Florida Rules of Traffic Court: Fines, Points, 30-Day Deadline

If you were cited for a Florida traffic ticket, you have 30 days from the date on the citation to do one of three things: pay the fine, elect a driver improvement course, or request a hearing to contest it.1Justia Law. Florida Code 318.14 – Noncriminal Traffic Infractions; Exception; Procedures Which option you choose affects your fine, your insurance rate, and the points added to your driving record, so the decision is worth a few minutes of thought before you reach for your wallet.

What Happens If You Ignore the 30-Day Deadline

Miss the 30 days and the court notifies the Florida Department of Highway Safety and Motor Vehicles, which can suspend your driving privileges indefinitely until you resolve the citation. On top of the original fine, you’ll owe late fees, and once your license is suspended, a reinstatement fee to get it back. A $100 or $150 ticket can easily grow past $500 by the time all of those add up.

Over half a million Florida drivers are dealing with suspended licenses tied to unresolved traffic citations at any given time. If this has already happened to you, the fix is the same as if you’d responded on time, with the added steps of paying the late fees and the reinstatement fee.

Your Three Options Within 30 Days

Florida Statute 318.14 gives you three ways to resolve a non-criminal traffic citation.1Justia Law. Florida Code 318.14 – Noncriminal Traffic Infractions; Exception; Procedures

  • Pay the fine by mail, in person, or online. This is treated as an admission. The infraction goes on your driving record, points are assessed for moving violations, and your insurer will see it.
  • Elect a state-approved basic driver improvement course. If you’re eligible, adjudication is withheld, no points are added, and the base fine is reduced by 18 percent.
  • Request a hearing. You appear before a traffic hearing officer or county judge. Win and the citation is dismissed. Lose and you pay the full fine with points on your record.

Paying is the fastest option and usually the worst one for a moving violation. Points raise your insurance premiums, and enough of them trigger a license suspension. For most people with most tickets, the traffic school election is the better move. A hearing makes sense when you have a real defense or when the stakes are too high to accept the conviction.

When Traffic School Works, and When You Can’t Use It

You can elect a basic driver improvement course once in any 12-month period and no more than eight times in your lifetime.1Justia Law. Florida Code 318.14 – Noncriminal Traffic Infractions; Exception; Procedures2Florida DHSMV. Driver Improvement Courses FAQ If you already elected traffic school within the last year, the option isn’t available for a new citation. Once you’ve used all eight lifetime elections, it’s gone for good. Burning an election on a minor ticket now can cost you later when a worse one comes along.

Several citation types are excluded from the election entirely. You cannot use traffic school if you were speeding 30 or more miles per hour over the limit, if you hold a commercial driver’s license or commercial learner’s permit, or if the citation requires a mandatory court appearance.1Justia Law. Florida Code 318.14 – Noncriminal Traffic Infractions; Exception; Procedures If you complete the course, adjudication is withheld, the civil penalty drops by 18 percent, and no points attach to your record.

How Much Your Ticket Will Cost

Florida sets base fines by statute. County surcharges and court costs ride on top, often adding $100 or more to the total you actually pay.

Speeding

Speeding fines scale with how far over the limit you were driving:3Online Sunshine. Florida Code 318.18 – Amount of Penalties

  • 1–5 mph over: warning, no fine
  • 6–9 mph over: $25
  • 10–14 mph over: $100
  • 15–19 mph over: $150
  • 20–29 mph over: $175
  • 30+ mph over: $250

Those amounts double in school zones and construction zones.3Online Sunshine. Florida Code 318.18 – Amount of Penalties A second or subsequent conviction for speeding 30 or more mph over the limit within 12 months also doubles the fine.

