Florida Leave of Absence Laws and Employee Rights

Florida leave of absence laws are thin at the state level: there is no general Florida family and medical leave statute, so most time off from work is governed by the federal Family and Medical Leave Act, with a short list of Florida-specific laws covering domestic violence situations, military service, and extra categories for state government employees.1U.S. Department of Labor. Fact Sheet #28 – The Family and Medical Leave Act What you are entitled to depends on your employer’s size, how long you have worked there, and whether you work for the state.

FMLA Is the Main Protection for Florida Workers

Because Florida has no comparable state law, the federal FMLA does most of the work. You qualify if you have been with your employer for at least 12 months, logged at least 1,250 hours over those 12 months, and work at a location where the employer has at least 50 employees within 75 miles.1U.S. Department of Labor. Fact Sheet #28 – The Family and Medical Leave Act Meet those three conditions and you can take up to 12 workweeks of unpaid leave in a 12-month period for your own serious health condition, the birth or placement of a child, or to care for an immediate family member with a serious health condition.2U.S. Department of Labor. Notice matters. When your need for leave is foreseeable, you owe your employer at least 30 days’ advance notice. When it is not foreseeable, such as a medical emergency, notify your employer as soon as practicable.3U.S. Department of Labor. Family and Medical Leave Act Advisor – Timing of Employee Notice Expect to provide medical documentation. Late notice on a foreseeable leave can push back your start date.

Many Florida workers fall outside FMLA because their employer is too small, or because their worksite does not have 50 employees nearby. If that describes your job, your leave rights come from your employer’s own policies or, in limited situations involving a disability, from the Americans with Disabilities Act’s reasonable accommodation requirements. Florida does not fill that gap with a state statute.

Domestic Violence and Sexual Violence Leave

Florida does have one targeted leave law that reaches private employers. Under Florida Statute 741.313, employers with 50 or more employees must allow eligible workers up to three working days of leave in any 12-month period if the employee or a household member is a victim of domestic violence or sexual violence.4Florida Senate. Florida Statutes 741.313 – Unlawful Action Against Employee You must have been with the employer at least three months. The leave can be used to seek a protective injunction, obtain medical or mental health treatment, access victim services, secure your home, or get legal help related to the violence.

Whether the three days are paid is up to the employer. You generally have to exhaust your existing vacation, personal, and sick leave first, unless the employer waives that. Advance notice and documentation are required when possible; the exception is imminent danger.

Military Leave

Military leave in Florida sits on two tracks. Florida Statute 115.07 gives all state, county, and municipal employees who serve in the U.S. military reserves or National Guard up to 240 working hours of paid leave per annual period for ordered training duties, with no loss of vacation leave, pay, or efficiency rating.5Florida Senate. Florida Statutes 115.07 – Officers and Employees Leaves of Absence for Reserve or Guard Training Training beyond 240 hours is unpaid, but your efficiency rating is still protected. This covers public employees across the state, not only those in the state personnel system.

Extra Leave Categories for State Employees

If you work for a Florida state agency, several paid leave categories exist that private-sector workers do not get. The Florida Administrative Code and Department of Management Services policies authorize paid administrative leave for jury duty, subpoenaed witness service, military entrance examinations, voting (up to one hour), disaster volunteering (up to 120 hours in a 12-month period), and mentoring through the Governor’s Mentoring Initiative (up to one hour per week, capped at five hours per calendar month).8Legal Information Institute. Florida Administrative Code R 60LER-19.1 – Administrative Leave Administrative leave pay does not count toward overtime.9Department of Management Services. Administrative Leave

Every leave of absence, paid or unpaid, must be in writing and approved by the agency head. During an approved leave you remain a state employee with the right to return to the same position, or a comparable one in the same classification and work location.10Florida Senate. Florida Code 110.219 – Attendance and Leave General Policies Informal arrangements and unapproved absences do not carry those rights.

Sick Leave Pool

State agencies may run voluntary sick leave pools. After one year of state employment, and with a minimum balance of unused sick leave set by agency rule, you can donate leave to the pool and later draw from it if you face a personal illness, accident, or injury. You must exhaust your own sick, annual, and compensatory leave before drawing pool credits.11Florida Senate. Florida Code 110.121 – Sick Leave Pool The pool covers your own illness, not a family member’s. Each agency caps how many pool days a single employee can use, and misuse can trigger repayment of all credits drawn plus discipline.

Educational Leave With Pay

State agencies may grant educational leave with pay to attend a college, university, or training academy for one or more full academic periods. You need at least one continuous year of state employment, you must meet the program’s entrance requirements, and the program must relate to your agency’s needs.12Legal Information Institute. Florida Administrative Code R 60L-34.0072 – Educational Leave With Pay Not every agency offers it, slots are limited, and selection must be objective and nondiscriminatory. Private-sector workers depend entirely on their employer’s policies or a collective bargaining agreement for anything similar.

Health Insurance During Leave

Under FMLA, your employer must keep your group health plan coverage going on the same terms as if you were still working. You keep paying your share of the premium, and if the rate changes during the leave, you pay the new rate. Your employer must give advance written notice of the payment terms.13U.S. Department of Labor. Employee Payment of Group Health Benefit Premiums Premiums can be collected on the normal payroll schedule, on a COBRA-type schedule, or any other arrangement you both agree to. The employer cannot force prepayment of the full leave period upfront or charge you more than active employees pay.

Outside FMLA, or after FMLA runs out on an extended leave, that protection ends. Many plans drop active coverage after a set period of inactivity. Once that happens, COBRA continuation coverage lets you keep the group plan for up to 18 months, but at the full premium (employer share plus your share) with a 2% administrative fee added. The jump from paying only the employee share to paying the whole premium catches many people off guard.

Job Protection and Your Right to Return

FMLA requires your employer to restore you to your original job or an equivalent one with equivalent pay, benefits, and working conditions.1U.S. Department of Labor. Fact Sheet #28 – The Family and Medical Leave Act Florida state employees get a parallel protection under Chapter 110: a return to the same position or one in the same classification and work location, as long as the leave was properly authorized in writing by the agency head.10Florida Senate. Florida Code 110.219 – Attendance and Leave General Policies That reaches any authorized leave, not just FMLA-qualifying leave, so state workers get a broader safety net than most private-sector workers.

USERRA’s return rights are stronger still. Returning service members receive the seniority, rights, and benefits they would have accumulated if they had never left, so promotions you would have earned, pay increases that took effect during your absence, and accrued benefits all carry over as though you were continuously employed.7GovInfo. 38 USC 4316 – Rights, Benefits, and Obligations of Persons Absent from Employment

One boundary worth knowing: the Florida Civil Rights Act does not create a general right to take leave. It protects against discrimination based on race, color, religion, sex, pregnancy, national origin, age, disability, and marital status.14Florida Senate. Florida Code Chapter 760 – Discrimination in the Treatment of Persons So if you are penalized after taking leave, the legal question is usually whether the reason for the leave connects to a protected characteristic (pregnancy, for example), not whether leave itself was protected.

How Leave Can Affect Your FRS Retirement

If you work for an FRS employer, an unpaid leave can quietly cost you money in retirement. In the FRS Pension Plan, an unpaid leave does not automatically count toward the six-year (pre-July 2011 enrollees) or eight-year (July 2011 and later enrollees) vesting requirement, and every year of unpaid leave that goes unpurchased is a year missing from the benefit formula.15MyFRS.
