Who Is Covered

Three situations sit outside the local rule:
- Work performed outside city limits. The state rate applies instead.
- Fewer than four hours per week worked in Fort Collins for a particular employer. The local rate doesn’t kick in that week.

How the Rate Changes After 2026

Penalties for Paying Below the Minimum
An underpaid worker has three years from the date of the violation to file a civil lawsuit in Colorado district or county court. Available relief includes:
- Back pay for all unlawfully withheld wages, including amounts that accrue after the lawsuit is filed.
- Interest of 12% per year on unpaid wages, running from the date each payment was originally due.
- A penalty of $100 per worker per day the violation occurred or continued.
- Reinstatement if the worker was fired in connection with the violation.

An employer who knowingly underpays can also be charged with a civil infraction under city code, on top of any civil suit. The $100 daily penalty compounds quickly across multiple workers, and the attorney fee provision makes these cases workable even when the individual dollar amounts are modest.
How to File a Wage Complaint
