Florida’s short-barreled rifle laws don’t create a separate state permit; they ban possession of an SBR unless the firearm is registered under the federal National Firearms Act. Section 790.221 makes possession of an unregistered SBR a second-degree felony punishable by up to 15 years in prison and a $10,000 fine, while subsection (3) carves out an exception for firearms “lawfully owned and possessed under provisions of federal law.”1Florida Senate. Florida Code 790.221 – Possession of Short-Barreled Rifle, Short-Barreled Shotgun, or Machine Gun; Penalty In practice, that means a properly registered NFA rifle is legal in Florida, and everything else in this area of law is a detail hanging off that single rule.
What Counts as a Short-Barreled Rifle
Florida Statute 790.001(16) defines an SBR as a rifle with any barrel less than 16 inches long, or any weapon made from a rifle with an overall length under 26 inches.2Online Sunshine. Two thresholds, either one triggers SBR status. Cut a 16-inch barrel down, and you have an SBR. Leave a 16-inch barrel alone but shorten the stock so the overall length drops below 26 inches, and you also have an SBR. The “weapon made from a rifle” language is what makes the second trigger bite.
How the Measurements Work
ATF measures barrel length with a dowel rod inserted until it stops against the closed bolt face, marked at the muzzle, then withdrawn and measured. A muzzle device counts toward barrel length only if it is permanently attached by welding, silver soldering at 1,100°F or above, or a blind pin welded over.4Bureau of Alcohol, Tobacco, Firearms and Explosives. NFA Handbook – Chapter 2 – What Are Firearms Under the NFA A brake you can thread off by hand doesn’t count. Overall length is measured with any folding or collapsible stock extended.
If you’re building near either threshold, measure carefully and leave yourself margin. A fraction of an inch is the difference between a legal rifle and an unregistered NFA firearm.
The Federal Registration Exception Is the Whole Game
Section 790.221(3) states that firearms lawfully owned and possessed under federal law are excepted from Florida’s ban.1Florida Senate. Florida Code 790.221 – Possession of Short-Barreled Rifle, Short-Barreled Shotgun, or Machine Gun; Penalty Florida has no parallel state registration system. Register under the NFA, and your possession is lawful. Fail to register, and both Florida and federal law treat you as possessing contraband.
Registration runs through one of two ATF forms:
- ATF Form 1 if you’re making an SBR yourself from an existing receiver or rifle. The form must be submitted and approved before you make any physical modification.
- ATF Form 4 if you’re buying a completed SBR through a licensed dealer.
Either form requires a $200 tax payment, passport-style photographs, fingerprints on FBI Form FD-258, and a background check.5Bureau of Alcohol, Tobacco, Firearms and Explosives. eForms Applications You also send a copy of the completed form to your chief law enforcement officer. The CLEO notification is not a request for approval; the CLEO has no authority to deny the application.
Individual Registration vs. an NFA Trust
Register an SBR as an individual, and only you can legally possess it. Hand it to a friend at the range, or leave it accessible to a spouse when you’re not there, and that person is now in unlawful possession of an NFA firearm. An NFA trust changes the ownership structure so that any co-trustee listed on the trust can lawfully possess and use the firearm.
The cost is paperwork. Every “responsible person” on the trust submits fingerprints, photographs, and ATF Form 5320.23 for each application the trust files.6Bureau of Alcohol, Tobacco, Firearms and Explosives. National Firearms Act Responsible Person Questionnaire – ATF Form 5320.23 A responsible person is anyone with authority to direct the trust’s management or to possess, transport, or transfer its firearms. That’s typically the settlor and all trustees. A beneficiary without management authority generally isn’t a responsible person.
Trusts also smooth out what happens if the original owner dies. Because a trust survives the settlor, successor trustees continue to lawfully possess the firearms without a break in custody while a Form 5 is processed. For individually registered SBRs, the executor uses ATF Form 5 to transfer the firearm tax-free to a lawful heir; the $200 tax doesn’t apply because the transfer happens by operation of law rather than by sale.7Bureau of Alcohol, Tobacco, Firearms and Explosives. Penalties for Unregistered Possession
Florida
Unregistered SBR possession is a second-degree felony under Section 790.221.1Florida Senate. Florida Code 790.221 – Possession of Short-Barreled Rifle, Short-Barreled Shotgun, or Machine Gun; Penalty The maximum sentence is 15 years in prison8Online Sunshine. Florida Statutes Section 775.082 and a fine of up to $10,000.9Online Sunshine. Florida Statutes Section 775.083 The statute reaches anyone who owns or has “care, custody, possession, or control” of an operable SBR, or one that “may readily be made operable.” Keeping a disassembled SBR in pieces does not avoid the charge.
