Taking job-protected leave as a New York employee means handling FMLA paperwork in New York under two parallel systems. Federal FMLA certification forms go to your employer and protect your job. New York Paid Family Leave forms go to your employer’s insurance carrier and provide partial wage replacement. Same leave event, two separate packets, two separate deadlines.
One boundary to settle before you start: New York PFL does not cover your own medical condition. If you’re the patient, your income replacement comes through New York short-term disability benefits, and your job protection comes through FMLA. PFL applies when you’re caring for a family member, bonding with a new child, or handling a military qualifying event.1Paid Family Leave. Paid Family Leave and Other Benefits
Federal FMLA Certification Forms
The U.S. Department of Labor publishes standardized certification forms, and the one you use depends on why you’re taking leave.2U.S. Department of Labor. FMLA Forms
- Form WH-380-E for your own serious health condition.
- Form WH-380-F to care for a family member with a serious health condition.
- Form WH-384 for qualifying exigency leave tied to a family member’s covered active duty or call-up. Your employer can require supporting documentation such as a copy of active duty orders.3U.S. Department of Labor. Certification for Military Family Leave for a Qualifying Exigency
- Forms WH-385 and WH-385-V for military caregiver leave when you’re caring for a current servicemember or a veteran with a serious injury or illness. Military caregiver leave runs up to 26 weeks in a single 12-month period for a spouse, child, parent, or next of kin.4Office of the Law Revision Counsel. 29 USC 2612 – Leave Requirement
You complete the first section yourself with your employment information and the general reason for leave. Your doctor or your family member’s doctor fills out the medical portion. Federal regulations require that section to include when the condition began, how long it’s expected to last, and enough medical facts to support the need for leave. For your own leave, the provider has to explain why you can’t do your job duties. For a family member’s leave, the provider has to describe why that person needs your care and estimate how often and how long you’ll be out.5eCFR. 29 CFR 825.306 – Content of Medical Certification
Read the completed form before you turn it in. Blank fields and illegible handwriting are the fastest way to get a certification bounced back as insufficient, and the clock keeps running while you fix it.
New York Paid Family Leave Forms
State PFL paperwork is completely separate from your federal FMLA packet. Even when both apply to the same absence, each system needs its own forms.
- Form PFL-1 is the main request form for every PFL claim. You fill out Part A with your employment details and the reason for leave. Your employer completes Part B and must return it to you within three business days.6Paid Family Leave. Handling Requests
- Form PFL-2 for bonding leave with a new child by birth, adoption, or foster placement.
- Form PFL-4 for caring for a family member with a serious health condition. The family member’s healthcare provider completes the medical portion.7New York State Workers’ Compensation Board. Paid Family Leave Forms and Instructions
- Form PFL-5 for military-related qualifying events when a family member is deployed abroad on active duty.8New York State Workers’ Compensation Board. PFL Military-Related Leave Forms
Once you have the completed PFL-1 and the matching certification form, you submit the entire package to your employer’s PFL insurance carrier, not to your employer. The carrier’s contact information should come back to you with Part B of the PFL-1.
When Both Systems Cover the Same Leave
If a single event qualifies under both FMLA and PFL, your employer can require the two leaves to run concurrently. The 12 weeks of FMLA and the 12 weeks of PFL tick down at the same time rather than stacking into 24 weeks. If your employer designates concurrent leave, they must notify you in writing that the absence counts against both entitlements.1Paid Family Leave. Paid Family Leave and Other Benefits
You still file both sets of paperwork. FMLA handles job protection and health benefit continuation at the federal level; PFL handles wage replacement at the state level. One packet doesn’t substitute for the other.
The Deadlines That Decide Your Claim
This is where claims most often go wrong. The windows are specific and short.
Before Leave Starts
For foreseeable leave (scheduled surgery, an expected due date, a planned deployment), federal law requires at least 30 days of advance notice to your employer. If 30 days isn’t possible, you must give notice as soon as practicable.9eCFR. 29 CFR 825.302 – Employee Notice Requirements for Foreseeable FMLA Leave New York PFL uses the same 30-day advance notice rule for foreseeable leave.10Paid Family Leave. Paid Family Leave for Family Care
Returning the FMLA Certification
Your employer should request medical certification within five business days of your leave notice. From that request, you have 15 calendar days to return the completed form.11eCFR. 29 CFR 825.305 – Certification That 15 days includes the time your doctor needs on their portion, so don’t wait a week to schedule the appointment. If your employer determines the certification is incomplete or insufficient, they must tell you in writing what’s missing and give you seven calendar days to cure it.
Filing the PFL Package
You must submit the completed PFL request package to your employer’s insurance carrier within 30 days after the start of your leave. Missing this deadline can cost you benefits entirely.10Paid Family Leave. Paid Family Leave for Family Care
Your Employer’s Response
After receiving your completed FMLA certification, your employer has five business days to issue a written designation notice telling you whether the leave is approved and whether it counts against your FMLA entitlement.12eCFR. 29 CFR 825.300 – Employer Notice Requirements If no written notice comes, follow up. A verbal “you’re fine” won’t help you if there’s a dispute later.
What Happens If Paperwork Is Late or Incomplete
The consequences depend on whether the leave was foreseeable.
For foreseeable leave, if you don’t provide certification within 15 days, your employer can deny FMLA protection until you hand in a sufficient certification. If you blow past the deadline by 30 days without a reasonable explanation, your employer can deny FMLA coverage for that entire gap.13eCFR. 29 CFR 825.313 – Failure to Provide Certification
For unforeseeable leave, the stakes are higher. If you don’t return the certification within 15 days and can’t point to a genuine emergency, your employer can deny FMLA protection for any leave taken after that window expires. If you never produce the certification, the time off is not FMLA-protected leave: no guaranteed reinstatement, no continuation of health benefits.13eCFR. 29 CFR 825.313 – Failure to Provide Certification
Your employer can also require a fitness-for-duty certification before letting you return to work, provided they told you about the requirement in advance and apply it consistently. Without it, they can delay or deny your reinstatement.
Recertification During a Long Leave
Your first certification may not be the last form you fill out. Your employer can request updated medical certification, but generally no more often than every 30 days and only in connection with an actual absence. If the original certification says the condition will last longer than 30 days, your employer must wait until that duration expires before asking for recertification. Regardless of the stated duration, they can always request recertification every six months in connection with an absence.14eCFR. 29 CFR 825.308 – Recertification
Your employer can request recertification sooner than 30 days if you ask to extend your leave, if your absences look significantly different from what the certification described, or if they receive information that raises a legitimate question about whether the certification is still valid.
Keep Your Own File
Copy every form before you submit it. Log the date you gave notice, the date certification was requested, the date you turned it in, and the date you received the designation notice. Save emails, letters, and portal confirmations. If a dispute surfaces months later, your personal file is the only piece of the paper trail you fully control. A time-stamped email confirming submission is worth more than any verbal assurance from HR.
