Florida’s pseudoephedrine laws cap how much of the decongestant you can buy, require photo ID and an electronic log at the register, and make exceeding those limits a crime that starts as a misdemeanor and climbs to a felony with repeat offenses. The rules exist because pseudoephedrine (PSE) is a key ingredient in methamphetamine, and the state classifies it as a listed precursor chemical under Section 893.033.
How Much Pseudoephedrine You Can Buy
The caps apply to the actual PSE content in the product, not the weight of the package. They also cover ephedrine and phenylpropanolamine.
- No more than 3.6 grams of pseudoephedrine base in a single day, across any number of packages.
- No more than three packages in one retail transaction, regardless of weight.
- No more than 9 grams of pseudoephedrine base in any 30-day period across all retail purchases.
Every form counts: tablets, liquids, gel caps. Stores must keep these products behind the counter or in a locked area that customers cannot reach without an employee.1Florida Senate. Florida Code 893.1495 – Retail Sale of Ephedrine and Related Compounds
What You Need at the Counter
You must be at least 18 and present a government-issued photo ID showing your name, date of birth, address, and ID number. Certain alternative documents used for federal employment verification are also accepted. You then sign for the purchase, either on paper or through an electronic signature pad.1Florida Senate. Florida Code 893.1495 – Retail Sale of Ephedrine and Related Compounds
The Florida Department of Law Enforcement approves an electronic system that records every PSE sale in real time, including the date and time, your identifying information, the product, and the total grams. The system automatically blocks a sale that would push you past the daily or 30-day cap. It also shares data across participating states, so a purchase you make in Georgia counts toward your Florida limit, and vice versa.1Florida Senate. Penalties for Going Over the Limit or Faking ID
Exceeding the purchase caps or giving false identification is a crime in its own right, separate from any charge connected to drug manufacturing. Law enforcement calls the practice of spreading small purchases across stores “smurfing,” and the penalties climb with each offense.
- First offense: second-degree misdemeanor, up to 60 days in jail and a $500 fine.
- Second offense: first-degree misdemeanor, up to one year in jail and a $1,000 fine.
- Third or subsequent offense: third-degree felony, up to five years in state prison and a $5,000 fine.

When PSE Possession Becomes a Manufacturing or Trafficking Case
Under Florida Statute 893.149, knowingly possessing a listed chemical to manufacture a controlled substance, or passing one along knowing it will be used that way, is a second-degree felony. The maximum is 15 years in prison and a $10,000 fine.3Online Sunshine. Florida Code 893.149 – Unlawful Possession of Listed Chemical Prosecutors do not need to prove any meth was actually made. PSE found with other precursor chemicals, lab equipment, or recipes can be enough to carry the intent element, and this charge can stack on top of purchase-violation charges.
The harshest exposure comes under Section 893.135, Florida’s trafficking statute. Possessing 14 grams or more of methamphetamine, or possessing pseudoephedrine along with other chemicals and equipment used to make meth, is a first-degree felony called “trafficking in amphetamine.” Mandatory minimums are based on weight:
- 14 grams to under 28 grams: 3-year mandatory minimum and a $50,000 fine.
- 28 grams to under 200 grams: 7-year mandatory minimum and a $100,000 fine.
- 200 grams or more: 15-year mandatory minimum and a $250,000 fine.
Judges cannot sentence below these floors. Weight includes any mixture containing methamphetamine, not just the pure drug.4Justia Law. Florida Code 893.135 – Trafficking, Mandatory Sentences, Suspension or Reduction of Sentences, Conspiracy to Engage in Trafficking
Federal Law Alongside the State Rules
Florida’s limits sit on top of the federal Combat Methamphetamine Epidemic Act of 2005, which sets the same 3.6-gram daily and 9-gram 30-day caps, so you hit the state and federal ceilings at the same moment. Federal law also requires photo ID, behind-the-counter placement, and a logbook. One extra federal rule: all non-liquid forms of pseudoephedrine, including gel caps, must be sold in blister packs of no more than two doses per unit.5Drug Enforcement Administration. Lying on the federal purchase log can be prosecuted under 18 U.S.C. 1001, which carries up to a $250,000 fine and five years in federal prison. A false entry can expose you to both a state charge and a separate federal case.5Drug Enforcement Administration. CMEA General Information
