Georgia Garnishment Exemptions: Wages, Benefits, and Property

Under Georgia garnishment exemptions, a creditor collecting on an ordinary consumer debt can take no more than 25% of your weekly disposable earnings, or the amount by which those earnings exceed $217.50, whichever is smaller.1Office of the Law Revision Counsel. 15 USC 1673 – Restriction on Garnishment Social Security, most retirement accounts, up to $21,500 in home equity, $5,000 in vehicle equity, and a $1,200 wildcard are also shielded under state and federal law.2Justia. You have to claim them on time or a court can release your money to the creditor regardless of whether an exemption applied.

How Much of Your Paycheck Is Protected

Georgia follows the federal Consumer Credit Protection Act. For each pay period, a creditor on a regular consumer debt can take the lesser of two amounts: 25% of your disposable earnings, or everything above 30 times the federal minimum wage for that week.1Office of the Law Revision Counsel. 15 USC 1673 – Restriction on Garnishment At the current $7.25 federal minimum wage, that floor is $217.50 per week. If your disposable pay drops below $217.50 in a week, none of it can be garnished.

Disposable earnings are gross pay minus legally required deductions like federal and state taxes, Social Security, and Medicare. Voluntary deductions such as health insurance premiums or 401(k) contributions do not come out first. Say your weekly disposable pay is $300. Twenty-five percent is $75. The overage above $217.50 is $82.50. The creditor gets the smaller of the two, so $75.

Georgia’s garnishment statutes reference these limits through O.C.G.A. 18-4-5 and 18-4-6.3Justia. Georgia Code 18-4-6 – Exemption from Garnishment The cap is a total ceiling, not a per-creditor allowance. If two creditors are collecting at once, they split what a single creditor could have taken.

Social Security and Federal Benefits

Social Security payments cannot be seized, levied, attached, or garnished through legal process, under 42 U.S.C. ยง 407.4Office of the Law Revision Counsel. 42 USC 407 – Assignment of Benefits A credit card issuer, hospital, or debt collector with a court judgment cannot reach these funds. Three narrow exceptions exist: delinquent federal taxes, child support, and alimony.5Social Security Administration. The trouble starts once benefits hit a bank account. When a garnishment order arrives, the bank must review the past two months of deposits and automatically protect any federal benefits that came in by direct deposit during that window.6Consumer Financial Protection Bureau. Can a Debt Collector Take My Federal Benefits, Like Social Security or VA Payments? Older deposits and funds that have been mixed with non-exempt money are harder to defend. A separate account used only for benefit deposits makes tracing straightforward and keeps the protection intact.

Retirement Accounts

Most employer-sponsored retirement plans are protected by the Employee Retirement Income Security Act. ERISA’s anti-alienation rules make it extremely difficult for creditors to reach money held inside a qualifying plan, including 401(k) accounts and most pensions.7U.S. Department of Labor. Georgia adds another layer under O.C.G.A. 44-13-100. Payments from pensions, annuities, and similar plans received on account of illness, disability, death, age, or length of service are exempt to the extent reasonably necessary for the support of the debtor and any dependents.2Justia. The phrase “reasonably necessary for support” is where disputes happen; a court can look at your income, expenses, and overall finances to decide how much of a distribution actually qualifies.

Once retirement money leaves the plan and lands in a regular checking account, it loses protected status and becomes exposed like any other balance. If you are receiving periodic retirement payments while a garnishment is active, do not mix those funds with other deposits.

Home, Vehicle, and Personal Property

Georgia’s exemption statute sets dollar caps on the property a creditor cannot take. Equity that exceeds a cap is exposed, so the specific numbers matter.

Homestead

You can protect up to $21,500 in equity in your primary residence, a housing cooperative, or a burial plot.2Justia. If both spouses are co-debtors and both hold title, each claims their own $21,500 and reaches the same total.

Motor Vehicle

You can shield up to $5,000 in equity in a vehicle.2Justia. Georgia Code 44-13-100 – Exemptions for Purposes of Bankruptcy and Intestate Insolvent Estates Equity is fair market value minus the loan balance. A $12,000 car with an $8,000 loan has $4,000 in equity and falls within the cap.

