A Georgia consent judgment is a settlement the parties negotiate and the court then adopts as its own order, giving the agreed terms the same force as a verdict reached after trial. What You Are Actually Agreeing To
The statute is short but does real work. Consent extinguishes the defenses in the file and lets the judge sign off without a trial.1Justia. So this is not a private handshake documented at the courthouse. It is a judgment. If the terms turn out to be worse than you expected, walking away is not an option, and the court’s enforcement machinery is available to the other side on day one.
How a Consent Judgment Gets Entered
The process starts with negotiation between the parties or their attorneys. The terms cover whatever the dispute requires: payment amount and schedule, transfers of property, obligations to do or stop doing certain things. Precision at this stage matters, because ambiguous language will be enforced as written once the court signs.
The parties then draft a written agreement setting out each side’s rights and duties and submit it to the court. The judge reviews it for compliance with Georgia law and public policy, sometimes asking for information or revisions before approving. Once approved, the judgment is entered on the court record and becomes enforceable through the same tools available for any Georgia judgment.
How the Other Side Can Enforce It
If a party does not comply, Georgia offers several enforcement mechanisms.

Garnishment, governed by Title 18, Chapter 4 of the Georgia Code, lets the creditor reach wages or bank funds through a court-supervised process. The creditor files an affidavit and summons of garnishment, and the employer or bank must respond with information about the debtor’s assets.
The judgment itself creates a lien. Every Georgia judgment binds the defendant’s property from the date of entry,2Justia. The debtor cannot cleanly sell or refinance that property without addressing the judgment.
Interest Keeps Running
A consent judgment accrues interest from the day it is entered. The statutory rate is the Federal Reserve’s prime rate on the date of judgment plus three percent. A debtor who stalls is not just delaying the principal. The balance grows every day the judgment sits unpaid.
Dormancy and the Renewal Window
Georgia judgments do not last forever, and this is where creditors most often lose money they were legally entitled to collect.
A judgment becomes dormant and unenforceable if seven years pass without the creditor taking one of the qualifying steps: issuing an execution and recording it on the general execution docket, having an authorized officer make an entry on the execution, or filing written notice of a bona fide enforcement effort.5Justia. Can You Undo a Consent Judgment?
Usually, no. Georgia treats consent judgments as very difficult to reopen. Under O.C.G.A. § 9-11-60, a party can move to set aside a judgment on three narrow grounds: the court lacked jurisdiction over the person or subject matter; fraud or mistake by the opposing party that was not caused by the movant’s own negligence; or a fundamental defect visible on the face of the record.7Justia. The statute also directs that judgments should not be set aside or modified without just cause. Before granting relief, the court weighs whether rights have vested under the judgment and whether innocent parties would be harmed by unwinding it.7Justia. Motions of this kind must go to the same court that entered the original judgment.
Consent judgments in child custody or support matters run on a different track. Those can be modified when a parent shows a material and substantial change in circumstances affecting the child’s best interests. Outside family law, the § 9-11-60 grounds are the ceiling.
Appeal rights largely disappear too. Because consent removes the defenses in the case,1Justia. The narrow escape routes track the set-aside grounds: jurisdictional defects or fraud, addressed through a motion in the trial court rather than a direct appeal.
Bankruptcy Does Not Always Erase It
Most consent judgments built on ordinary debts are dischargeable in bankruptcy like any other debt. Federal law carves out important exceptions.
Under 11 U.S.C. § 523(a)(2)(A), debts arising from fraud are non-dischargeable. The U.S. Supreme Court held in Archer v. Warner (2003) that wrapping a fraud claim inside a settlement does not sanitize it; if the underlying obligation involved fraud, the settlement obligation carries that character into bankruptcy. If you are the creditor and the underlying claim was for fraud, the debtor cannot discharge the obligation by filing bankruptcy. If you are the debtor, do not assume converting the claim into a consent judgment gives you a clean exit through Chapter 7.
Tax Treatment of What You Receive
Whether money paid under a consent judgment is taxable depends on the underlying claim. Federal law excludes from gross income any damages, other than punitive damages, received on account of personal physical injuries or physical sickness,9Office of the Law Revision Counsel. 26 USC 104 – Compensation for Injuries or Sickness whether paid as a lump sum or over time and whether obtained by verdict or settlement.
Several categories stay taxable even inside a physical-injury case:

- Interest accruing on the judgment or settlement is taxable income.
- Medical expenses you previously deducted, then later recover through the settlement, become taxable up to the amount previously deducted.
How the consent judgment allocates the total across these categories has real dollar consequences. Specifying which portion covers physical injury damages, which covers lost income, and so on protects the recipient. Vague lump-sum language invites IRS scrutiny.
Do Not Expect Confidentiality by Default
Georgia court records carry a strong presumption of public access. Sealing a consent judgment requires satisfying Uniform Superior Court Rule 21: the movant must show that a privacy interest clearly outweighs the public’s right of access, the court must hold a public hearing, and any sealing order must identify the restricted files, the duration, and the reasoning.
Parties who need privacy often structure their resolution as a private settlement agreement rather than a consent judgment, since the judgment itself becomes part of the public record. The underlying settlement terms can sometimes be kept confidential through a separate agreement, but the judgment is generally accessible unless the court seals it under Rule 21.
Weighing Whether to Sign
The pull toward a consent judgment is straightforward. You control the terms instead of gambling on a judge or jury. Trials are expensive, slow, and unpredictable, and settlement lets you skip discovery fights, witness preparation, and courtroom risk. The agreement can address specific arrangements a court-imposed judgment might never craft on its own.
The costs deserve equal weight. A consent judgment is very hard to undo. Bargaining leverage that was uneven going in gets locked into the terms, and the court’s approval is not a substitute for careful negotiation. Sloppy drafting produces enforcement disputes that can eat more time and money than the original case would have. Appeal rights largely disappear, so if the obligations turn out heavier than expected, there is no safety valve. And if the claim underneath sounds in fraud, bankruptcy will not clear it.
Settlement is often the right call. Just treat the drafting session as the case: the words on the page are what you will live with, enforcement, interest, dormancy deadlines, and all.
