Georgia Auto Sales Tax (TAVT): Calculation, Deadlines, and Exemptions

Georgia doesn’t charge a traditional auto sales tax. Instead, the state collects a one-time Title Ad Valorem Tax (TAVT) of 7% of a vehicle’s fair market value when the title is issued or transferred, and that single payment replaces both retail sales tax and the old annual vehicle property tax for as long as you own the car.1Department of Revenue. The TAVT applies to all titled motor vehicles: cars, trucks, motorcycles, and motor homes. It’s triggered every time ownership changes hands or when a new Georgia resident registers a vehicle in the state for the first time.1Department of Revenue. How the TAVT Is Calculated

The rate is fixed at 7.0%, but the base it’s applied to isn’t always your purchase price. The Georgia Department of Revenue uses the vehicle’s fair market value (FMV), and how FMV is set depends on whether the vehicle is new or used.

New Vehicles

For a new vehicle from a dealer, FMV is the greater of the retail selling price or the value in the state motor vehicle assessment manual. That figure is then reduced by any trade-in value and by any rebate or cash discount the dealer provides at the time of sale.2Department of Revenue. Title Ad Valorem Tax (TAVT) – FAQ

Say you negotiate a new truck at $35,000, but the state manual lists it at $37,000. The DOR starts at $37,000. Trade in a car worth $8,000 and take a $2,000 manufacturer rebate, and the taxable base falls to $27,000. Your TAVT: $1,890.

Used Vehicles

Used vehicles are treated differently. FMV comes from the state assessment manual, which averages current wholesale and retail values. Your actual purchase price does not factor in, even if you negotiated a price well below the manual value.2Department of Revenue. Trade-in credit still applies when the used car is purchased from a dealer. In a private sale between individuals, though, there’s no trade-in reduction. The TAVT is calculated on the full assessed FMV with no deductions.2Department of Revenue. Title Ad Valorem Tax (TAVT) – FAQ

Who Collects the Tax: Dealer vs. Private Sale

The mechanics of paying depend on who sold you the car.

Buy from a Georgia dealer, and the dealer collects the full TAVT at the point of sale and submits it along with your title application to the county tag agent where you’ll register the vehicle.3Georgia Department of Revenue. In a private sale, the responsibility is entirely yours. You take the completed title application, the bill of sale, proof of Georgia liability insurance, and a valid government-issued ID to the county tag office where the vehicle will be registered, and you pay the TAVT in full before the title and registration are issued.1Department of Revenue. The 30-Day Deadline and Late Penalties

You have 30 days from the purchase date to title the vehicle. Miss that window and the penalties add up fast.

The title application itself carries a flat $10 late fee. The TAVT penalty is where it hurts, and the structure depends on how you bought the car:4Department of Revenue. Motor Vehicles Fees, Fines, and Penalties

  • Dealer sale: 5% of the TAVT due after day 30, plus another 5% for every month it remains unpaid.
  • Private (casual) sale: 10% of the TAVT due after day 30, plus 1% for every month thereafter.

On a $2,000 TAVT bill from a private sale, being two months late tacks on roughly $240 in penalties.

Reduced Rates: New Residents and Family Transfers

Two common situations pay less than 7%.

If you’ve moved to Georgia and bring a vehicle already titled in another state, the rate drops to 3.0% of FMV.1Department of Revenue. Transferring a vehicle to an immediate family member qualifies for a 0.5% rate, provided TAVT was previously paid on the vehicle under a Georgia title. Qualifying relatives are a spouse, parent, child, sibling, grandparent, or grandchild, and you file Form MV-16 (Affidavit to Certify Immediate Family Relationship) with the title application.1Department of Revenue. Vehicle Taxes–Title Ad Valorem Tax (TAVT) and Annual Ad Valorem Tax If the vehicle is still on the old annual property tax system because it was titled before March 2013 and never changed hands, the receiving family member can either stay in that system or pay the full TAVT. The 0.5% rate isn’t available in that case.

Gifts to non-family members receive no reduction. Full 7% applies on assessed FMV whether money changes hands or not.

Leased Vehicles

Leases are subject to TAVT, but the calculation is narrower. For leases originated on or after January 1, 2022, the FMV base is the total of the depreciation amount, any amortized amounts under the lease, and any down payments.5Department of Revenue. Policy Bulletin MVD-2021-04 – Revised TAVT Calculation for Leases That’s typically well below the vehicle’s full retail value, so lease TAVT usually runs lower than TAVT on an outright purchase of the same car. Business-use leases with adjustable rental prices may instead use the “agreed upon value.”

Military Members Stationed in Georgia

Active-duty service members stationed in Georgia who keep legal residency in another state don’t pay TAVT when titling a vehicle here. Under the federal Servicemembers Civil Relief Act, their personal property isn’t considered located in Georgia for tax purposes.6Office of the Law Revision Counsel. 50 USC Chapter 50 – Servicemembers Civil Relief They pay Georgia’s standard sales and use tax on the purchase instead.

The DOR does allow non-resident service members to voluntarily opt into the TAVT system to avoid the sales tax if that works out cheaper.7Department of Revenue. Non-Resident Servicemembers of the Armed Forces and TAVT Run both numbers before choosing. The policy also covers qualifying dependents.

Other Fees at the Tag Office

  • Title application fee: $18
  • License plate registration fee: $20 for a standard passenger car or light pickup; other vehicle types vary

On a $25,000 vehicle, total out-of-pocket runs about $1,788: $1,750 in TAVT plus $38 in title and registration. Specialty or prestige plates add another $25 to $43.

Disputing the Assessed Value

If you think the DOR’s FMV is too high because of high mileage, accident history, or mechanical problems the manual doesn’t account for, you can file a protest within 45 days of the assessment notice, either through the Georgia Tax Center or by mailing Form TSD-1 with supporting documentation.8Department of Revenue. This route mostly pays off for unusual vehicles: salvage rebuilds, classics with condition issues, or models that depreciated harder than the manual reflects. For a mainstream used car in average shape, the manual value tends to be close enough that a protest isn’t worth the effort.

Can You Deduct TAVT on Your Federal Return?

No. The IRS allows a personal property tax deduction only when the tax is imposed yearly.9Internal Revenue Service. Georgia residents who itemize can still deduct other state and local taxes up to the federal SALT cap; TAVT just isn’t one of them.
