FMLA in West Virginia: Eligibility, Leave Length, and Job Protection

If you work in West Virginia, FMLA in West Virginia means two different things depending on who signs your paycheck: the federal Family and Medical Leave Act, which gives eligible workers up to 12 weeks of unpaid, job-protected leave each year, and the state’s own Parental Leave Act, which covers state agency and county school board employees under easier eligibility rules. Some public-sector workers are covered by both. Many private-sector workers at smaller companies are covered by neither.

Who Qualifies Under Federal FMLA

Three requirements have to line up before federal FMLA applies to you. You need 12 months of employment with your current employer (the months don’t have to run back-to-back). You need at least 1,250 hours of actual work in the 12 months just before leave starts. And your employer must have at least 50 employees working within 75 miles of your worksite.1Office of the Law Revision Counsel. 29 USC 2611 – Definitions

That last requirement is where coverage breaks down for a lot of workers in smaller West Virginia communities. A company with 35 employees at your location and 10 more at an office 60 miles away still falls short of the 50-employee threshold. All employees on the payroll count, not just full-timers, but the geographic radius closes the door for many.

Who Qualifies Under West Virginia’s Parental Leave Act

The state Parental Leave Act fills part of the gap, but only for employees of state government agencies and county boards of education.2West Virginia Legislature. West Virginia Code 21-5D – The Parental Leave Act Work for a private employer and this law does not apply to you, regardless of how long you’ve been there.

For those it does cover, eligibility comes faster. You qualify after 12 consecutive weeks of permanent employment, compared with the federal 12-month and 1,250-hour test.2West Virginia Legislature. West Virginia Code 21-5D – The Parental Leave Act There is no minimum employer size, since the act applies to state agencies and school boards regardless of headcount.

The state law also defines “dependent” more broadly than federal FMLA. Under West Virginia law, a dependent is anyone living with you or relying on your income, related or not.2West Virginia Legislature. West Virginia Code 21-5D – The Parental Leave Act Federal FMLA limits qualifying family to a spouse, child, or parent.

Reasons You Can Take Leave

Federal FMLA covers five categories:3Office of the Law Revision Counsel. 29 USC 2612 – Leave Requirement

  • Your own serious health condition that prevents you from doing your job.
  • Caring for a spouse, child, or parent with a serious health condition.
  • Bonding with a newborn, within 12 months of birth.
  • Bonding with a newly placed adopted or foster child, within 12 months of placement.
  • Qualifying needs arising from a family member’s active-duty military deployment, such as arranging childcare, attending military events, or handling financial and legal matters.

The state Parental Leave Act is narrower. It covers birth, adoption, and care for a son, daughter, spouse, parent, or dependent with a serious health condition.4West Virginia Legislature. West Virginia Code 21-5D-4 – Family Leave It does not cover your own serious health condition or military family needs. A state employee with a serious personal illness has to rely on federal FMLA, if eligible, rather than the state act.

How Much Leave You Get

Both laws cap leave at 12 workweeks within a 12-month period.3Office of the Law Revision Counsel. 29 USC 2612 – Leave Requirement One federal exception stretches that: military caregiver leave allows up to 26 workweeks in a single 12-month period when you’re caring for a servicemember or recent veteran with a serious injury or illness, and the 26-week cap includes any other FMLA leave you take during that same year.5U.S. Department of Labor. Fact Sheet 28M(a) – Military Caregiver Leave for a Current Servicemember under the Family and Medical Leave Act

Your employer gets to choose how the “12-month period” is measured. The four options are a calendar year, any fixed 12-month period (such as a fiscal year or your hire anniversary), a rolling period measured backward from each day you use leave, or a forward period measured from the first day you take leave.6U.S. Department of Labor. 12-Month Period under the Family and Medical Leave Act The method matters. Under a calendar-year method, you could take 12 weeks in December and 12 more in January. Under a rolling backward method, that same pattern leaves you with zero available leave in January. If your employer hasn’t picked a method, the one most favorable to you applies.

Intermittent leave is available when it’s medically necessary for a serious health condition. For birth or adoption bonding under federal FMLA, intermittent scheduling requires employer agreement.7eCFR. 29 CFR 825.202 – Intermittent Leave or Reduced Leave Schedule The state act is more flexible on part-time schedules for any covered reason, provided the overall leave period doesn’t stretch beyond 12 consecutive months.4West Virginia Legislature. West Virginia Code 21-5D-4 – Family Leave

Paid Time, Unpaid Leave, and the State Employee Trap

FMLA leave is unpaid by default. Federal law lets either you or your employer substitute accrued vacation, sick, or personal time for some or all of the unpaid period, and that paid time still counts as protected FMLA leave.8U.S. Department of Labor. FMLA Frequently Asked Questions

West Virginia’s Parental Leave Act takes a harder line. You must exhaust all your accrued annual and personal leave before unpaid family leave begins.4West Virginia Legislature. West Virginia Code 21-5D-4 – Family Leave For state and school board employees, that directly affects how long you’ll go without a paycheck, so check your balances early.

