Florida Transfer Taxes: Rates, Who Pays, and Exemptions

Florida transfer taxes come in three pieces at a typical closing: a documentary stamp tax on the deed at $0.70 per $100 of the price, a documentary stamp tax on the mortgage note at $0.35 per $100 of the loan, and a one-time intangible tax of 2 mills on the mortgage. Miami-Dade uses a different structure. By convention the seller pays the deed tax and the buyer pays the financing taxes, though the contract can shift that.

Documentary Stamp Tax on the Deed

Florida Statutes Section 201.02 imposes $0.70 for every $100 of consideration, or any fraction of $100, on deeds transferring an interest in Florida real property.1Florida Legislature. Florida Code 201.02 – Tax on Deeds and Other Instruments Relating to Real Property or Interests in Real Property That rate applies in 66 of Florida’s 67 counties.

The “fraction thereof” rule rounds up, not down. A $350,050 sale is taxed on $350,100, not $350,000. On a clean $450,000 sale, the math is 4,500 increments times $0.70, or $3,150.

What Counts as Consideration

Consideration is more than the cash price. The statute includes money paid, debt discharged, and the full amount of any mortgage or lien on the property, whether or not the buyer formally assumes the loan.2Florida Senate. Florida Code 201.02 – Tax on Deeds and Other Instruments Relating to Real Property or Interests in Real Property A buyer paying $200,000 in cash and taking over a $150,000 existing mortgage owes tax on $350,000. When property is swapped rather than sold, the state presumes the consideration equals the fair market value of the real property transferred.

Miami-Dade County Has Its Own Rate

Miami-Dade is the outlier. The base deed rate there is $0.60 per $100, not $0.70.3Florida Department of Revenue. Condominium and co-op units count as single-family for this exclusion, not just detached houses.4Florida Senate. A $500,000 Miami-Dade condo pays $3,000 in deed stamps. A $500,000 warehouse in the same county pays $5,250 because the combined $1.05 rate applies. Investors buying apartment buildings, retail space, or offices in Miami-Dade should budget for the higher combined rate.

Taxes on the Financing

Borrowing to buy adds two more state taxes. Section 201.08 taxes the promissory note at $0.35 per $100 of the loan amount, or any fraction of $100.5Florida Legislature. Florida Code 201.08 – Tax on Promissory or Nonnegotiable Notes, Written Obligations to Pay Money, or Assignments of Wages or Other Compensation On top of that, Florida imposes a one-time nonrecurring intangible tax of 2 mills, or $0.002 per dollar, on every new mortgage secured by Florida real property.6Florida Legislature. Florida Code 199.133 – Levy of Nonrecurring Tax That works out to $2 per $1,000 borrowed.

Run the numbers on a $360,000 loan. Note stamps come to $1,260. Intangible tax adds $720. That’s $1,980 in state taxes on the financing alone, separate from the $2,520 in deed stamps on the same $360,000 purchase price. Cash buyers avoid both financing taxes entirely.

Who Pays

All parties to a deed are jointly liable for the documentary stamp tax under Florida law. If one side doesn’t pay, the state can collect from the other.7Florida Department of Revenue. The standard convention across Florida is that the seller pays the deed stamps as part of delivering clear title and the buyer pays the note stamps and intangible tax on their own financing.

The convention is not the rule. Purchase contracts can shift the obligation either way, and new construction developers frequently push all transfer taxes onto the buyer. If the contract is silent, the seller bears the deed tax as the party executing the deed. Read the transfer-tax language before signing. A vague contract on this point creates confusion that tends to surface at the closing table.

When and How the Tax Is Paid

Documentary stamp tax is due when the deed is recorded with the county clerk.8Florida Legislature. Florida Code Chapter 201 – Excise Tax on Documents In most residential closings, the title company or closing agent collects the tax from the appropriate party at settlement and remits it when the deed is filed. The clerk will not record a deed without the correct tax amount. The line item appears on the Closing Disclosure, so both sides can check the calculation before funds move.

Exemptions and Zero-Consideration Transfers

Not every deed triggers tax. Some transfers are exempt outright; others produce no tax because there is no taxable consideration.

Divorce and Spousal Transfers

Deeds between spouses during a marriage carry no tax when the property is the couple’s homestead and the only consideration is the existing mortgage. Deeds between spouses or former spouses after a divorce are also exempt as long as the property was the marital home at the time of divorce.3Florida Department of Revenue. Corrective Deeds and Gifts

A corrective deed that fixes a clerical error on a previously recorded document generates no new tax, because the tax was paid on the original. Pure gifts, where no money changes hands and the recipient takes on no mortgage or lien, have zero consideration and therefore zero tax. If the recipient assumes a $200,000 mortgage as part of the gift, tax applies to that $200,000.

Transfers Into an LLC or Corporation

There is no special exemption for moving property into an entity for estate planning or liability protection. The Florida Department of Revenue treats any existing mortgage on the property as consideration even when the owner remains the sole beneficial owner of the entity.3Florida Department of Revenue. Chapter 11 Bankruptcy Sales

Federal law exempts property transfers made under a confirmed Chapter 11 reorganization plan from state stamp taxes. Under 11 U.S.C. ยง 1146(a), such a transfer cannot be taxed under any state law imposing a stamp or similar tax.9Office of the Law Revision Counsel. 11 U.S. Code 1146 – Special Tax Provisions This applies only to Chapter 11 reorganizations with a court-confirmed plan, not to Chapter 7 liquidations or ordinary foreclosure sales.

Penalties for Not Paying

Underpaying or skipping the tax carries both criminal and financial consequences. Under Section 201.17, failure to pay the full tax is a first-degree misdemeanor.8Florida Legislature. Florida Code Chapter 201 – Excise Tax on Documents The money side stacks up fast:

  • Late penalty of 10% of the unpaid tax for the first 30 days, plus another 10% for each 30-day period after that, capped at 50% of the total tax owed.
  • Interest at 1% per month on the unpaid balance, running from the original due date.
  • Fraud penalty of 200% of the deficiency instead of the standard late penalties, if the Department of Revenue proves fraud by clear and convincing evidence.

On a $3,150 tax bill, letting six months slide would add roughly $1,575 in penalties and about $189 in interest, nearly doubling the original obligation. The Department has authority to compromise penalties and interest, but planning around that is a gamble.

How Transfer Taxes Affect Your Federal Return

Florida documentary stamp taxes are not deductible as real estate taxes on a federal return. The IRS lists transfer and stamp taxes among the items that do not qualify for the real estate tax deduction.10Internal Revenue Service. Publication 530, Tax Information for Homeowners Buyers can add the tax they pay to the property’s cost basis, which reduces the taxable gain when they later sell.11Internal Revenue Service. Publication 551, Basis of Assets Sellers who pay the tax as a closing cost can treat it as a selling expense, which also reduces their taxable gain. The benefit shows up at the eventual capital gains calculation rather than as an immediate deduction.
