Georgia gun carry laws let most adults carry a handgun in public, openly or concealed, without a state permit. The Georgia Constitutional Carry Act took effect on April 12, 2022, and eliminated the license requirement for anyone who qualifies as a “lawful weapons carrier.” You still have to meet an age and eligibility test, avoid specific prohibited locations, and follow separate rules for vehicles, private property, and use of force.
Who Can Carry Without a Permit
You qualify as a lawful weapons carrier if you are eligible for a Georgia weapons carry license, even though you no longer need the physical license to carry.1Justia. Georgia Code 16-11-125.1 – Definitions Out-of-state residents who would qualify except for residency, and anyone licensed to carry in another state, are covered too.
The baseline age is 21. If you are at least 18 and have completed U.S. armed forces basic training, you also qualify, as long as you remain on active duty or were honorably discharged.2Justia. Georgia Code 16-11-129 – Weapons Carry License
Several categories of people are disqualified:
- Anyone with a felony conviction or pending felony charge in any state or federal jurisdiction, unless pardoned.
- Anyone hospitalized as an inpatient in a mental hospital or alcohol or drug treatment center within the past five years, adjudicated mentally incompetent to stand trial, or found not guilty by reason of insanity.
- Anyone whose weapons carry license was revoked within the past three years.
- Fugitives from justice and people convicted of manufacturing or distributing controlled substances.
- Anyone prohibited from possessing firearms under federal law, including people with qualifying domestic violence misdemeanor convictions and those subject to certain protective orders.3Bureau of Alcohol, Tobacco, Firearms, and Explosives. Misdemeanor Crimes of Domestic Violence Prohibitions
All of these disqualifiers come from the same eligibility statute that governs the weapons carry license.2Justia. Georgia Code 16-11-129 – Weapons Carry License Non-immigrant visa holders face additional federal restrictions and are generally prohibited from possessing firearms, with narrow exceptions such as holding a valid hunting license.
Where You Can Carry
Lawful weapons carriers can carry throughout typical public spaces in Georgia. The statute specifically authorizes carrying in state parks, historic sites, recreational areas, publicly owned buildings within those areas, wildlife management areas, and on public transportation.4Justia. Georgia Code 16-11-126 – Having or Carrying Handguns, Long Guns, or Other Weapons You cannot carry anywhere federal law prohibits, even if Georgia would otherwise allow it.
Anyone with a valid carry license from another state is authorized to carry in Georgia, subject to Georgia’s rules about prohibited locations. Bring your license with you if you’re visiting.
Where You Cannot Carry
Georgia law lists specific locations where carrying is a misdemeanor even for lawful weapons carriers.5Justia. Georgia Code 16-11-127 – Carrying Weapons or Long Guns in Unauthorized Locations
Government Buildings
Whether you can carry depends on security screening. If a government building is open for business and no one screens people at the entrance, lawful weapons carriers can enter armed. If a certified peace officer screens visitors at the entrance, carrying past that checkpoint is a misdemeanor. If you approach security and get flagged for a weapon, you can leave immediately and avoid criminal liability.
Courthouses, Jails, and Places of Worship
Courthouses and jails or prisons are always off-limits. Places of worship are restricted by default, but the governing body of a religious organization can grant permission for lawful weapons carriers to carry on its premises.
Schools
Carrying a weapon in a school safety zone, at a school function, or on a school bus is illegal. For a lawful weapons carrier the offense is a misdemeanor. For anyone who does not qualify as a lawful weapons carrier, the same offense is a felony carrying a fine up to $10,000 and two to ten years in prison. If the weapon is a machine gun or other dangerous weapon, the minimum sentence rises to five years.6Justia. Georgia Code 16-11-127.1 – Carrying Weapons Within School Safety Zones, at School Functions, or on a Bus or Other Transportation Furnished by a School
Federal Buildings
Federal facilities follow federal law. Possessing a firearm in a federal building where employees regularly work is a federal crime with up to one year in prison. Federal courthouses carry up to two years. Bringing a firearm intending to use it in a crime raises the maximum to five years.7Office of the Law Revision Counsel. 18 USC 930 – Possession of Firearms and Dangerous Weapons in Federal Facilities Post offices, federal courthouses, and Social Security offices are all covered.
College and University Campuses
Lawful weapons carriers can carry concealed handguns on public college and university campuses in Georgia, but the exceptions cover most of the places students actually spend their time. You cannot carry in:
- Student housing, including dormitories, fraternity houses, and sorority houses.
- Buildings or property used for athletic events.
- Faculty and administrative offices, and rooms used for disciplinary proceedings.
- On-campus preschools or childcare facilities.
- Rooms where high school students attend dual-enrollment classes.
Only concealed handguns qualify in the areas where carry is allowed. “Concealed” means substantially covered by clothing, carried in a nondescript bag, or otherwise not clearly visible to a casual observer.6Justia. Georgia Code 16-11-127.1 – Carrying Weapons Within School Safety Zones, at School Functions, or on a Bus or Other Transportation Furnished by a School
Private Property and Businesses
Private property owners have the final say. A homeowner, business owner, or anyone in legal control of property can exclude or eject someone carrying a weapon, and refusing to leave is criminal trespass.4Justia. Georgia Code 16-11-126 – Having or Carrying Handguns, Long Guns, or Other Weapons8Justia. Georgia Code 16-7-21 – Criminal Trespass
Restaurants and bars that serve alcohol are not automatically off-limits to lawful weapons carriers under state law. Carrying while under the influence of alcohol or drugs is a separate offense.
