If your project or facility will send pollutants into a Georgia river, lake, stream, or coastal water from a pipe, ditch, or similar point source, you need a Georgia NPDES permit from the Environmental Protection Division before that discharge starts. The Clean Water Act created the National Pollutant Discharge Elimination System, and the U.S. EPA has delegated permitting authority in Georgia to the EPD.1US EPA. Who Needs a Georgia NPDES Permit
Three broad categories of activity require coverage, and each turns on whether pollutants leave a specific, identifiable conveyance and reach state waters.
Construction projects. Any construction activity that disturbs one acre of land or more and discharges stormwater to waters of the United States needs NPDES coverage.3eCFR. 40 CFR 122.26 – Storm Water Discharges Smaller sites also qualify if they are part of a larger common plan of development or sale that will disturb one or more acres in total.4US EPA. Georgia also caps active disturbance at 50 acres at any one time unless the permittee gets prior written authorization from the appropriate EPD District Office.5Environmental Protection Division. Industrial facilities. Factories, landfills, transportation hubs, and similar operations need coverage if they generate process wastewater or store materials outdoors where stormwater can pick up contaminants. The EPD looks at the facility’s Standard Industrial Classification code and its stormwater exposure. If rain can reach raw materials, waste, or industrial equipment on the site, you almost certainly need a permit.
Municipal Separate Storm Sewer Systems. Cities and counties operating MS4s must also hold permits, because those systems funnel road and parking-lot runoff into local waterways with no treatment.6Environmental Protection Division. Georgia Water Quality Standards
General Permits vs. Individual Permits
Most applicants fall under a general permit. These cover whole categories of similar dischargers under one set of standardized conditions, and coverage can begin relatively quickly once you file. An individual permit is written for one facility when the discharge is too complex or too large for a general permit. The EPD sets site-specific effluent limits, monitoring schedules, and conditions case by case. Facilities discharging into sensitive or already-impaired waters are more likely to need one. Individual permits go through a mandatory public comment period of at least 30 days before the EPD issues a final decision.7eCFR. 40 CFR 124.10 – Public Notice of Permit Actions and Public Comment Period Both types are capped at a five-year term under federal regulations.
What to Gather Before Applying
All Georgia NPDES applications go through the Georgia Environmental Online Services (GEOS) portal. Before starting, pull together:
- Exact latitude and longitude of each discharge point, in decimal degrees.
- Site maps showing project boundaries, stormwater flow paths, and the location of any state waters.
- Your facility’s SIC or NAICS code.
- The name and location of the receiving water, and whether it appears on Georgia’s 303(d) list of impaired waters, which can trigger stricter conditions.8Environmental Protection Division. Total Maximum Daily Loadings
- For land-disturbing activities, a finalized Erosion, Sedimentation, and Pollution Control Plan.
- Contact information for both the legally responsible official and the technical contact.
Incomplete submissions are the most common cause of delay. Missing coordinates, wrong industry codes, and unsigned forms all result in the EPD sending the file back for corrections instead of issuing coverage.
How to Apply and When You Can Start Work
Applicants file a Notice of Intent through GEOS with an electronic signature, which carries the same legal weight as a physical one. For construction projects, activity may begin 14 days after the complete submission of an NOI.9Environmental Protection Division. Keep a copy of the finalized permit and payment confirmation on site at all times.
Fees
Georgia’s construction stormwater permit fees run $80 per disturbed acre, calculated to the nearest tenth of an acre. In areas with a certified Local Issuing Authority, the $80 splits evenly, with $40 going to the EPD and $40 to the LIA in two separate payments. In areas without a certified LIA, the full $80 per acre goes to the EPD.10Environmental Protection Division. Your Stormwater Pollution Prevention Plan
A construction permit is only half the equation. Every permitted construction site must develop and maintain a Stormwater Pollution Prevention Plan (SWPPP) before breaking ground. Without a compliant SWPPP, you are in violation even if the rest of the paperwork is right.
A SWPPP describes the site, identifies pollutant sources, and lays out the best management practices you will use to prevent erosion and trap sediment. Georgia requires that all BMPs be designed to withstand a 25-year, 24-hour rainfall event.11Georgia Secretary of State. The plan must also set an inspection schedule. Georgia requires inspections at least once every seven calendar days, and inspectors must hold Georgia Soil and Water Conservation Commission Level 1B certification. Inspection records, maintenance logs, and any corrective actions belong in the SWPPP and must be kept on site and available for EPD review. Inspection failures are easy for regulators to spot and are one of the most common enforcement triggers.
Buffers Near State Waters
Georgia law prohibits land-disturbing activity within 25 feet of the banks of any state waters, measured horizontally from the point where vegetation has been uprooted by normal stream flow.11Georgia Secretary of State. If a project must encroach, you need a buffer variance from the EPD. The application requires a detailed site map showing all state waters and wetlands, a site plan identifying the exact area of buffer to be impacted, and a written justification for the encroachment.12Georgia Comp R and Regs. Keeping the Permit in Good Standing
Once you hold coverage, the obligations run for the life of the permit. Construction permittees maintain the SWPPP, conduct the required inspections, and log every corrective action. Industrial permittees face additional monitoring, including periodic sampling of stormwater discharges and submission of discharge monitoring reports to the EPD.
Federal rules require permittees to retain monitoring records, inspection logs, and related documentation for at least three years, and five years for sludge-related activities.14U.S. Environmental Protection Agency. NPDES Permit Writers’ Manual The EPD director can extend that period. In practice, keeping records for the full permit term and at least a year beyond is the safe approach.
Renewing Before Expiration
Georgia NPDES permits last a maximum of five years.15US EPA. NPDES Permit Basics Construction permits tied to a specific project end when the site is fully stabilized and a Notice of Termination is filed. For industrial facilities and MS4s on a five-year cycle, renewal is a firm deadline.
To keep discharging past expiration, submit a complete renewal application at least 180 days before the expiration date.15US EPA. File late and your authorization can lapse entirely, exposing you to enforcement for every day you keep operating without coverage.
Closing Out a Construction Permit
When a construction project reaches final stabilization, file a Notice of Termination through GEOS to formally end coverage. Final stabilization means all soil-disturbing activities are complete and permanent vegetative cover or equivalent stabilization is in place across the entire site. Filing the NOT closes out permit obligations and the fee cycle.
Failing to file is a common and expensive oversight. The permit stays active, compliance obligations continue, and you remain liable for violations at the site until the EPD formally terminates coverage. Handing the site off to a new owner does not shift that liability; the permit stays with the entity that filed the NOI until the NOT clears.
Penalties for Getting It Wrong
Under the Water Quality Control Act, any person who violates a permit condition or fails to comply with an EPD order faces civil penalties of up to $50,000 per day for each day the violation continues, and up to $100,000 per day for a second violation within twelve months of the first.16Justia.