West Virginia does not have a state paid family leave program. Some employers voluntarily offer short-term disability insurance or paid parental leave policies that run alongside FMLA; if yours does, coordinate with HR so the paid and unpaid portions are tracked correctly against your 12-week entitlement.

Health Insurance During Leave

Your group health insurance keeps running throughout your FMLA leave on the same terms as if you were still working. Family coverage stays family coverage. The employer continues paying its share of premiums, and you remain responsible for yours.9eCFR. 29 CFR 825.209 – Maintenance of Employee Benefits

If you don’t come back to work after leave ends, the employer can recover the premium share it paid during your leave. But it cannot do so if the reason you didn’t return was a continuing or recurring serious health condition (yours or a family member’s) or other circumstances beyond your control.10U.S. Department of Labor. Family and Medical Leave Act Advisor You count as having “returned to work” once you’ve been back at least 30 calendar days.

Getting Your Job Back

When your leave ends, you’re entitled to your old position or an equivalent one with the same pay, benefits, schedule, and working conditions.11Office of the Law Revision Counsel. 29 USC 2614 – Employment and Benefits Protection Equivalent means virtually identical. A lower-paying role or a worse shift doesn’t qualify.

FMLA doesn’t give you more job security than you would have had without taking leave. If your employer eliminates your position in a legitimate company-wide layoff, you have no right to reinstatement just because you were out on leave, though the employer carries the burden of proving you would have lost the job anyway.12eCFR. 29 CFR 825.216 – Limitations on an Employee’s Right to Reinstatement The same applies if your fixed-term contract expires or your shift is permanently eliminated during leave.

There is a narrow “key employee” exception. If you’re a salaried worker among the highest-paid 10 percent of all employees within 75 miles of your worksite, your employer can deny restoration if bringing you back would cause substantial and grievous economic injury to the business.11Office of the Law Revision Counsel. 29 USC 2614 – Employment and Benefits Protection That standard is deliberately harder to meet than the ADA’s “undue hardship” test. The employer must tell you in writing when you request leave that you qualify as a key employee and spell out the possible consequences. Even then, you keep the right to take the leave and to maintain health insurance; only the restoration guarantee can be removed.

How to Request Leave

When the need is foreseeable, like a scheduled surgery or an expected due date, federal FMLA requires at least 30 days’ advance notice.13eCFR. 29 CFR 825.302 – Employee Notice Requirements for Foreseeable FMLA Leave For emergencies, notify your employer as soon as practicable, generally the same day or the next business day. West Virginia’s Parental Leave Act requires two weeks’ written notice for a foreseeable birth, adoption, or planned medical treatment.4West Virginia Legislature. West Virginia Code 21-5D-4 – Family Leave If both laws cover you, use the longer federal notice period when you can.

Your employer can require medical certification to back up the request. Use Department of Labor Form WH-380-E for your own serious health condition or Form WH-380-F for a family member’s.14U.S. Department of Labor. FMLA Forms The certification must state when the condition started, how long it’s expected to last, the relevant medical facts, and either that you can’t perform your job or that you’re needed to provide care.15Office of the Law Revision Counsel. 29 USC 2613 – Certification Incomplete forms are the most common cause of delay.

Once you’ve submitted your request, your employer has five business days to send you a written notice of eligibility telling you whether you meet the basic requirements and what documents you still owe. After reviewing your certification, the employer has another five business days to issue a designation notice confirming whether the leave qualifies as FMLA leave.16eCFR. 29 CFR 825.300 – Employer Notice Requirements

If Your Employer Violates Your Rights

If your employer fires you, demotes you, or retaliates against you for taking FMLA leave, you have two paths: file a complaint with the U.S. Department of Labor’s Wage and Hour Division, or sue in court. You generally have two years from the last violation to file a lawsuit, or three years if the violation was willful.17U.S. Department of Labor. Family and Medical Leave Act Advisor

The financial remedies are substantial. You can recover lost wages, salary, and benefits, plus interest. Courts then add liquidated damages equal to that total, effectively doubling the recovery. An employer can shrink liquidated damages only by proving it acted in good faith and genuinely believed it was following the law.18Office of the Law Revision Counsel. 29 USC 2617 – Enforcement The court also awards attorney’s fees and costs. FMLA does not allow damages for emotional distress or punitive damages, but the liquidated-damages rule carries enough weight that most employers take these claims seriously. Courts can also order equitable relief, including reinstatement or a denied promotion. West Virginia state employees covered by both acts may have additional administrative remedies through their agency’s grievance process.
