Georgia Temporary License Plate: TOPs, Extensions, and Penalties

In Georgia, the temporary license plate rules work like this: when you buy from a licensed dealer, the dealer must give you a temporary operating permit (TOP) at no cost, and it is valid for 45 days from the purchase date. You can legally drive on Georgia roads during that window without a permanent plate. But the permit’s 45 days and your registration deadline are not the same number. You have only 30 days from purchase to register the vehicle, and if you bought from a private seller, you get no temporary permit at all.¹²

Dealer Purchases and the 45-Day TOP

Every Georgia dealer selling a new or used vehicle is required to issue a temporary operating permit to the buyer at the point of sale, free of charge. The permit expires 45 days from the purchase date.² It has to be displayed on the rear of the vehicle in the space provided for a license plate. Not inside the back window.³

Here is the trap most buyers walk into. The permit lasts 45 days, but you only have 30 days from the purchase date to apply for registration at your county tag office. The extra 15 days on the permit is a cushion in case your permanent plate hasn’t arrived yet, not extra time to file paperwork.¹

Dealers are not legally required to submit the registration application on your behalf. Some do it as a courtesy. If yours doesn’t, the 30-day clock is entirely yours to manage.¹

You are protected from penalties while a valid TOP is displayed during the allowed registration period. And if you have already applied for registration but your permanent plate hasn’t arrived, evidence of that application shields you as well.²

Private Sales Do Not Get a Temporary Tag

Temporary operating permits are only issued by dealerships. If you buy from a private party (Georgia calls this a “casual sale”), you cannot get a TOP anywhere. Instead, you must title and register the vehicle within seven business days of the purchase date.¹

Bring the following to your county tag office:

A valid Georgia driver’s license or ID card
The signed title from the seller
A completed Form MV-1 (Title/Tag Application)
Proof of Georgia liability insurance
An emissions inspection certificate, if your county requires one

Seven business days is tight. Gather your documents before the sale closes if you can. Once that window passes, driving the vehicle without registration is a misdemeanor.²

Out-of-State Purchases and New Residents

If you move to Georgia or buy a vehicle in another state, you have 30 calendar days after establishing residency to register.² After that, your out-of-state registration is no longer valid here.

Georgia does not issue temporary operating permits for vehicles brought in from other states. You drive on your existing out-of-state tag during the 30-day grace period, then switch directly to permanent Georgia registration. Bring your out-of-state title, a valid Georgia driver’s license, proof of Georgia-compliant liability insurance, and an emissions certificate if you live in one of the 13 counties that require testing.

Extending a Dealer-Issued Permit

A TOP can be extended in one narrow situation: the dealer has not delivered your title for transfer with more than five business days left before the permit expires. When that happens, you can apply for a single 30-day extension at your county tag office.⁴

To get it, you need to:

Surrender the dealer-issued TOP for destruction
Provide proof of ownership (the dealer’s invoice)
Show a valid Georgia driver’s license
Complete Form T-226, “Application to Extend the Registration Period of a Motor Vehicle Purchased from a Georgia Motor Vehicle Dealer”

The extension is not a general grace period for anyone who missed a deadline. It exists specifically because dealer title delays are common. If the delay is on your side, the extension may not apply.⁴

Penalties for Driving on an Expired or Missing Tag

Operating a vehicle in Georgia without a valid registration or license plate is a misdemeanor. If you own and drive the unregistered vehicle yourself, it is a general misdemeanor. If you rent, lease, or loan an unregistered vehicle to someone else, the fine is $100 per violation, and each day of operation counts as a separate offense.²

Late registration itself carries a penalty of 10% of the ad valorem tax due plus 25% of license plate fees, with a minimum ad valorem penalty of $5.⁵ Those charges compound the longer the tag sits expired.

Tampering is treated separately. Altering, defacing, or concealing any marking on a license plate is a misdemeanor.⁶ It is also illegal to display any temporary or permanent tag on the rear of a vehicle that is “intended to resemble” a Georgia-issued plate but wasn’t actually issued by the state.⁵ That means paper or novelty plates from third parties are not a legal substitute for a dealer TOP.

What About Renewing a Permanent Plate

Once you have permanent plates, Georgia’s temporary-tag rules no longer apply. Renewals run on your birthday: in counties with year-round registration you can renew up to 30 days before your birthday, and the registration expires at midnight on that date.⁷ There is no temporary permit to bridge a missed renewal. If your tag expires, you are driving unregistered until you catch up at the tag office.