Federal
Federal charges are separate and can be filed alongside state charges. Under 26 U.S.C. § 5871, an NFA violation carries up to 10 years in prison and a fine of up to $250,000 for an individual.10Office of the Law Revision Counsel. 26 USC 5871 – Penalties Any firearm involved is subject to seizure and forfeiture.11Bureau of Alcohol, Tobacco, Firearms and Explosives. Constructive Possession
You don’t have to assemble an SBR to be charged with possessing one. If you own an AR pistol lower along with a short barrel and a rifle stock, prosecutors can argue you constructively possess an unregistered SBR because you have both the power and the intent to put the parts together. An approved Form 1 or Form 4 for that receiver eliminates the issue. Owning the loose parts without a registration is a real risk.
Building Your Own SBR
Home builds are legal in Florida if you follow the sequence. File ATF Form 1, pay the $200 tax, and wait for the approved form to come back before touching the rifle.5Bureau of Alcohol, Tobacco, Firearms and Explosives. eForms Applications Cutting the barrel before you have the stamp is a federal felony even if you intended to register the finished product.
Once the form is approved, you must engrave the receiver before assembling the SBR. Under 27 CFR § 479.102, the markings include the maker’s name (or a recognized abbreviation), the city and state of manufacture, a serial number, and where applicable a caliber and model designation, all to a minimum depth of .003 inches.12ATF eRegulations. 27 CFR 479.102 – Identification of Firearms
Traveling Out of Florida With a Registered SBR
Federal law requires ATF approval before you take an SBR across state lines. Under 18 U.S.C. § 922(a)(4), non-licensed individuals may not transport SBRs in interstate commerce without authorization.13Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts You get that authorization by filing ATF Form 5320.20 and waiting for the approved copy before moving the firearm.14Bureau of Alcohol, Tobacco, Firearms and Explosives. Application to Transport Interstate or to Temporarily Export Certain NFA Firearms – ATF Form 5320.20 The requirement covers a weekend trip the same way it covers a permanent move.
Destination and transit states matter too. Some states ban SBRs entirely. The Firearm Owners’ Protection Act’s safe-passage provision may give you a defense at trial if your route passes through one of those states, but it does not prevent arrest or seizure. Verify SBR legality in every state on the route before you leave.
Exceptions Worth Knowing
Antique Firearms
Section 790.221(1) exempts antique firearms.1Florida Senate. Florida Code 790.221 – Possession of Short-Barreled Rifle, Short-Barreled Shotgun, or Machine Gun; Penalty Under the NFA, that means a firearm manufactured in or before 1898 that was not designed for rimfire or conventional centerfire fixed ammunition, plus certain replicas and muzzleloaders that cannot fire modern fixed ammunition.3Office of the Law Revision Counsel. 26 USC 5845 – Definitions The firearm has to genuinely qualify; being merely old is not enough.
Pistol Braces
ATF’s 2023 rule reclassifying many brace-equipped pistols as SBRs was vacated in Mock v. Bondi. As of mid-2025, the government dismissed its appeal and the vacatur stands, so braced pistols are not currently classified as SBRs under federal law, no tax stamp is required, and there is no retroactive registration obligation. A future rulemaking could revisit the issue.
Law Enforcement and Military
Agencies that possess NFA firearms through official channels satisfy the federal registration requirement, which pulls their SBRs under the Section 790.221(3) exception. ATF’s Government Support Branch processes those applications.15Bureau of Alcohol, Tobacco, Firearms and Explosives. National Firearms Act Individual officers have no personal exemption. The exception flows from the agency’s registration, not the badge.
Common Defenses
When SBR charges are filed, the strongest defenses usually attack the classification itself. A barrel that measures at or above 16 inches by the ATF’s dowel method, or an overall length at or above 26 inches, means the firearm isn’t an SBR regardless of appearance. Fourth Amendment challenges to the search that produced the firearm are the other common line. Cases turn on measurement records, registration documents, and the circumstances of the search.
