Georgia Sales Tax Exemption Certificate: Forms, Use, and Renewal

A Georgia sales tax exemption certificate is free in most cases and is applied for through the Georgia Tax Center at gtc.dor.ga.gov, though the specific form, agency, and process depend on whether you’re a government entity, a qualifying nonprofit, a manufacturer, an agricultural producer, or a business buying inventory for resale. Matching your situation to the correct certificate matters more than the paperwork itself. Using the wrong form, or using the right form for the wrong kind of purchase, is what turns an exemption into an audit.

Who Qualifies and Which Certificate You Need

Georgia does not offer a single blanket exemption. Each category has its own rules and its own paperwork.

Government entities. The federal government, the State of Georgia, Georgia counties and municipalities, the University System of Georgia, the American Red Cross, and Community Service Boards are exempt on purchases paid directly with appropriated government funds. They don’t need a sales tax registration number; they present a completed Form ST-5 citing the government funds provision.1State of Georgia Department of Revenue. Nonprofits. Being a 501(c)(3) is not enough on its own. Only specific nonprofit categories qualify in Georgia:

  • Nonprofit licensed general hospitals, mental hospitals, nursing homes, and in-patient hospices that hold federal tax-exempt status
  • Licensed nonprofit child-caring institutions (including orphanages), child-placing agencies, and maternity homes
  • Blood banks and organ procurement organizations with 501(c)(3) status
  • Private K-12 schools approved by the Commissioner, and private colleges and universities whose credits are accepted by the University System of Georgia
  • Nonprofits whose primary function is providing services to intellectually disabled persons
  • Nonprofit organizations that raise money exclusively for public libraries

Most of these apply for a Letter of Authorization (LOA) through the Georgia Tax Center. Hospitals and nursing homes use Form ST-NH1. Churches and religious organizations. One boundary worth stating plainly: churches and religious organizations have no sales tax exemption in Georgia. Manufacturers. Machinery, equipment, and energy that are necessary and integral to the manufacturing process qualify for exemption. Energy used in production is covered; energy for office space, general lighting, or other non-production purposes is not.4Justia Law. Agricultural producers. Farmers qualify for a Georgia Agricultural Tax Exemption (GATE) certificate, which covers equipment and production inputs. To qualify, you generally must own or lease agricultural land that produced and sold at least $5,000 worth of agricultural products during the year, including government payments. Businesses buying for resale. Any Georgia business purchasing inventory for resale can present Form ST-5 with a valid sales tax number and skip the tax at purchase. The exemption applies only to goods you intend to resell, never to supplies or equipment your business consumes itself.7Department of Revenue. Nontaxable Sales

Which Form Matches Which Situation

Georgia uses different forms for different exemption types, and picking the wrong one gets a purchase flagged. The short version:

  • Form ST-5 covers resale, government entities, and several other exempt purchaser categories
  • Form ST-5M is for manufacturers claiming exemptions on machinery, equipment, and integral energy
  • Form ST-CH-1 is for licensed nonprofit child-caring institutions, child-placing agencies, and maternity homes
  • Form ST-8 is for nonresidents buying a motor vehicle tax-exempt in Georgia
  • A Letter of Authorization is required for most nonprofit categories, including hospitals, nursing homes, blood banks, and organizations serving people with intellectual disabilities, and is issued through the Georgia Tax Center rather than as a preprinted form
  • The GATE certificate is issued by the Department of Agriculture at agr.georgia.gov

How to Apply

Nonprofit Letter of Authorization

Most qualifying nonprofits apply through the Georgia Tax Center. You need a GTC account first. If your organization has never filed Georgia tax returns and has no filing obligation, call the Department of Revenue at 877-423-6711 to have an account set up.8Department of Revenue. Once logged in, open the “More…” tab, find the “Sales Tax Exemptions” section, and click the hyperlink that matches your organization type. The application asks you to confirm eligibility, answer questions about your operations, and report prior-calendar-year financial data where applicable. You’ll also upload your IRS Exemption Determination Letter.

Submitting the application generates a confirmation number. To check status later, log back in, open “More…,” and use “Search Submissions.” Once you’re approved, the LOA is available to view and reprint under “View Letters.”

The LOA runs on a fiscal-year cycle, July 1 through June 30. If you’re applying for the current period, leave the default dates alone. If you need coverage that starts before July 1 of the current year, adjust the date selection during the application.

GATE Certificate

Agricultural producers apply at agr.georgia.gov, not through the Department of Revenue. Paper Applications

Using the Certificate Without Creating a Problem

Give the vendor a completed copy of your certificate at or before the point of sale. For resale, that’s Form ST-5 with your sales tax number. For manufacturing, Form ST-5M. Nonprofit LOA holders provide a copy of the letter itself.7Department of Revenue. Nontaxable Sales

Every exemption has a scope, and staying inside it is the whole game. A resale certificate covers goods you plan to sell to customers, not office supplies, cleaning products, or furniture for your own use. A manufacturer’s exemption covers machinery and energy used in production, not the electricity in the front office. Using an exemption certificate outside its scope is the most common trigger for an assessment.

If you buy from an out-of-state vendor that ships into Georgia, your Georgia certificate still applies.9Department of Revenue. Out-of-State Sellers

Keep copies of every exemption certificate and every tax-exempt purchase record for at least three years after the transaction. If the Department of Revenue issues an assessment and you appeal, keep the records until the appeal is fully resolved, even if that runs past the three-year mark.10Cornell Law School Legal Information Institute. How Long the Certificate Lasts

Nonprofit LOAs expire every June 30. You reapply through the Georgia Tax Center before the current authorization runs out, using the same process as the initial application and uploading updated financial data and your IRS determination letter if prompted.8Department of Revenue. GATE certificates last three years, not one, and the $150 fee covers the full period. Form ST-5 for resale and Form ST-5M for manufacturers have no built-in expiration date, but vendors may ask for updated copies periodically, and the information on the form has to stay current. If your business name, address, or sales tax number changes, issue new certificates to your suppliers.

Penalties for Misusing a Certificate

Obtaining a certificate by fraud or using one you aren’t entitled to is a misdemeanor under Georgia law.11Justia Law. If Your Application Is Denied

You have 45 days from the date on the denial notice to file a protest. Protests can be filed online through the Georgia Tax Center or by mail using Form TSD-1 with supporting documentation.13Department of Revenue. Protests and Appeals

If the Department denies the protest, you can appeal to the Georgia Tax Tribunal or the appropriate superior court. The deadline is the later of two years from the original denial or 45 days from the Department’s decision on the protest. For most applicants the Tax Tribunal is the more practical venue. It has lower filing fees than superior court, uses judges experienced in tax law, and does not require a bond.
