Florida Sales Tax Exemption for Manufacturing Equipment

Florida’s sales tax exemption for manufacturing equipment lets an eligible manufacturer buy qualifying industrial machinery without paying the state’s 6% sales tax or the local discretionary surtax of up to 1.5%.1Florida Senate. Florida Code 212.08 – Sales, Rental, Use, Consumption, Distribution, and Storage Tax; Specified Exemptions2Florida Department of Revenue. Discretionary Sales Surtax The exemption lives in Section 212.08(7)(jjj) of the Florida Statutes, and you claim it by handing your vendor a signed certificate at the time of purchase. If you already paid tax you shouldn’t have, you can recover it by filing a refund application with the Florida Department of Revenue.

Does Your Business Qualify

The statute limits the exemption to an “eligible manufacturing business.” Your primary business activity at the specific Florida location where the equipment will sit must fall within one of a short list of North American Industry Classification System codes: NAICS 31, 32, or 33 (the manufacturing sector), NAICS 112511 (finfish farming and fish hatcheries), or NAICS 423930 (recyclable material merchant wholesalers). Florida uses the 2007 edition of NAICS for this test.3Online Sunshine. Florida Code 212.08 – Sales, Rental, Use, Consumption, Distribution, and Storage Tax; Specified Exemptions

“Primary” has a concrete meaning: the qualifying activity has to be more than 50% of what happens at that location.1Florida Senate. Florida Code 212.08 – Sales, Rental, Use, Consumption, Distribution, and Storage Tax; Specified Exemptions A facility that mostly repairs third-party equipment but runs a side production line does not qualify, even if the production line uses expensive machines. The state looks at each site on its own, so a company with multiple locations may qualify at one and not another.

Postharvest crop activity businesses have a parallel path. If your primary activity at a Florida location falls under NAICS 115114, you can claim the exemption for postharvest machinery and equipment used there.1Florida Senate. What Equipment Is Covered

The exemption applies to “industrial machinery and equipment,” defined as tangible personal property with a depreciable life of three years or more that is used as an integral part of manufacturing, processing, compounding, or producing tangible personal property for sale.1Florida Senate. Florida Code 212.08 – Sales, Rental, Use, Consumption, Distribution, and Storage Tax; Specified Exemptions Both conditions have to be satisfied. A short-lived tool does not qualify even if it is central to production, and a long-lived asset used for office or administrative work does not qualify either.

In practice, that covers the machines that physically transform raw materials into finished goods: CNC machines, hydraulic presses, industrial ovens, conveyors, automated assembly systems, and similar production equipment. Computers running payroll, office furniture, break room appliances, and janitorial gear fall outside the exemption. Dual-use equipment is the gray area; if a machine splits its time between production and non-production work, the Department may challenge whether its real use is manufacturing when auditors show up.

Parts and Accessories

Parts and accessories for qualifying machinery can be purchased tax-free only if you buy them before the machinery is placed into service.4Florida Department of Revenue. Changes to Sales Tax Exemption for Machinery and Equipment Replacement parts bought after the equipment is already running on the floor are treated differently. Plan accessory purchases carefully during the commissioning window.

How to Claim the Exemption at Purchase

At the time of sale, give the vendor a signed certificate stating that you are entitled to the exemption under Section 212.08(7)(jjj). Once the vendor has that certificate, it is not required to collect sales tax on the transaction.1Florida Senate. Florida Code 212.08 – Sales, Rental, Use, Consumption, Distribution, and Storage Tax; Specified Exemptions The Florida Department of Revenue publishes a sample certificate format in its Tax Information Publication on the exemption.4Florida Department of Revenue. The certificate should include your business name, your Florida sales tax registration number, a description of the equipment, and a statement that it will be used at a fixed Florida location for qualifying manufacturing activity. Describe the equipment’s role specifically. “General industrial use” invites scrutiny; “CNC lathe for machining aluminum housings on the production line at [facility address]” tells the vendor and the state exactly what they need to know.

