Florida Sin Tax: Tobacco, Alcohol, and Gambling Rates

Florida’s sin taxes are excise charges the state adds to cigarettes, other tobacco, alcoholic beverages, and gambling on top of the regular 6% sales tax. A standard 20-pack of cigarettes carries $1.339 in combined state excise and surcharge. Alcohol runs from $0.48 per gallon on beer to $9.53 per gallon on the strongest spirits. Other tobacco products are taxed at an effective 85% of wholesale. Slot machine revenue at licensed pari-mutuel facilities is taxed at 35%. These charges are paid by distributors and operators and built into the shelf or ticket price, so consumers rarely see them itemized.

Cigarettes and Other Tobacco

Cigarettes are taxed under two statutes that work together. Section 210.02 sets a base excise tax that works out to 33.9 cents on a standard 20-pack (cigarettes weighing no more than 3 pounds per thousand).1Florida House of Representatives. Florida Code 210.02 – Cigarette Tax Imposed; Collection Section 210.011 adds a $1.00 surcharge per pack.2Florida Senate. Florida Code 210.011 – Cigarette Surcharge Levied; Collection Together, that is $1.339 per standard pack.

Heavier and longer cigarettes pay more. Cigarettes over 3 pounds per thousand and 6 inches or less carry 67.8 cents base tax plus a $2.00 surcharge per 20-pack. Cigarettes longer than 6 inches carry 135.6 cents plus a $4.00 surcharge.2Florida Senate. Florida Code 210.011 – Cigarette Surcharge Levied; Collection Tax is owed on the first sale or transfer inside the state, including sales from one distributor to another.1Florida House of Representatives. Non-cigarette tobacco (loose tobacco, snuff, chewing tobacco, pipe tobacco) uses a percentage model instead. The base tax on distributors is 25% of the wholesale price,3Florida Senate. Florida Code 210.30 – Tax on Tobacco Products; Exemptions and a surcharge adds another 60% of wholesale,4Online Sunshine. Florida Code 210.276 – Surcharge on Tobacco Products bringing the effective rate to 85% of wholesale.

Vapes and electronic nicotine devices are not subject to a Florida excise tax. They pay only the standard 6% state sales tax and any county surtax. Proposals to add a vape excise come up in the legislature regularly, but none have passed as of 2026.

Alcohol Excise Rates

Alcohol excise taxes are set per gallon and paid by manufacturers and distributors, who pass the cost through at retail. Beer is $0.48 per gallon in kegs and barrels, or $0.06 per pint in smaller containers.5Online Sunshine. Florida Code 563.05 – Excise Taxes on Malt Beverages

Wine rates depend on alcohol content and style:

  • Table wine under 17.259% ABV: $2.25 per gallon
  • Fortified wine at 17.259% ABV and above: $3.00 per gallon
  • Natural sparkling wine: $3.50 per gallon
  • Cider up to 7% ABV: $0.89 per gallon

These sit in Section 564.06.6Online Sunshine. Florida Code 564.06 – Excise Taxes on Wines and Beverages

Spirits carry the highest rates:

  • Spirits between 17.259% and 55.78% ABV: $6.50 per gallon
  • Spirits above 55.78% ABV: $9.53 per gallon
  • Spirits below 17.259% ABV are taxed at the $2.25 wine rate instead

Those spirits rates come from Section 565.12.7Florida Senate. Gambling Taxes

Slot machine gambling is limited to licensed pari-mutuel facilities in Miami-Dade and Broward counties where voters approved slots by referendum. Operators pay a 35% tax on slot revenue, defined as money dropped into machines minus winnings paid to players. Every dollar collected goes to the Educational Enhancement Trust Fund for public schools. Each licensed facility also pays a $2 million annual license fee that funds the Florida Gaming Control Commission and the Department of Law Enforcement’s gaming oversight.8Online Sunshine. Pari-mutuel wagering (horse racing, greyhound racing, jai alai) is governed by Chapter 550 and carries per-event daily license fees: $100 per horserace, $80 per dograce, and $40 per jai alai game. Simulcast daily fees are capped at $500 regardless of how many out-of-state events a facility takes. Separate tax rates apply to the amounts wagered at each type of facility.9Florida Senate. Florida Code 550.0951 – Payment of Daily License Fee and Taxes; Penalties

The largest single stream of Florida gambling revenue comes through the 2021 Gaming Compact with the Seminole Tribe rather than any excise statute. The Tribe makes revenue-sharing payments on a tiered schedule: 12% to 25% on slot machines, raffles, and new games depending on net win; 15% to 25% on table games; and 13.75% on most sports betting, or 10% when a bet is placed through a pari-mutuel-branded platform. The compact makes the Tribe the sole authorized operator for mobile sports wagering in Florida.10Bureau of Indian Affairs. Seminole Tribe and State of Florida Tribal State Gaming Compact

Who Pays and When

You don’t pay these taxes at the register. Distributors of alcohol and tobacco, and operators of gaming facilities, remit directly to the state. For cigarettes, payment is due by the 10th of the month after the sale.1Florida House of Representatives. Florida Code 210.02 – Cigarette Tax Imposed; Collection Alcohol distributors file monthly on the same 10th-of-the-month cycle,6Online Sunshine. Returns must break sales out by product category and tax bracket. Lumping table wine with sparkling wine, for example, understates the tax owed, because the per-gallon rates differ. The Division of Alcoholic Beverages and Tobacco within the Department of Business and Professional Regulation publishes current rate schedules for distributors to match products against.12Florida Department of Business and Professional Regulation. Filing on time earns a small collection allowance. Wine distributors, for example, keep 1.9% of the tax due as compensation for record-keeping and bonding costs. Late payment forfeits the allowance entirely.6Online Sunshine. Florida Code 564.06 – Excise Taxes on Wines and Beverages

Penalties for Noncompliance

Willfully making false entries in the records required under the Beverage Law is a third-degree felony, carrying up to five years in prison and a $5,000 fine. A first-time Beverage Law violation without a specific penalty is a second-degree misdemeanor, but any subsequent conviction becomes a third-degree felony. Possessing alcohol on which the excise tax hasn’t been paid creates personal liability for the unpaid amount, which the Division can collect by direct suit.13Florida Senate. Florida Code 562.16 – Possession of Beverages Upon Which Tax is Unpaid

On the tobacco side, a distributor or dealer that fails to file has 10 days after receiving notice to submit a correct return. Miss that window, and the Division can determine the tax owed on its own, reaching back up to three years. The determination becomes final unless the taxpayer requests a hearing within 30 days.14Florida Senate. Florida Code 210.13 – Determination of Tax Beyond fines and criminal exposure, the Division can suspend or revoke the operating license, which for most licensees is the sharper threat.

Federal Taxes Still Apply

Florida’s rates are on top of federal excise taxes, not instead of them. Businesses handling alcohol or tobacco owe both layers. Federal rates set by the Alcohol and Tobacco Tax and Trade Bureau include:

  • Beer: $18.00 per barrel at the general rate; $3.50 on the first 60,000 barrels for small domestic brewers producing 2 million barrels or less
  • Still wine at 16% ABV and under: $1.07 per gallon, with small-producer credits
  • Sparkling wine: $3.40 per gallon
  • Distilled spirits: $13.50 per proof gallon generally; $2.70 on the first 100,000 proof gallons for eligible domestic producers

These rates have been in effect since 2018 and apply uniformly across states.15Alcohol and Tobacco Tax and Trade Bureau. Tax Rates Businesses owing federal excise taxes on alcohol, tobacco, or wagering file IRS Form 720 quarterly, with deadlines on April 30, July 31, October 31, and January 31.
