If you lived, worked, or served at Fort Benning (now Fort Moore) and later developed a serious illness, you may be able to join the Fort Benning PFAS lawsuit, which is consolidated with thousands of similar claims in a federal multidistrict litigation in South Carolina. No personal injury trial has been held yet, no settlement has been reached for individuals, and a court-ordered filing deadline of September 5, 2025, has already tightened the rules for new claims.1Lawsuit Tracker. Military Base Water Contamination Lawsuit
The claims trace back to decades of firefighting foam use at the base. Aqueous film-forming foam, or AFFF, was used at Fort Benning starting in the 1970s at fire training areas, fire stations, hangars, and nozzle-testing sites. The per- and polyfluoroalkyl substances in that foam leached into soil and groundwater, and have since been detected in drinking water above the EPA’s new federal limits of 4 parts per trillion for PFOA and PFOS.2U.S. EPA. Who Can File a Fort Benning PFAS Claim
Eligibility is broader than many people assume. The personal injury claims in the AFFF MDL are open to veterans and active-duty military who served at the base, spouses and children who lived in base housing, civilian employees and contractors, and nearby residents who drank from water systems connected to the base’s supply.3TruLaw. Most claims require documentation showing at least six to twelve months of residence or service at the installation. The highest exposure period is generally understood to run from the 1970s through the early 2000s.3TruLaw. Fort Benning PFAS Lawsuit
You also need a qualifying diagnosis. The conditions associated with PFAS exposure in the litigation and in the underlying science include:
- Kidney cancer
- Testicular cancer
- Thyroid cancer and thyroid disease
- Liver cancer
- Ulcerative colitis
- Immune system disorders
A 2024 report by the Disabled American Veterans and the Military Officers Association of America rated the evidence linking PFAS to kidney cancer, decreased antibody response, and dyslipidemia as “sufficient,” with “limited or suggestive” evidence for breast cancer, testicular cancer, thyroid disease, ulcerative colitis, liver enzyme alterations, and pregnancy-induced hypertension.4Disabled American Veterans. Filing Deadlines You Need to Know
Two sets of deadlines matter. Claims against the federal government fall under the Federal Tort Claims Act, which requires filing an administrative claim within two years of discovering the injury. Claims against the chemical and foam manufacturers are governed by state statutes of limitations, typically two to three years from diagnosis.1Lawsuit Tracker. On top of that, the court imposed its own cutoff of September 5, 2025. Cases filed after that date face stricter procedural requirements, and as of mid-2026 at least some intake channels for the MDL have closed to new cases.1Lawsuit Tracker. Where the Litigation Stands
Fort Benning claims sit inside In Re: Aqueous Film-Forming Foams Products Liability Litigation, MDL No. 2873, before Judge Richard M. Gergel in the U.S. District Court for the District of South Carolina.5U.S. District Court for the District of South Carolina. MDL 2873 Information By mid-2026 the MDL held more than 15,200 active lawsuits against 3M, DuPont, Chemours, Corteva, Tyco Fire Products, Chemguard, BASF, other manufacturers, and the U.S. Department of Defense.1Lawsuit Tracker. One important procedural ruling has already shaped these cases. In September 2022, the court rejected the “government contractor defense” that manufacturers like 3M had raised, which means military personnel and government contractors can pursue claims against the companies that sold the foam.6Drugwatch. The Delayed Bellwether Trial
A bellwether trial focused on kidney cancer was scheduled for October 2025 but was pulled from the court’s calendar, and no replacement date had been publicly set as of early 2026. Judge Gergel has pushed the parties to negotiate a global personal injury settlement, but none has been announced.6Drugwatch. What CMO 37 Means for Your Case
In February 2026, the court issued Case Management Order No. 37, setting documentation requirements that every personal injury plaintiff must meet. Claimants have to submit a completed profile form, medical records showing their diagnosis, and verified exposure details through an electronic portal. Miss the requirements and your case can be dismissed after a 14-day cure period: with prejudice if the case was filed before March 2025, without prejudice if it was filed later.7U.S. District Court for the District of South Carolina. What’s Already Been Settled (and What Hasn’t)
The MDL has produced four major settlements, but all of them are with public water systems, not individuals. Judge Gergel has granted final approval to:8PFAS Water Settlement. AFFF PFAS Water Settlement

VA Benefits Are a Separate Question
Winning or filing an MDL claim doesn’t involve the VA, and VA benefits aren’t an alternative source of compensation yet. There is currently no presumptive service connection for any PFAS-related condition. A veteran seeking disability benefits must prove a direct causal link between service, PFAS exposure, and diagnosis — the same case-by-case burden that advocacy groups have called inadequate.12Disabled American Veterans. Ending the Wait The PACT Act of 2022 did not cover PFAS. The Veterans Exposed to Toxic PFAS Act (S. 2294), introduced in 2023 to create automatic disability coverage for veterans who served at contaminated bases, has not been enacted.13AJMC. The VET PFAS Act Promises Disability Benefits to PFAS-Exposed Veterans The VA has said it is reviewing the scientific evidence on PFAS and kidney cancer as part of a process that could eventually lead to presumptive service connection.14U.S. Department of Veterans Affairs. Cleanup at the Base Itself
The Army is handling Fort Moore under the federal Superfund law and is still in the remedial investigation phase, meaning it is assessing the scope of contamination before designing a cleanup plan.15U.S. Army Environmental Command. Fort Moore PFAS Information The next scheduled water testing event is set for December 2027.3TruLaw. Fort Benning PFAS Lawsuit Under a September 2024 Defense Department policy, the Army must take interim steps such as providing bottled water, filtration, or municipal hookups for any private wells near the base where PFOS or PFOA reaches 12 parts per trillion. The surrounding Columbus Water Works system also recorded PFOA and PFOS above the 4-ppt federal limit in 2024 and 2025 sampling, and utilities have until 2029 to come into compliance.16Columbus Water Works.
