Florida Speeding Laws: Fines, Points, and 30-Day Options

A Florida speeding ticket carries a base fine between $25 and $250 depending on how many miles per hour you were over the limit, plus 3, 4, or 6 points on your driving record. Florida speeding ticket fines and points both climb with the severity of the violation, and mandatory court costs and county surcharges usually push the total you actually owe well above the base fine. You have 30 days from the date on the citation to pay, elect traffic school, or request a hearing, and that choice decides whether points land on your record at all.

Base Fines by Speed Over the Limit

Florida’s fine schedule is set by how far over the posted limit you were driving:1Florida Senate. Florida Code 318.18 – Amount of Penalties

  • 1–5 mph over: warning, no fine
  • 6–9 mph over: $25
  • 10–14 mph over: $100
  • 15–19 mph over: $150
  • 20–29 mph over: $175
  • 30 mph or more over: $250

Those are base fines only. Every moving violation also carries mandatory court costs of at least $35, and state and county surcharges can more than double what you actually owe.2Official Internet Site of the Florida Legislature. Florida Code 318.18 – Amount of Penalties A $100 base fine can end up around $250 by the time everything is added. The exact figure depends on the county, so the Clerk of Court where the ticket was issued has the precise number.

School Zones and Active Construction Zones

Fines double in a school zone across the whole schedule. Even 1–5 mph over costs $50 instead of a warning, 10–14 over becomes $200, and 30 or more over becomes $500.2Official Internet Site of the Florida Legislature. Florida Code 318.18 – Amount of Penalties

Construction zone fines double under the same rule, but only when workers are actually present or operating equipment on or immediately next to the road, and the posted signs must state both the speed limit and that fines are doubled.2Official Internet Site of the Florida Legislature. Florida Code 318.18 – Amount of Penalties Passing through an empty work zone at 3 a.m. doesn’t trigger the doubled fine.

Points on Your Driving Record

The Florida Department of Highway Safety and Motor Vehicles adds points to your record for every speeding conviction:3Florida Senate. Florida Code 322.27 – Authority of Department to Suspend or Revoke License

  • 3 points for speeding up to 15 mph over the limit
  • 4 points for speeding more than 15 mph over the limit
  • 6 points for any speeding violation that results in a crash

Points stack up and trigger mandatory suspensions at set thresholds:4Florida Department of Highway Safety and Motor Vehicles. Points and Point Suspensions

  • 12 points in 12 months: 30-day suspension
  • 18 points in 18 months: 3-month suspension
  • 24 points in 36 months: 1-year suspension

A single 4-point ticket on a clean record won’t suspend your license by itself. But two 4-point tickets and one 3-point ticket in the same year puts you at 11, one small infraction from a 30-day suspension.

Your Three Options Within 30 Days

You have 30 calendar days from the date on the citation to choose one of three responses. Miss that window and a $16 late penalty is added, followed by a compliance letter and eventually a license suspension.5Florida Senate. Florida Code 318.18 – Amount of Penalties

Pay the Fine

Paying is an admission of guilt. Points go on your record, and your insurer will likely see the conviction at your next renewal. Payment goes to the Clerk of Court in the county where the ticket was issued, and many counties accept it online.

Elect Traffic School

If you’re eligible, you can elect a Basic Driver Improvement course instead of taking the points. Notify the Clerk of Court within 30 days, pay the fine (plus any county administrative fee), and complete the course within 90 days of enrollment.6Florida Department of Highway Safety and Motor Vehicles. Driver Improvement Schools When you finish on time, no points are assessed, the court withholds adjudication of guilt, and your fine is reduced by 18 percent.7Florida Senate. Florida Code 318.14 – Noncriminal Traffic Infractions; Exception; Penalties The catch: you can only use this option once every 12 months and no more than eight times in your lifetime.

