemption and often more dramatic. Your homestead is fully exempt from forced sale on most court judgments, and Florida imposes no dollar limit on the equity that’s protected.7FindLaw. Florida Constitution Art. X, Section 4 – Homestead Exemptions A waterfront estate is shielded the same as a modest bungalow. Only a handful of states offer unlimited equity protection.

What is capped is the land. Outside a municipality, up to 160 acres of contiguous land and everything on it are protected. Inside a municipality, the shield covers only half an acre. If a rural property later gets annexed into a city, the constitution preserves the original 160-acre protection; the shield doesn’t shrink because city limits moved.

Debts That Override the Shield

The constitution carves out specific exceptions where a forced sale remains possible.

  • Unpaid property taxes and special assessments. The government can sell the home through a tax deed sale regardless of homestead status.
  • Mortgages and loans taken out to buy, improve, or repair the property. Signing the mortgage grants the lender the right to foreclose.
  • Contractor and laborer liens for work done on the property. A properly filed lien remains valid for one year, after which it expires unless a foreclosure action has been filed.8The Florida Legislature. Florida Statutes 713.08 – Claim of Lien
  • Homeowners association assessments. Unpaid dues create a lien the HOA can foreclose on, using the same process as a mortgage foreclosure. The association must give at least 45 days’ notice of intent to foreclose before filing suit.9The Florida Legislature. Florida Statutes 720.3085 – Payment for Assessments; Lien Claims

Homestead also won’t help if the property was funded through fraud. When a debtor converts non-exempt assets into a homestead specifically to keep them away from creditors, the creditor can petition the court to unwind the conversion, whether the underlying claim arose before or after. The statute of limitations is four years from the date of the conversion.10The Florida Legislature. Rules That Surprise Owners

You Cannot Freely Leave the Home in a Will

If you’re survived by a spouse or a minor child, you cannot devise the homestead to anyone other than your spouse, and even that only works when there are no minor children.11The Florida Legislature. Florida Statutes 732.4015 – Devise of Homestead A will that leaves the homestead to an adult child, sibling, or friend while a surviving spouse is alive is invalid as to the homestead, however clearly written.

When the homestead passes outside a valid devise, the surviving spouse receives a life estate, meaning the right to live there for life, with the descendants receiving the remainder. The surviving spouse can instead elect to take an undivided half interest as a tenant in common with the descendants.12Florida Senate. Florida Statutes 732.401 – Descent of Homestead Neither option gives the spouse full control to sell, which creates real problems when downsizing or relocating.

Your Spouse Must Sign Deeds and Mortgages

If you’re married, your spouse must sign any deed or mortgage on the homestead, even if their name isn’t on the title. This blocks one spouse from quietly selling or borrowing against the family home. Title companies will refuse to close on homestead property without spousal joinder, so in practice it functions as an absolute barrier.

A spouse can waive homestead inheritance rights through a prenuptial or postnuptial agreement, but the waiver must be in writing and signed in the presence of two subscribing witnesses.13The Florida Legislature. Florida Statutes 732.702 – Waiver of Spousal Rights Postnuptial waivers require each spouse to make a fair disclosure of their estate. Prenuptial waivers do not. Language waiving “all rights” in the other spouse’s property is broad enough to cover homestead rights unless the agreement says otherwise.

Renting the Home Can Count as Abandonment

Renting all or substantially all of a home previously claimed as homestead is treated as abandonment, and the tax exemption drops off until you physically move back in.14FindLaw. Florida Statutes 196.061 – Rental of Homestead to Constitute Abandonment There is breathing room. Renting for 30 days or fewer per calendar year won’t trigger abandonment unless you do it two years in a row. Abandonment after January 1 of a given year doesn’t affect that year’s exemption. Armed forces members transferred under military orders are exempt from the rule, and the protection extends to their spouse.

That standard governs the tax exemption. The constitutional creditor protection can also be lost through abandonment, but courts analyze that separately and focus on whether you’ve genuinely given up the intent to return.

Property Held in a Trust Can Still Qualify

Holding the home in a revocable living trust does not automatically disqualify it. The trust beneficiary needs equitable or beneficial title for life and a present right to live in the home, and the deed transferring the property into the trust must be recorded. Including language in the deed that reserves the grantor’s right to reside on the property as a permanent residence during their lifetime, and that states the intent to retain beneficial interest and possessory rights, generally satisfies the property appraiser. Without that language, the appraiser may need to review the trust document itself, which slows things down and creates more room for denial.

The Federal Bankruptcy Limit

Florida’s unlimited equity protection draws debtors considering bankruptcy, but federal law caps it in one situation. If you acquired the homestead within 1,215 days (roughly three years and four months) before filing bankruptcy, any equity above $214,000 is not protected regardless of Florida law.15Office of the Law Revision Counsel. 11 U.S. Code 522 – Exemptions The $214,000 figure reflects the most recent adjustment effective April 1, 2025.

The rule targets people who move to a generous-exemption state, buy an expensive home, and file bankruptcy. Own your Florida homestead longer than 1,215 days and the federal cap doesn’t apply. Family farmers are excepted. So is equity rolled over from a prior homestead in the same state, even when the new home was purchased inside the look-back window.