Wildcard

Every debtor gets a $1,200 wildcard that applies to any property.2Justia. Georgia Code 44-13-100 – Exemptions for Purposes of Bankruptcy and Intestate Insolvent Estates On top of that, up to $10,000 of unused homestead exemption can be rolled into the wildcard. A renter with no home equity to protect can stack the full $10,000 onto the $1,200 base, giving $11,200 to cover cash, a tax refund, or personal items that exceed their category limit. This is one of the most underused tools in Georgia’s system.

Debts That Override These Limits

The 25% cap and several other protections apply to ordinary consumer debts. A handful of debt categories let creditors take more, and Georgia’s exemption statutes do not stop them.

  • Child support and alimony: federal law allows garnishment of up to 50% of disposable earnings if you are supporting another spouse or child, or 60% if not, with an extra five percentage points if you are more than 12 weeks behind.   • Federal tax debt: the IRS can levy wages without a court judgment. The amount you keep depends on filing status, pay frequency, and dependents. For 2026, a single taxpayer with no dependents paid weekly keeps $309.62, plus $101.92 per dependent; the rest goes to the IRS.9Internal Revenue Service.   • Defaulted federal student loans: the Department of Education can garnish up to 15% of disposable income administratively, without a court order, and must leave you with at least $217.50 per week.

How to Claim an Exemption

Georgia exemptions are not self-executing. You have to file a claim of exemption with the clerk of the court where the garnishment is pending, and you have to do it before the deadline runs.

Under O.C.G.A. 18-4-15, you may file at any time before a judgment is entered, a disbursement order is issued, or the garnished money is distributed, whichever comes first.10Justia. Georgia Code 18-4-15 – Parties to Garnishment Under O.C.G.A. 18-4-20, if no claim or traverse is filed within 20 days after the garnishee (your employer or bank) files its answer, the clerk can release the funds to the creditor.11Justia. Georgia Code 18-4-20 – Failure to File Claim or Traverse in Timely Manner The 20 days run from the answer date, not from when you receive notice, so delays in opening mail or figuring out the paperwork can cost you.

Your claim must state the specific basis for the exemption. Point to the exact category: wages below the federal floor, Social Security deposits, retirement funds, homestead equity, and so on. Once you file, the court must set a hearing within 10 days, and no funds can be disbursed until the hearing happens.10Justia. Georgia Code 18-4-15 – Parties to Garnishment

You carry the burden of proof at that hearing. Bring pay stubs, bank statements showing direct-deposited benefits, retirement account statements, or benefit award letters. General assertions about hardship lose. Georgia’s garnishment statutes do not include a general hardship exemption; the money either fits a defined category or it does not.

How Long a Georgia Garnishment Lasts

Duration depends on the type of garnishment, under O.C.G.A. 18-4-4.8Justia. Georgia Code 18-4-4 – Process of Garnishment; Period of Garnishment A continuing wage garnishment on a consumer debt runs 1,095 days, roughly three years, from the date the summons is served on your employer. A garnishment on a financial institution covers only the five days after service, freezing whatever is in the account during that window. A continuing garnishment for support has no fixed expiration and runs until the arrearage is paid. All other garnishments last 29 days.

A creditor whose 1,095 days expire without full satisfaction can file a fresh summons and start again. Each new summons is a new proceeding, which means a new claim of exemption if you want the protection.

Mistakes That Forfeit Protection

The most expensive error is doing nothing. If the 20-day window passes without a filed claim, the court can release your money regardless of whether an exemption would have applied. This is the single most common way debtors lose funds they had every legal right to keep.

Commingling exempt funds runs a close second. Social Security payments and retirement distributions lose their protected character once they blend with paychecks, gifts, and other deposits in a general account. If a court cannot trace which dollars came from an exempt source, it has little reason to protect them. A dedicated account for exempt income solves the tracing problem.

Filing without evidence is nearly as bad as not filing. Judges rule on documentation, not on hardship. Show that the specific funds fall into a recognized category: below the wage floor, traceable to Social Security, held in a protected retirement plan, or covered by the homestead, vehicle, or wildcard limits. That is what a Georgia exemption claim actually requires.