One point to be clear on: if the Department later decides you were not entitled to the exemption, it collects the unpaid tax from you, not the vendor.1Florida Senate. Florida Code 212.08 – Sales, Rental, Use, Consumption, Distribution, and Storage Tax; Specified Exemptions The signed certificate shields the seller. The purchaser carries the entire risk of a mistaken claim.

Getting a Refund for Tax Already Paid

If you paid sales tax on equipment that should have been exempt, file Form DR-26S, Application for Refund — Sales and Use Tax, with the Florida Department of Revenue. You can submit it through the Department’s online portal or by mail to the Refund Process office in Tallahassee.5Florida Department of Revenue. Tax Refunds Information

Include the documentation that proves the tax was paid and that the equipment belongs on the exempt side of the line: original invoices, receipts, and records tying the equipment to qualifying manufacturing activity at a Florida location. The application is not considered valid until the Department has all supporting documentation.5Florida Department of Revenue. Tax Refunds Information

You have three years from the date the tax was paid to file. Miss that window and the refund right is permanently barred.6Legal Information Institute. Florida Administrative Code Annotated R. 12-26.003 – Application for Refund On a large equipment purchase, the 6% state tax alone can run into tens of thousands of dollars, so the deadline matters.

A Different Program: The DR-1214 Temporary Permit

Do not confuse this exemption with the temporary tax exemption permit under Section 212.08(5)(b), which uses Form DR-1214 and is filed directly with the Department of Revenue for specific qualifying projects.7Florida Department of Revenue. Application for Temporary Tax Exemption Permit The Section 212.08(7)(jjj) certificate goes to your vendor for routine manufacturing equipment purchases. The DR-1214 permit covers a different, project-based situation. Using the wrong one can delay your savings or create a compliance problem.

Related Exemptions That Can Stack

Electricity, Steam, and Boiler Fuels

Electricity or steam used to operate machinery and equipment at a fixed Florida manufacturing location is exempt from sales tax, including the power that runs pollution control, recycling, and related maintenance and monitoring equipment. Boiler fuels burned in manufacturing processes, including natural gas, coal, residual oil, and wood, are also exempt.8Florida Department of Revenue. Sales Tax Incentives

Packaging Materials

Materials, containers, labels, and bags used to package tangible personal property for sale are not subject to sales tax if they are intended to accompany the product to the customer and are used one time only. The packaging must either be necessary because the product cannot practicably be delivered without it, or be used for the customer’s convenience.9Legal Information Institute. Florida Administrative Code Annotated R. 12A-1.040 – Containers and Other Packaging

Penalties for a Wrong or Fraudulent Claim

Florida treats exemption fraud harshly. Issuing a certificate fraudulently to evade sales tax means owing the tax plus a mandatory penalty of 200% of the unpaid amount, and fraudulent use of an exemption certificate is a third-degree felony.10Online Sunshine. Florida Code 212.085 – Fraudulent Claim of Exemption; Penalties That carries potential prison exposure on top of the financial penalty. Claiming the exemption for equipment that does not qualify, or for a facility whose primary activity is not manufacturing, is not a minor paperwork problem. Resolve any uncertainty before you sign the certificate, not after.

Recordkeeping and Audit Exposure

Manufacturers tend to attract audit attention because exempt purchases make up a large share of total purchases. The most common trigger is poorly documented exempt transactions. If an auditor cannot match every exempt purchase to a properly completed certificate, you will owe the tax plus interest.

Keep copies of every signed exemption certificate paired with the matching purchase invoice. Florida requires vendors to retain exemption certificates for at least three years.11Florida Department of Revenue. Annual Resale Certificate for Sales Tax As the purchaser, hold your records at least that long, and longer is better given the three-year refund window and the back-and-forth that audits often involve.

For each exempt machine, keep records showing its depreciable life, its specific function on the production floor, and its location in the facility. If a machine’s role changes, document the change. Auditors look at how the equipment is actually used, not just what the certificate said on the day you bought it.
