A Florida tax ID number usually means one of two things, and most businesses need both: a federal Employer Identification Number (EIN) issued by the IRS, and a Florida tax registration number issued by the state Department of Revenue. The EIN comes first because Florida’s application asks for it. The state number follows only if your business triggers a Florida tax, most commonly sales tax, reemployment tax, or corporate income tax.
Which Numbers Your Business Actually Needs
The federal EIN identifies your business for every IRS matter. The Florida registration number ties you to specific state tax programs. They are separate numbers issued by separate agencies, and needing one does not automatically mean you need the other.
You need an EIN if your business is a corporation, partnership, or LLC, if you pay wages to any employee, or if you owe federal excise taxes on things like alcohol, tobacco, or firearms. A sole proprietor with no employees and no excise obligations is the main exception and can generally use a Social Security Number for federal tax purposes.1Internal Revenue Service. You need a Florida tax registration number if your activity triggers a state tax. The three common triggers are selling taxable goods or services, hiring employees, and earning corporate income in Florida. Getting Your Federal EIN
The IRS offers three application methods: online, fax, and mail. Online is fastest and issues the number immediately.
Applying Online
The IRS EIN online tool is available Monday through Friday from 6:00 a.m. to 1:00 a.m. Eastern, Saturday from 6:00 a.m. to 9:00 p.m., and Sunday from 6:00 p.m. to midnight. The application must be finished in one sitting; the system doesn’t save progress and times out after 15 minutes of inactivity.4Internal Revenue Service. Get an Employer Identification Number
Have this information ready before you start:
- The entity’s legal name and principal business address
- The entity type (sole proprietorship, partnership, corporation, or LLC)
- The reason you’re applying
- The responsible party’s name and Social Security Number or ITIN
The responsible party is the individual who controls the entity’s funds and assets. It must be a person, not another business.5Internal Revenue Service. One quirk catches new business owners off guard: even though the IRS issues the EIN on the spot, you cannot e-file a return or make electronic tax payments with it for about two weeks. Applying by Fax, Mail, or Phone
If online isn’t an option, you can complete Form SS-4 and fax it in. The IRS typically returns the EIN within four business days. Mail takes four to five weeks. Applicants whose business has no U.S. address or legal residence must apply by phone; that is the only method available to them, and the IRS issues the EIN during the call.6Internal Revenue Service. Once issued, an EIN is permanent. It stays with the entity for its entire existence.
When Florida Requires a State Tax Number
Florida does not require every business to register with the Department of Revenue. Registration is tied to specific tax obligations.
Selling Taxable Goods or Services
Businesses that sell, rent, or lease tangible goods or certain taxable services in Florida must register to collect and remit the state’s 6% sales tax.7Florida Department of Revenue. Tax and Interest Rates Many counties add a discretionary surtax that gets collected through the same registration.
Registered sellers also receive a Florida Annual Resale Certificate, which lets you buy inventory for resale without paying sales tax on those purchases.8Florida Department of Revenue. Annual Resale Certificate for Sales Tax
Out-of-state sellers are not off the hook. Florida’s economic nexus law requires any remote seller with more than $100,000 in taxable Florida sales during the previous calendar year to register and collect sales tax, even without a physical presence in the state.9The Florida Legislature. Hiring Employees
The first Florida hire triggers reemployment tax, which is what most states call unemployment tax. It’s funded entirely by the employer; nothing comes out of employee wages. New employers start at 2.7% on the first $7,000 of each employee’s annual wages, a maximum of $189 per employee in the first year. Earning Corporate Income
Florida imposes a 5.5% corporate income tax on corporations and LLCs that elect corporate taxation. The first $50,000 of net income is exempt, but every qualifying corporation with Florida-sourced income must file a return, even one showing zero tax due.11Florida Department of Revenue. Florida has no personal income tax, so pass-through entities like sole proprietorships and single-member LLCs that don’t elect corporate taxation generally don’t register for state income tax.
How to Register With the Florida Department of Revenue
Florida uses a single online application, the Florida Business Tax Application (Form DR-1), to register for all applicable state tax accounts at once. The system’s interactive wizard determines which accounts you need based on your answers, so there’s no separate application for sales tax versus reemployment tax.2Florida Department of Revenue. The application starts with your EIN. From there, expect questions about your business operations, the physical address of every Florida location, your estimated start date for collecting sales tax, the types of goods or services you sell, your expected number of employees, and the first date you plan to pay wages.
Unlike the IRS online tool, the Florida system lets you create a profile and return later. If you prefer paper, you can download and mail Form DR-1 instead. Allow up to three business days for online applications to be processed. Once approved, you receive a registration certificate, your Florida Tax Registration Number, and an assigned filing frequency (monthly, quarterly, or annually) based on your projected tax liability. Penalties for Skipping Registration or Missing Deadlines
Penalties depend on the tax involved and add up quickly.
For sales tax, failing to file a return or pay by the due date adds a penalty of 10% of the unpaid amount, with a $50 minimum. Underreporting triggers a penalty that starts at 10% for the first 30 days and grows by another 10% for each additional 30-day period, up to a maximum of 50% of the unpaid amount. A fraudulent return carries a 100% penalty plus criminal charges, and willfully failing to file six consecutive returns is a third-degree felony.12Florida Senate. For reemployment tax, missing a report deadline costs $25 for every 30-day period or partial period the report is late. Filing an inaccurate or incomplete report costs $50 or 10% of the tax due, whichever is greater, up to $300 per report. If you ignore notices, the state can estimate what you owe and assess you for that amount with interest. An employer who refuses to file or pay can be legally prohibited from employing anyone until the delinquency is resolved.13The Florida Legislature. Both taxes accrue interest on unpaid balances, generally at a rate that cannot exceed 1% per month from the original due date.
Keeping and Closing Your Tax Accounts
Your registration details need to stay current. On the federal side, address changes and responsible party changes go on Form 8822-B. A change of responsible party must be reported within 60 days, a detail founders often miss when ownership shifts.14Internal Revenue Service. When you close or sell the business, close both accounts. To close the federal EIN account, send a letter to the IRS at Cincinnati, OH 45999 with the business’s legal name, EIN, address, and the reason for closing.
