Georgia ALS Hearing: Deadline, Issues Decided, and Outcomes

A Georgia ALS hearing is the administrative proceeding where you challenge the license suspension that follows a DUI arrest, and you have 30 calendar days from the date of arrest or notice to request one in writing or lose the right forever.1Justia. Georgia Code 40-5-67.1 – Chemical Tests; Implied Consent The hearing runs through the Department of Driver Services and the Office of State Administrative Hearings, entirely separate from the criminal DUI case. It decides only whether the state can suspend your driving privileges, not whether you are guilty of DUI.

The 30-Day Deadline

When you are arrested for DUI in Georgia, the officer takes your license and issues a yellow form called the DDS 1205.2Georgia Department of Driver Services. DDS Update and Forms That form is your temporary driving permit for 45 days and it starts the clock on your 30-day window to request a hearing. The days run from the date of personal notice or certified-mail notification, whichever applies.1Justia. Georgia Code 40-5-67.1 – Chemical Tests; Implied Consent

If you do nothing, the statute says your right to a hearing “shall be deemed waived.”1Justia. Georgia Code 40-5-67.1 – Chemical Tests; Implied Consent No extension. No good-cause exception. The suspension takes effect when your 45-day temporary permit expires.

How to Request the Hearing

The request must be in writing to the Department of Driver Services and must include a $150 filing fee, which is non-refundable regardless of outcome.1Justia. Georgia Code 40-5-67.1 – Chemical Tests; Implied Consent Sometimes called a “30-day letter,” it should contain information copied directly from your DDS 1205:

  • The arresting officer’s name, badge number, and agency
  • The exact date and county of the arrest
  • Your full legal name, Georgia driver’s license number, and date of birth

DDS accepts requests three ways.3Georgia Department of Driver Services. Administrative License Suspension (ALS) Hearing Requests Certified mail with return receipt requested is the safest, because the receipt is your proof of timely filing. The DDS website offers an online portal for submission and electronic fee payment; save the confirmation page and transaction receipt. You can also file in person at a DDS customer service center, subject to availability.

Once DDS receives a valid request, the file transfers to the Office of State Administrative Hearings for scheduling.4Office of State Administrative Hearings. The Four Issues the Judge Decides

Georgia law strictly limits what the administrative law judge can consider. The hearing is not a mini-trial on whether you were actually intoxicated. The judge looks only at these four questions:1Justia. Georgia Code 40-5-67.1 – Chemical Tests; Implied Consent

  • Whether the officer had reasonable grounds to believe you were driving under the influence and lawfully arrested you, or whether you were involved in a traffic accident causing serious injuries or a fatality
  • Whether the officer properly gave you the implied consent notice
  • Whether you refused the chemical test, or whether the results showed a BAC of 0.08 or higher for adults, 0.02 for drivers under 21, or 0.04 for commercial vehicle operators
  • Whether the test was administered by a qualified person using approved equipment maintained by the Division of Forensic Sciences

If the state fails to prove even one of these, the judge should rescind the suspension. Common wins come from an officer reading the implied consent notice incorrectly or failing to appear at all. Arguments about pretextual stops or how sober you seemed on scene fall outside the judge’s authority.

What the Hearing Looks Like

ALS hearings do not resemble criminal trials. There is no jury and no prosecutor. An administrative law judge from the Office of State Administrative Hearings presides, usually in a government office or dedicated hearing room, and the proceeding is recorded.

The arresting officer is the state’s primary witness and testifies about the stop, the arrest, and the chemical test or refusal. You or your attorney can cross-examine that officer under oath. This is where the ALS hearing earns its reputation as a strategic tool: every answer is locked into a sworn record that can be used later in the criminal case. You can also introduce documents such as the police report, dashcam or bodycam footage, and medical records, as long as they touch on the four issues above.

Possible Outcomes

If the judge finds the state fell short on any required element, the suspension is rescinded and your driving privileges are restored. If the suspension is upheld, the consequences depend on what happened with the chemical test.

