Form NYC-210 is a one-page claim form that lets New York City residents collect the city school tax credit when they are not filing a New York State income tax return. The credit is fully refundable, so you receive the money as a direct payment even if you owe no state tax. The maximum is $63 for single filers and $125 for married couples filing a combined claim, prorated by month for anyone who lived in the city for only part of the year.1New York Department of Taxation and Finance. New York City Credits
One point to settle before you start: if you are filing Form IT-201 (resident) or IT-201 (nonresident/part-year), do not file NYC-210. You claim the school tax credit directly on the state return, and the state calculates it as part of your refund or balance due.2New York State Department of Taxation and Finance. Instructions for Form NYC-210 Claim for New York City School Tax Credit NYC-210 exists for residents whose income is low enough that no state return is required but who still want the credit.
Who Qualifies
You must meet all three of these conditions:
- You lived in New York City for at least part of the tax year.
- No one else claims you as a dependent on their federal income tax return.
- Your income for the year does not exceed $250,000. The cap is the same for every filing status.1New York Department of Taxation and Finance. New York City Credits
The dependency rule is the one that catches people. If a parent or anyone else claims you as a dependent on their federal return, you cannot take this credit no matter how long you lived in the city or how little you earned.
How to Fill Out the Form
You can download a fillable PDF from the New York State Department of Taxation and Finance at tax.ny.gov, or file electronically through the state’s Free File program at no cost.3New York State. Form NYC-210, Claim for New York City School Tax Credit

- Single: lines 1, 2, and 5.
- Married filing a combined claim: lines 1 through 5.
- Married filing a separate claim: lines 1, 2, and 5.
- Qualifying surviving spouse (conditions in the instructions, including a dependent child): lines 1, 2, and 5.
Months of NYC Residency
Line 2 asks how many months you lived in New York City during the tax year. The counting rule: any period of more than half a month counts as a full month, and any period of half a month or less does not count at all.2New York State Department of Taxation and Finance. Instructions for Form NYC-210 Claim for New York City School Tax Credit If you moved to the city on November 16 and stayed through December 31, November does not count and December does, giving you one month.
On a combined claim, line 4 asks the same question for your spouse. If your spouse died during the year and had lived in NYC from January 1 until the date of death, enter 12.
Refund Method
Line 5 asks whether you want direct deposit or a paper check. If you choose direct deposit, enter your bank routing and account numbers on line 6. Direct deposit is substantially faster.

After You File
E-filed claims with direct deposit are generally processed in two to three weeks. Paper filings commonly take six to eight weeks, longer during peak season. You can check progress with the “Check Your Refund” tool on the Department of Taxation and Finance website.
If you did file a state income tax return and forgot to claim the school tax credit on it, NYC-210 is not the fix. You would file an amended return on Form IT-201-X to correct the original filing.5New York State Department of Taxation and Finance. Enhanced Form IT-201-X, Amended Resident Income Tax Return The general refund window on an amended return is three years from the date the original return was filed or two years from the date the tax was paid, whichever is later. If you never filed a state return and never submitted an NYC-210, you can still file the form within the same three-year window.
Keep your copy of the filed form, any e-file confirmation, and records showing your NYC residency dates such as a lease or utility bills.
