Under Georgia’s tobacco age law, you have to be at least 21 to buy, attempt to buy, or possess cigarettes, cigars, smokeless tobacco, e-cigarettes, vape pods, or nicotine pouches. Tobacco 21 Selling to someone under 21 is illegal, and so is buying if you are under 21. Both sides carry penalties, but they look very different.
What the Law Covers
The 21 minimum applies across the board: cigarettes, cigars, smokeless tobacco, vapor products, and alternative nicotine products like pouches and lozenges. “Vapor products” is defined broadly enough to catch disposable vapes, refillable tanks, and pod systems, so there is no loophole for one style of device over another.1Justia. Acceptable Proof of Age
Federal rules tell retailers to check ID for anyone who looks under 30.2Food and Drug Administration. Tobacco 21 Georgia’s Department of Revenue narrows what counts: a state-issued driver’s license, a state-issued ID card, or a government-issued ID such as a U.S. passport or military ID.3Department of Revenue. As of November 2025, Georgia’s Department of Driver Services confirmed that a mobile driver’s license stored in a digital wallet is a valid ID for age-restricted purchases, and the DOR Alcohol and Tobacco Division issued a bulletin to the same effect.4Georgia Department of Driver Services. Digital Driver’s Licenses Can Now Be Accepted for Age-Restricted Purchases Acceptance is still up to each retailer, though. A store can require a physical card, and some do because their scanners can’t read a phone screen. Out-of-state government IDs are generally accepted, but a clerk who can’t confidently verify an unfamiliar document is within their rights to decline the sale.
Penalties if You’re Under 21
Georgia does not fine underage buyers a flat dollar amount for tobacco possession or purchase. The statute focuses on service and education, and it reserves its sharper penalty for repeat offenders. - Up to 20 hours of community service, often connected to tobacco and vaping health awareness.
- Mandatory attendance at a lecture or program on the health hazards of smoking and vaping, provided at no cost.
- A 45-day suspension of your driver’s license or driving privilege for a third or subsequent violation within the same calendar year, or for failing to complete assigned community service. The Department of Driver Services handles the suspension.
The license suspension is the penalty with real weight behind it. Losing driving privileges for 45 days over a tobacco citation hits hard if you need to get to work or class, and skipping court-ordered community service can accelerate you to that penalty.
Using a Fake ID Is a Separate Charge
If you are under 21 and use a fake, altered, or borrowed ID to buy tobacco, you also face charges under O.C.G.A. 16-9-4 for possession or use of a fraudulent identification document.5Justia. Penalties for Retailers Who Sell to Minors
A knowing sale of tobacco to someone under 21 is a misdemeanor in Georgia, which under the general sentencing statute carries up to a $1,000 fine and up to 12 months in jail per violation.1Justia. The owner can face suspension or revocation of the store’s tobacco license through the DOR’s Alcohol and Tobacco Division, which handles licensing and enforcement investigations.8Georgia Department of Revenue. Federal penalties come on top of the state charge. The FDA runs its own undercover compliance checks and typically issues a warning letter for a first violation, then civil money penalties for repeats within defined windows:9Food and Drug Administration. - Second violation within 12 months: up to $365
- Third violation within 24 months: up to $727
- Fourth violation within 24 months: up to $2,920
- Fifth violation within 36 months: up to $7,300
- Sixth violation within 48 months: up to $14,602
Persistent violators can be hit with a no-tobacco-sale order, which temporarily bars the retailer from selling any tobacco product. The single-violation federal maximum is $21,903. A retailer caught in one compliance check can face both a Georgia misdemeanor and an FDA penalty from the same sale.
Vending Machines and Online Orders
Georgia doesn’t ban tobacco vending machines outright, but O.C.G.A. 16-12-173 restricts them to locations not readily accessible to people under 21: factories, offices closed to the public, bars that don’t admit anyone under 21, areas under continuous supervision by the owner or an employee, and rest areas on state roads and highways. Every machine must display a sign that purchases by anyone under 21 are prohibited by law, and the machine can dispense only tobacco products and matches. Vapor products are stricter. Under Georgia’s revenue code, they may be sold only in person, face to face, or through specifically authorized electronic means, and never through vending machines.11Department of Revenue. Notice ATD-2026-05
Ordering online doesn’t get around the age rule either. Georgia’s delivery sales statute requires that the person receiving a tobacco delivery be at least 21 and present proper ID at delivery, and the delivery person must verify identity and age and obtain a signed receipt certifying legal age.12Justia. Consumer-to-door vape shipping through mainstream carriers is essentially unavailable.
Vaping in School Safety Zones
Georgia treats vaping in a school safety zone as its own offense, and this one reaches adults too. Under O.C.G.A. 16-12-171(c), knowingly using a vapor product inside a school safety zone is illegal regardless of age. For someone 21 or older, a first conviction is a $25 fine and a second is $50, and the statute prohibits courts from tacking on additional fees, surcharges, or prosecution costs for first and second offenses. For someone under 21, the penalties track the underage possession rules: community service, an education program, and potential license suspension for repeats. How the Rules Get Enforced
Enforcement runs on parallel tracks.