Refusing the test triggers a one-year suspension, and no limited driving permit is available during that year.1Justia. Georgia Code 40-5-67.1 – Chemical Tests; Implied Consent Failing the test (0.08 or above) results in a suspension under O.C.G.A. ยง 40-5-67.2 and may allow you to apply for a limited driving permit depending on your record. A limited permit costs $32 and can be issued where losing driving privileges would cause extreme hardship, such as getting to work, school, medical appointments, or court-ordered programs.5Justia. Georgia Code 40-5-64 – Limited Driving Permits for Certain Offenses

Whichever way the hearing goes, the decision only touches your administrative driving privilege. It carries no jail time, no criminal fine, and no criminal conviction.4Office of State Administrative Hearings. What to Do After an Administrative License Suspension

The Ignition Interlock Alternative

Georgia offers another route. Instead of requesting the ALS hearing, eligible drivers can apply for an ignition interlock device limited driving permit. Choosing this option waives your right to the ALS hearing entirely, so it is an either-or decision.1Justia. Georgia Code 40-5-67.1 – Chemical Tests; Implied Consent

To qualify, you must meet all of the following:6Justia. Georgia Code 40-5-64.1 – Ignition Interlock Device Limited Driving Permit

  • No prior DUI conviction within the past five years, measured from arrest dates
  • Age 21 or older
  • Not a CDL holder
  • No serious-injury or fatal accident involved in the arrest
  • Currently licensed to drive in Georgia

The permit costs $25 and lasts one year, during which you drive with an interlock device installed at your own expense. Monthly device costs typically run $55 to $150 for leasing, calibration, and maintenance. Completing 12 months of monitored driving removes the interlock restriction.6Justia. Georgia Code 40-5-64.1 – Ignition Interlock Device Limited Driving Permit The permit can be renewed in two-month increments for $5 each if you need more time.

For a first-offense driver who knows the chemical results will not help, the interlock permit trades hearing uncertainty for guaranteed driving privileges. Where there are real grounds to challenge the suspension, though, waiving the hearing gives up your best opportunity to cross-examine the officer under oath.

How the Hearing Affects the Criminal Case

The administrative suspension and the criminal DUI charge run on parallel tracks. Winning the ALS hearing does not get the criminal charge dismissed, and losing it is not proof of guilt in criminal court. The Office of State Administrative Hearings puts it plainly: the judge’s decision “only pertains to the pending administrative suspension” and “has no impact on the pending criminal charge(s).”4Office of State Administrative Hearings. What to Do After an Administrative License Suspension

The strategic value is elsewhere. The ALS hearing is one of the few chances to put the arresting officer on the record under oath before the criminal trial. Defense attorneys treat it as a discovery tool. If the officer’s ALS testimony differs from what they say at trial later, the inconsistency becomes cross-examination material. That is why many experienced DUI attorneys recommend requesting a hearing even when the administrative case looks like a long shot.

Appealing an Adverse Decision

If the judge upholds the suspension, you can seek judicial review by filing a petition in superior court within 30 days of the final decision.7Justia. Georgia Code 50-13-19 – Judicial Review of Contested Cases You can file in the Superior Court of Fulton County or in the superior court of the county where you live. The petition must state your interest in the case, how the decision harms you, and the specific legal grounds for reversal, with copies served on the agency and all parties of record.

This is not a new hearing. The court reviews the administrative record to decide whether the judge applied the law correctly and whether substantial evidence supports the decision. It is a legal argument on a closed record, not a factual do-over.

If You Hold an Out-of-State License

The ALS process still applies to your privilege to drive in Georgia if you were arrested here on an out-of-state license. Through the Driver License Compact, Georgia reports the suspension and the underlying DUI violation to your home state, which typically treats the offense as if it happened locally and applies its own penalties, including possible suspension of your home-state license.8The Council of State Governments. Driver License Compact Ignoring a Georgia ALS suspension because you live elsewhere generally makes the problem worse rather than smaller.