Carrying in a Vehicle
Anyone not legally prohibited from possessing a firearm can keep a weapon on their person inside their own home, motor vehicle, or place of business, no license needed.4Justia. Georgia Code 16-11-126 – Having or Carrying Handguns, Long Guns, or Other Weapons The firearm can be open or concealed inside the vehicle. Lawful weapons carriers can also transport a handgun or long gun in any private passenger vehicle, not just their own.
Georgia law prohibits employers from searching the locked, privately owned vehicles of employees or invited guests on company parking lots. An employer cannot require, as a condition of employment, that you agree not to keep a firearm locked out of sight in your trunk, glove box, or another enclosed compartment, as long as you are a lawful weapons carrier.9Justia. Georgia Code 16-11-135 – Public or Private Employers Parking Lot Restrictions These protections do not apply at correctional facilities, certain electric generation plants, Department of Defense contractor sites near military installations, or employers who provide a secure, gated lot with a uniform vehicle search policy.
Self-Defense and Stand Your Ground
Carrying a firearm and using one are different legal questions. Georgia law allows you to threaten or use force when you reasonably believe it is necessary to defend yourself or someone else against an imminent unlawful attack. Deadly force is justified only when you reasonably believe it is necessary to prevent death, serious bodily injury, or a forcible felony.10Justia. Georgia Code 16-3-21 – Use of Force in Defense of Self or Others
Georgia is a stand-your-ground state. If you are using force lawfully in self-defense or defense of your home or property, you have no duty to retreat before acting.11Justia. Georgia Code 16-3-23.1 – No Duty to Retreat Prior to Use of Force
The justification fails if you provoked the confrontation intending to use it as an excuse to hurt the other person, if you were committing or fleeing from a felony at the time, or if you were the initial aggressor and did not clearly withdraw from the fight.10Justia. Georgia Code 16-3-21 – Use of Force in Defense of Self or Others
Traffic Stops and Police Encounters
Georgia has no “duty to inform” law. You are not required to volunteer that you are carrying a firearm during a traffic stop. If your firearm is stored near your registration or insurance documents, telling the officer before you reach for anything avoids a dangerous surprise.
Police cannot search your vehicle on a hunch. A warrantless search generally requires your consent, probable cause to believe the car contains evidence of a crime, or a search incident to arrest. You can decline a search, and refusing cannot be treated as evidence of guilt.
Why Get a Weapons Carry License Anyway
Even though the license is not required to carry inside Georgia, it still offers benefits:
- Reciprocity when traveling. Many states honor Georgia weapons carry licenses but do not recognize Georgia’s permitless carry status.
- Faster firearm purchases. A valid Georgia weapons carry license may serve as a Brady Act alternative, letting you skip the NICS check when buying from a licensed dealer.12Bureau of Alcohol, Tobacco, Firearms and Explosives. Brady Permit Chart
- Instant proof of eligibility during a law enforcement encounter.
How to Apply and Renew
Applications go through the Probate Court in your county of residence. Bring proof of Georgia residency and a government-issued photo ID.13Georgia.gov. Apply for a Firearms License First-time applicants are fingerprinted for state and federal background checks; renewals do not require fingerprints.2Justia. Georgia Code 16-11-129 – Weapons Carry License
The statutory fees are $30 to the probate court plus $5 for fingerprinting, but most counties add processing fees that bring the total closer to $75. Call your probate court for the exact amount and payment methods before you go.
Once the background check comes back, the judge has ten days to issue or deny the license. The check itself usually takes about 30 days, so expect roughly five to six weeks from application to receiving the license.13Georgia.gov. Apply for a Firearms License
Licenses are valid for five years. Apply to renew at least 90 days before your license expires, or within 30 days after it expires, at your county probate court. A $1 temporary renewal license is available to cover any gap while the renewal processes.2Justia. Georgia Code 16-11-129 – Weapons Carry License
Penalties for Unlawful Carry
Carrying without qualifying as a lawful weapons carrier is a misdemeanor on a first offense, and a second conviction within five years is charged more seriously.4Justia. Georgia Code 16-11-126 – Having or Carrying Handguns, Long Guns, or Other Weapons Carrying in a prohibited location is a misdemeanor for lawful weapons carriers, punishable by up to 12 months in jail and a fine up to $1,000.14Justia. Georgia Code 17-10-3 – Punishment for Misdemeanors The school safety zone rules are the sharpest contrast: a misdemeanor for lawful carriers, a felony carrying up to $10,000 in fines and two to ten years in prison for anyone else.
Local Ordinances Do Not Apply
Georgia’s firearms rules are uniform statewide. No county, city, or school district can pass its own ordinance regulating the possession, carrying, transport, or sale of firearms or ammunition.15Justia. Georgia Code 16-11-173 – Legislative Preemption Someone harmed by a local government that violates this preemption can sue for actual damages (or a minimum of $100), equitable relief, and attorney’s fees. You do not have to research city-by-city rules when traveling within the state.