Contest the Ticket

Request a court hearing, also within 30 days, and you’ll get a date to argue your case before a judge. Win, and the ticket is dismissed with no fine and no points. Lose, and you owe the full fine with points. Missing the hearing date triggers an automatic suspension and additional fees.

Why Traffic School Protects Your Insurance

The insurance benefit of traffic school is written into Florida law. When the court withholds adjudication and no points are assessed, which is what happens when you complete the course, your insurer is prohibited from raising your premium, canceling your policy, or refusing to renew it because of that ticket.8Florida Senate. Florida Code 626.9541 – Unfair Methods of Competition and Unfair or Deceptive Acts or Practices Defined

One exception: if the speeding violation involved a crash where your insurer paid a claim based on your fault, that protection does not apply.8Florida Senate. Florida Code 626.9541 – Unfair Methods of Competition and Unfair or Deceptive Acts or Practices Defined For every other driver, a single speeding conviction can add hundreds of dollars a year to a premium, so the course fee pays for itself.

If you just pay the fine, the conviction and points appear on your record, and your insurer can factor them in at renewal.

What Happens If You Miss the 30-Day Deadline

Ignoring the citation starts a predictable chain of escalating costs. After 30 days without a response, a $16 late penalty is added.5Florida Senate. Florida Code 318.18 – Amount of Penalties The clerk sends a compliance letter, usually with its own fee, and if you still don’t respond, FLHSMV suspends your driver license.

Once suspended, traffic school is off the table for that citation. You can’t just pay the original fine either: you’ll owe it plus the late penalty, collection fees, and a reinstatement fee. The 30-day deadline is the single most important date on the ticket, and missing it eliminates your best options while making everything more expensive.

Speeding 30 or More Over the Limit

Once you hit 30 mph or more over the posted limit, paying the fine or electing traffic school through the standard route is no longer available. Florida requires a mandatory court appearance at that tier.7Florida Senate. Florida Code 318.14 – Noncriminal Traffic Infractions; Exception; Penalties The base fine is $250 before surcharges.1Florida Senate. Florida Code 318.18 – Amount of Penalties

At 50 mph or more over the limit, a separate statute takes over:9Justia. Florida Code 316.1926 – Additional Offenses

  • First offense: mandatory minimum fine of $1,000
  • Second offense: mandatory minimum fine of $2,500
  • Third offense: third-degree felony, up to $5,000 in fines, up to five years in prison, and license revocation up to 10 years

A third-degree felony reaches well beyond traffic consequences into employment, housing, and civil rights. Anyone facing a second or third charge at this level should consult a defense attorney rather than handle it alone.

Commercial Driver License Holders

If you hold a CDL, two rules change. First, CDL holders cannot elect traffic school to avoid points on any speeding ticket, regardless of whether the violation happened in a commercial vehicle or a personal one.10Florida Department of Highway Safety and Motor Vehicles. Driver Improvement Courses FAQ Every conviction posts to the record with full points.

Second, speeding 15 mph or more over counts as a “serious traffic violation” under CDL rules. Two of them in separate incidents within three years is a 60-day disqualification from commercial driving. Three in three years is 120 days.11Florida Senate. Florida Code 322.61 – Disqualification From Operating a Commercial Motor Vehicle For a driver whose income depends on the license, a single 4-point ticket starts a three-year clock with very little margin.

Out-of-State Drivers

A Florida ticket doesn’t disappear when you cross the state line. Florida belongs to both the Driver License Compact and the Nonresident Violator Compact. Under the first, Florida reports the conviction to your home state, and your home state treats the offense as if it happened there, including assessing points under its own system.12National Center for Interstate Compacts. Driver License Compact Under the second, ignoring the citation entirely prompts Florida to notify your home state, which will suspend your license until you resolve the Florida ticket.13Florida Senate. Florida Code 322.50 – Nonresident Violator Compact

Out-of-state drivers who meet Florida’s eligibility rules can still elect traffic school and complete an approved Florida course online from anywhere.
