Florida Tax on Electronics: Rates, Holidays, and Use Tax

Florida tax on electronics starts at a 6% state sales tax on nearly every physical device you buy, with county surtaxes of 0.5% to 1.5% pushing the total as high as 7.5% depending on where the item is delivered.1The Florida Legislature. Florida Code 212.05 – Sales, Storage, Use Tax2Florida Department of Revenue. Discretionary Sales Surtax Digital downloads escape sales tax entirely, streaming services get taxed under a different and higher framework, and once a year the state waives tax on computers and accessories under $1,500 during the Back-to-School Sales Tax Holiday.

How the Rate Is Built

The 6% base comes from Florida Statutes Section 212.05, which taxes the retail sale of tangible personal property.1The Florida Legislature. Florida Code 212.05 – Sales, Storage, Use Tax Most counties add a discretionary surtax between 0.5% and 1.5%, and a few add none at all.2Florida Department of Revenue. Discretionary Sales Surtax The surtax that applies is the one in effect in the county where the item is delivered, not where the seller is located. On a $1,000 laptop in a county with a 1% surtax, you pay $60 in state tax plus $10 in surtax for a total of $70.

What Counts as Taxable Electronics

Any physical electronic device is tangible personal property and carries the full rate: computers, laptops, tablets, smartphones, televisions, gaming consoles, cameras, and smartwatches. Accessories ride along at the same rate, including monitors, keyboards, mice, printers, routers, external drives, charging cables, and headphones.1The Florida Legislature. Florida Code 212.05 – Sales, Storage, Use Tax Software on a physical disc or USB drive is taxable because the medium is tangible. The intended use doesn’t matter. A laptop for a home office, a tablet for a child, and a monitor for a gaming setup are all taxed the same way.

Digital Downloads and Streaming Services

This is where buyers lose the most money by guessing. A purely digital product you download, like software, an e-book, a music file, or a mobile app, is not tangible personal property. It doesn’t exist on a physical disc or drive, so Florida sales tax doesn’t apply. Buying a digital copy of an operating system or a video game through an online store carries no sales tax.

Streaming is a separate story. Video streaming, music streaming, and satellite television fall under Florida’s Communications Services Tax instead of the standard sales tax. The combined state-level CST rate is 7.44%, made up of a 4.92% state tax and 2.52% in gross receipts taxes, and local governments add their own CST rates on top. Direct-to-home satellite service carries a combined 11.44% at the state level because local rates don’t apply to satellite.3Florida Department of Revenue. Florida Communications Services Tax The practical result is that the tax line on your Netflix or Spotify bill runs higher than the sales tax on a physical device.

Back-to-School Sales Tax Holiday

Once a year, Florida waives sales tax on personal computers and computer-related accessories priced at $1,500 or less, as long as they’re purchased for noncommercial home or personal use.4Florida Department of Revenue. Annual Back-to-School Sales Tax Holiday The “personal computers” category covers desktops, laptops, tablets, electronic book readers, and calculators. Qualifying accessories include printers, flash drives, and headphones.

The $1,500 cap is a cliff, not a sliding scale. A laptop priced at $1,499 is fully tax-free. A laptop priced at $1,501 is taxable on the entire purchase price, with no partial exemption on the first $1,500.4Florida Department of Revenue. Annual Back-to-School Sales Tax Holiday Items normally sold as a set can’t be broken apart and repriced to slip under the threshold. The 2025 holiday ran August 1 through August 31, and a 2026 holiday has been announced with a July start, though you should confirm final dates through the Department of Revenue before shopping. Retailers are required to apply the exemption automatically at the register; you don’t file for a refund later.

Disaster Preparedness Sales Tax Holiday

A narrower electronics category gets a break during the Disaster Preparedness Sales Tax Holiday. Portable self-powered radios, two-way radios, and weather-band radios priced at $50 or less qualify, along with portable power banks priced at $60 or less.5Florida Department of Revenue. Disaster Preparedness Sales Tax Holiday – Frequently Asked Questions for Consumers The 2024 version included two separate two-week windows. As with the back-to-school holiday, the dates and eligible items are set fresh each legislative session, so check current guidance before relying on them.

Online and Out-of-State Purchases

Buying online from an out-of-state seller doesn’t put you outside Florida’s tax. A remote seller whose taxable sales into Florida exceeded $100,000 in the previous calendar year is treated as a dealer and must collect Florida sales tax.6The Florida Legislature. Florida Code 212.0596 – Taxation of Remote Sales Florida uses a dollar-volume test only; there’s no transaction-count threshold.

Marketplace platforms like Amazon and eBay carry their own collection duty. When you buy from a third-party seller through one of these platforms, the platform itself collects and remits Florida sales tax.7Online Sunshine. Florida Code 212.05965 – Taxation of Marketplace Sales The surtax rate follows the delivery county, so an order shipped to Miami-Dade carries that county’s rate regardless of where the seller or warehouse sits.2Florida Department of Revenue. When Shipping Is Taxed

Whether shipping is taxable depends on how the charge appears on the invoice and whether you could have avoided it. The rules in Florida Administrative Code Rule 12A-1.045 break into three scenarios.8Legal Information Institute. Florida Admin Code 12A-1.045 – Transportation Charges

  • If shipping is bundled into the item price with no separate line, the full amount is taxable.
  • If shipping is a separate line but mandatory, with no store pickup or other alternative available, that charge is still taxable.
  • If shipping is a separate line and optional, meaning you could have picked up the item or chosen another fulfillment method, the shipping charge is not taxable.

Most large online retailers either bundle shipping into the transaction or offer “free shipping” baked into the listed price, so the full amount ends up subject to tax.

Use Tax When Nobody Collected Sales Tax

If you buy electronics from a seller who doesn’t collect Florida sales tax, whether that’s a small out-of-state business below the $100,000 threshold or a private seller, you owe use tax at the same 6% state rate plus your county’s surtax.9Florida Department of Revenue. Florida Sales and Use Tax Use tax applies whenever you bring a taxable item into Florida or have one delivered into the state without paying sales tax at purchase. Individual consumers can report it on their federal return or directly to the Department of Revenue. Most people ignore the obligation, and that works until it doesn’t.

Penalties for Unpaid Tax

Florida Statute 212.12 sets a tiered penalty structure.10Florida Senate. Florida Code 212.12 – Dealers Credit, Penalties, Hearings Late filing or late payment carries a flat 10% penalty on the tax due, with a $50 minimum. Tax that goes undisclosed on a return carries 10% of the unpaid amount for the first 30 days and another 10% for each 30-day period after that, capped at 50% of the unpaid tax. Interest runs at 1% per month, starting on the 21st day of the month following the month the tax was due. Fraud or willful evasion carries a specific penalty of 100% of the unreported tax plus potential third-degree felony charges.

On a $2,000 computer bought out of state and never reported in a 7% county, the base tax owed is $140. Left unreported for five months, the penalty alone can reach $70 on top of the original tax, plus interest.

Refurbished, Used, and Trade-Ins

Refurbished and used electronics are taxed on the full sales price, same as new. A refurbished laptop sold for $800 generates the same 6% state tax (plus county surtax) as a new one at the same price.1The Florida Legislature. Florida Code 212.05 – Sales, Storage, Use Tax Private sales between individuals are technically subject to the same rules through use tax, though enforcement on casual transactions is rare.

Florida allows a trade-in credit against sales tax for motor vehicles, but that benefit does not extend to electronics. Trading in an old phone or laptop toward a new one does not reduce the taxable price. You owe tax on the full price of the new device, not on the difference after the trade-in value is subtracted.
