Florida sales tax exemption certificate requirements come down to three things: holding the right certificate for your situation, presenting it to the seller before or at the time of purchase, and keeping it current. Florida charges 6% state sales tax on most goods, rentals, and certain services, and Chapter 212 of the Florida Statutes carves out exemptions for specific buyers and specific uses. The way you claim one of those exemptions is by handing the seller a valid certificate or affidavit at the transaction, not after.
Which Certificate You Need
Florida issues different certificates for different exemptions. Using the wrong one won’t protect you if the Department of Revenue audits the transaction.
Annual Resale Certificate (Form DR-13)
If you buy goods to resell them, the Annual Resale Certificate is the document that lets you skip sales tax on those purchases. It tells the seller you’re buying for resale, not for your own use.1Florida Department of Revenue. Consumer’s Certificate of Exemption (Form DR-14)
Nonprofits with IRS 501(c)(3) status and governmental entities such as counties, municipalities, school districts, and state agencies use this certificate instead.3Florida Department of Revenue. Agricultural TEAM Card
Qualifying farmers can obtain a Florida Farm Tax Exempt Agricultural Materials (TEAM) card, which replaces paper exemption certificates for agricultural purchases. To qualify, you need either agricultural classification on your property from the county property appraiser or documented implementation of best management practices adopted by the Department of Agriculture and Consumer Services.5Florida Department of Revenue. Farmers who don’t qualify can still claim agricultural exemptions using a paper purchaser’s exemption certificate.
How to Apply
For the Annual Resale Certificate, you first register as a sales and use tax dealer by filing the Florida Business Tax Application (Form DR-1), either online or on paper.6Florida Department of Revenue. Instructions for Completing the Florida Business Tax Application Once approved, you receive both a Certificate of Registration (Form DR-11) and your Annual Resale Certificate (Form DR-13). As long as you remain a registered dealer, a new certificate is issued to you each year automatically.
Nonprofits and governmental entities apply for the Consumer’s Certificate of Exemption using Form DR-5. Nonprofits must include a copy of their IRS determination letter proving current 501(c)(3) status.3Florida Department of Revenue. Using the Certificate at Purchase
Present the certificate to the seller before or at the time of purchase. A physical signature is no longer required on the Annual Resale Certificate; presenting it certifies your intent to resell.1Florida Department of Revenue. The certificate must be current on the date of the transaction. A resale certificate from the previous calendar year doesn’t count after December 31. If you’re using a Consumer’s Certificate of Exemption, confirm the five-year expiration hasn’t passed.
Watch for one trap. If you buy something tax-free with a resale certificate and then use it in your business instead of reselling it, you owe use tax on that item and must report and pay it on your next sales and use tax return.8Florida Department of Revenue. Florida Sales and Use Tax
What the Seller Has to Do
A buyer’s certificate only protects the transaction if the seller documents it properly. Florida law requires a seller accepting a resale certificate to document the exempt nature of every transaction.9The Florida Legislature. - Keep a physical or electronic copy of the customer’s current Annual Resale Certificate.
- Verify the certificate for a single sale by calling 877-FL-RESALE (877-357-3725), using the online Seller Certificate Verification tool, or the FL Tax mobile app. The system issues a transaction authorization number good for that one sale.
- Upload a batch file through the online verification system to receive annual vendor authorization numbers valid for the whole calendar year. With this method, keeping a copy of the customer’s certificate isn’t required.1Florida Department of Revenue. Annual Resale Certificate for Sales Tax
A useful protection for sellers with regular customers: if you make recurring sales to a buyer who has a credit account or established cash account with you at least once every 12 months, you can rely on a resale certificate that was valid when you received it, without seeking annual re-verification.9The Florida Legislature. Accepting an expired or invalid certificate means the seller failed to document the exemption. The seller then has to remit the uncollected tax and faces penalties and interest.
How Long to Keep the Paperwork
The Department of Revenue’s standard audit lookback period is three years, and it can be extended if returns weren’t filed or were substantially incorrect.10Florida Department of Revenue. Sellers who rely on transaction or vendor authorization numbers instead of certificate copies should retain those numbers as their audit trail.
Penalties for Misuse
Fraudulent use of an exemption certificate carries a mandatory penalty of 200% of the tax evaded, on top of the tax itself. Someone who uses a fake or misapplied certificate to avoid $5,000 in tax owes that $5,000 plus a $10,000 penalty. Fraudulent use is also a third-degree felony under Florida law.11Florida Senate. Careless use is more common than outright fraud. Buying items with a resale certificate and then keeping them for personal or business use triggers use tax liability. Caught during an audit, you’ll owe the tax plus interest. Forgetting to self-assess use tax on a few items looks different from systematically using a resale certificate at office supply stores for things the business consumes. When the pattern suggests intentional evasion, the 200% penalty and criminal exposure come into play.
Getting a Refund If You Paid Tax by Mistake
If you paid sales tax on a purchase that should have been exempt, apply for a refund using Form DR-26SN. You have three years from the date the tax was paid to file.12Florida Department of Revenue. For refunds on exempt sales where tax was collected anyway, the Department of Revenue requires a copy of the exemption documentation that should have applied, accounting records showing the tax was reported and paid, and evidence that the seller refunded the tax to the buyer.13Florida Department of Revenue. The seller has to actually return the money to the buyer, and you need proof, such as a cancelled check, credit memo, or payment history showing the credit.
County Surtax
The 6% rate is only the state portion. Most counties add a discretionary sales surtax that varies by location; some charge nothing, others add up to 2% or more.14Florida Department of Revenue. When estimating how much tax the exemption is saving you, check your county’s current rate rather than assuming 6% flat.