Other Violations

The base fine for most moving violations that don’t involve speeding is $60. Non-moving violations like expired registration, equipment violations, and most parking infractions carry a $30 base fine, and non-moving violations do not add points to your driving record. Parking in a space reserved for people with disabilities carries a base fine of $100, or a higher amount set by county ordinance, plus court costs.3Online Sunshine. Points and the Suspension Thresholds

Florida assigns points for moving violation convictions based on severity:4Florida Senate. Florida Code 322.27 – Authority of Department to Suspend or Revoke License

  • 3 points: speeding 15 mph or less over the limit, most other moving violations
  • 4 points: speeding more than 15 mph over the limit, reckless driving, running a red light, passing a stopped school bus
  • 6 points: leaving the scene of a crash with property damage, speeding or phone use that causes a crash, passing a stopped school bus that results in serious injury or death

Accumulated points trigger automatic suspension at three thresholds:4Florida Senate. Florida Code 322.27 – Authority of Department to Suspend or Revoke License

  • 12 points in 12 months: suspension up to 30 days
  • 18 points in 18 months: suspension up to 3 months
  • 24 points in 36 months: suspension up to 1 year

This is the real argument for electing traffic school whenever you qualify. Two speeding tickets and a red-light violation in one year put you at 10 or 11 points, one ticket away from losing your license. An election keeps that count at zero.

Contesting the Ticket

To contest, you must request a hearing within the 30-day window. The hearing is held in the traffic division of the county court where the citation was issued, before a traffic hearing officer or a county judge. The citing officer typically appears as the state’s witness.

You can testify, call witnesses, and present evidence. Florida’s Rules of Traffic Court include a limited discovery provision for speed-related citations: the type of speed detection device and its serial number must appear on the citation itself, and any supporting documentation the officer has about that device must be made available for your review before trial.5The Florida Bar. Florida Rules of Traffic Court If the officer cannot produce calibration records or maintenance logs showing the radar or laser was properly maintained, that gap can undermine the state’s case.

Because civil infractions aren’t criminal proceedings, the court will not appoint an attorney for you. You can hire one, and for anything where your license is genuinely at risk, that’s worth considering. If you lose before a hearing officer, you can appeal to a county judge, but the appeal reviews whether the hearing officer applied the law correctly rather than retrying the facts.

Red-Light Camera Tickets Follow a Different Clock

Automated red-light camera citations issued under the Mark Wandall Traffic Safety Program don’t follow the 30-day rule. After a camera captures a violation, the registered owner receives a notice of violation by first-class mail within 30 days. That notice gives you 60 days to either pay $158, submit an affidavit identifying someone else as the driver, or request a hearing.6Florida Senate. Florida Code 316.0083 – Mark Wandall Traffic Safety Program

Ignore the 60 days and a formal traffic citation is mailed by certified mail, and the fine goes up. The citation is issued to the registered owner regardless of who was driving. Paying the initial $158 does not add points to your driving record, which makes a camera ticket less damaging than an officer-issued red-light citation, which carries 4 points.

If You Hold a CDL

Commercial driver’s license and commercial learner’s permit holders are excluded from the traffic school election under Section 318.14(9).1Justia Law. Florida Code 318.14 – Noncriminal Traffic Infractions; Exception; Procedures Federal regulations prohibit states from masking, deferring, or allowing diversion programs that would keep a traffic conviction off a CDL holder’s record, and that applies to any vehicle you were driving, not just commercial ones.7eCFR. 49 CFR 384.226 – Prohibition on Masking Convictions A ticket in your personal car on a Saturday still lands on your CDL record on Monday. Your only choices are to pay or to contest.

Out-of-State Tickets

Florida belongs to the Driver License Compact, which operates on “one driver, one license, one record.”8CSG. Driver License Compact A moving violation you pick up in another member state gets reported to the Florida DHSMV, which treats it as if it happened here. The reverse is also true for out-of-state drivers cited in Florida. Ignoring a citation in a state you were passing through can prompt that state to ask Florida to suspend your license until you clear it up. Non-moving violations like parking tickets generally aren’t covered by the compact.

If the Charge Is Criminal

Not every traffic charge is a civil infraction. DUI, reckless driving, driving on a suspended license in some circumstances, and leaving the scene of a crash with injuries are criminal traffic offenses handled in the criminal division of county court. You have the right to a jury trial, the right to an attorney, and the right to court-appointed counsel if you can’t afford one. A conviction creates a permanent criminal record. A first DUI alone carries a fine between $500 and $1,000, up to six months in jail, up to a year of probation, at least 50 hours of community service, and a 10-day vehicle impoundment, with sharper penalties if your blood-alcohol level was 0.15 or higher or a minor was in the car.9Justia Law. Florida Code 316.193 – Driving Under the Influence; Penalties If your citation falls into any of these categories, the three-option framework in this article does not apply, and you should talk to a lawyer before doing anything else.
