Florida HSMV Form 82139 is the application you file with your county tax collector to record a lien on a motor vehicle, mobile home, off-highway vehicle, or vessel that already has a Florida title, to reassign an existing lien to a new lender, or to notify a first lienholder that a second lien is being added.1Florida Department of Highway Safety and Motor Vehicles. Application for Notice of Lien / Reassignment of Lien or Notice to First Lienholder of Subsequent Lien Which sections you complete depends on which of those three transactions you are doing, and the single biggest thing to get right is the timing: file within 15 days of the security agreement and your lien is treated as perfected on the date the owner signed, not the date the tax collector stamps it in.2The 2025 Florida Statutes. Florida Statutes 319.27 – Liens and Encumbrances
What to Have in Front of You
Before opening the form, pull together:
- The Florida certificate of title, or a current title status printout from the tax collector if the title is electronic.
- The year, make, body type, and VIN (or HIN for a vessel), copied from the title or registration.
- The current Florida title number.
- The registered owner’s full legal name and address, exactly as they appear on the title.
- The lienholder’s name, mailing address, and either an FEID (for a business) or a driver license number, sex, and date of birth (for an individual).
- The date the security agreement was signed. This becomes the “Date of Lien” and sets your priority against other creditors.
Form 82139 is designed for individuals and lienholders who are not in the business of financing vehicles. Financial institutions that routinely finance vehicles are expected to transmit liens through Florida’s Electronic Lien and Title system instead of filing on paper.2The 2025 Florida Statutes. Florida Statutes 319.27 – Liens and Encumbrances
Section 1: Describe the Property
Check the box for the property type, then enter the year, make, body type, VIN or HIN, and the current Florida title number. Copy every character from the title. A single transposed digit in the identification number can bounce the application back.1Florida Department of Highway Safety and Motor Vehicles. Application for Notice of Lien / Reassignment of Lien or Notice to First Lienholder of Subsequent Lien
Section 2: Owner and Lienholder Information
Enter the registered owner’s full legal name and residential address exactly as the title shows them. Mismatches between what you write and what FLHSMV already has on file are a common reason applications come back unprocessed.
For the lienholder, fill in the full name, mailing address, and FEID or driver license information. The “Date of Lien” is the date the security agreement was executed, not the date you are filing.3Florida Highway Safety and Motor Vehicles. TL-32 Motor Vehicle Procedure Manual – Notice of Lien, Subsequent Lien Actions and Court Orders The owner signs under penalty of perjury, so use black or blue ink and keep the signature legible.
Section 2 also includes a checkbox allowing the lienholder to direct that a paper title be sent to the owner rather than held electronically. That option does not apply to vessels, which follow Chapter 328 rules.1Florida Department of Highway Safety and Motor Vehicles. Who Has to Sign When There Are Co-Owners
The signature rule turns on one word in the ownership line. If the names on the title are joined by “or,” any one co-owner can sign and authorize the lien alone. If they are joined by “and,” every co-owner has to sign.4Florida Senate. Florida Statutes 319.235 – Encumbrance of Co-Owned Motor Vehicle or Mobile Home A missing spouse or co-owner signature on an “and” title will stop the whole filing.
Section 3: Reassigning a Lien to a New Lender
When a lienholder sells or transfers the loan to another lender, use Section 3. Complete Section 1 with the property description, then have an authorized agent for the current lienholder (the assignor) and an authorized agent for the new lienholder (the assignee) sign Section 3.3Florida Highway Safety and Motor Vehicles. TL-32 Motor Vehicle Procedure Manual – Notice of Lien, Subsequent Lien Actions and Court Orders The owner does not sign for a reassignment; it is strictly a transaction between the two lienholders.
Section 4: Adding a Subsequent Lien
If a first lien is already recorded and you are adding a second, complete Sections 1, 2, and 4. The registered owner must sign Section 2 to authorize the additional lien. The subsequent lienholder also has to send a copy of the completed form by certified mail, return receipt requested, to the first lienholder so the senior lender has notice that a junior lien now exists.3Florida Highway Safety and Motor Vehicles. Fees
Pay at the time of submission. The tax collector will not process the form without the fees.
- Lien only, no title transfer: $74.25
- Original title, new vehicle: $77.25
- Original title, used vehicle: $85.25
- Transfer or duplicate title: $75.25
Add $2.50 if a paper title needs to be printed and mailed, and an additional $2 lien recording fee may apply depending on the transaction.5Florida Department of Highway Safety and Motor Vehicles. Fees Vessel lien recording fees are set separately under Section 328.14(6) of the Florida Statutes.
Where to Submit, and Why the Date You Submit Matters
Take the completed form, the paper title or title status printout, and the fees to your local county tax collector. You can walk in for same-day processing or mail everything with a check.1Florida Department of Highway Safety and Motor Vehicles. Application for Notice of Lien / Reassignment of Lien or Notice to First Lienholder of Subsequent Lien Walking it in lets the counter staff flag problems before they become rejections.
The filing date is the date the department, tax collector, or license plate agency receives the form, not the date you signed it or mailed it.3Florida Highway Safety and Motor Vehicles. TL-32 Motor Vehicle Procedure Manual – Notice of Lien, Subsequent Lien Actions and Court Orders Mailing on the last possible day is a gamble, because the clock that governs lien priority is the receipt clock.
The 15-Day Perfection Window
Filing is what makes the security interest enforceable against other creditors and future buyers. Without the notice of lien on record, a Florida court will not enforce the lien against someone who had no knowledge of it.2The 2025 Florida Statutes. Florida Statutes 319.27 – Liens and Encumbrances
File within 15 days after the debtor takes possession of the vehicle and signs the security agreement, and your lien is treated as perfected on the date the agreement was signed. That backdating protects you against anyone who might have acquired an interest in the vehicle between signing and filing. Miss the 15 days and your perfection date becomes the date the tax collector receives the application, which means any competing claim that arose in the meantime can jump ahead of you.2The 2025 Florida Statutes. Florida Statutes 319.27 – Liens and Encumbrances
Releasing the Lien When the Loan Is Paid Off
When the borrower makes the final payment, you release the lien on a different form, HSMV 82260, not on 82139. The deadlines are short. For motor vehicles, mobile homes, and off-highway vehicles, the lienholder has 10 working days from receiving final payment to mail or deliver the satisfaction and the certificate of title. For vessels, the deadline is 30 days.6Florida Senate. Florida Statutes 319.24 – Issuance in Duplicate; Delivery; Liens and Encumbrances
Form 82260 must be signed by an authorized agent under penalty of perjury and mailed to FLHSMV’s Division of Motorist Services at 2900 Apalachee Parkway, Tallahassee, Florida 32399. The date of lien entered on the satisfaction must match the date on the title certificate.7Florida Department of Highway Safety and Motor Vehicles. Lien Satisfaction (Form HSMV 82260)
A lienholder who refuses to release within 30 days after the owner demands it becomes liable for costs, damages, and reasonable attorney fees in a lawsuit to cancel the lien, and failing to respond within 10 days to a department demand to forward the satisfaction or return the title is a second-degree misdemeanor.6Florida Senate. Florida Statutes 319.24 – Issuance in Duplicate; Delivery; Liens and Encumbrances Vessel satisfactions carry a parallel 30-day enforcement window with costs and attorney fees for a lienholder who stalls.8The 2025 Florida Statutes.
