Georgia Tobacco Tax Rates, Licensing, and Penalties

Georgia’s tobacco tax is a set of excise taxes under Title 48, Chapter 11 of the Official Code of Georgia Annotated, covering cigarettes, cigars, loose and smokeless tobacco, and vapor products.1Justia Law. Georgia Code Title 48 Chapter 11 – Cigar, Cigarette and Loose or Smokeless Tobacco Taxes Cigarettes are taxed at 37 cents per pack of 20, one of the lowest state cigarette rates in the country.2FindLaw. Georgia Code Title 48 Revenue and Taxation 48-11-2 – Excise Tax on Cigars, Cigarettes, Loose or Smokeless Tobacco, Alternative Nicotine Products, and Vapor Products Licensed distributors collect the tax before product reaches a retail shelf, prepaying cigarette tax through official stamps and filing monthly returns with the Department of Revenue for other categories.

Rates by Product

All rates below come from O.C.G.A. ยง 48-11-2.2FindLaw. Georgia Code Title 48 Revenue and Taxation 48-11-2 – Excise Tax on Cigars, Cigarettes, Loose or Smokeless Tobacco, Alternative Nicotine Products, and Vapor Products

Cigarettes

37 cents per pack of 20. Other pack sizes are taxed at the same proportional rate.

Little Cigars

Two and one-half mills each (a quarter of a cent per cigar) for small rolls wrapped in tobacco leaf weighing no more than three pounds per thousand.

All Other Cigars

23 percent of the wholesale cost price, excluding trade discounts and promotional allowances. Classification matters here: applying the little-cigar rate to a product that doesn’t meet the weight definition creates audit exposure the moment the shipment is reviewed.

Loose and Smokeless Tobacco

10 percent of the wholesale cost price, excluding discounts and promotional allowances. Because the tax is calculated against the wholesale invoice, the manufacturer’s invoice is the document a Department of Revenue auditor will ask for first.

Vapor and E-Liquid Products

Vapor products are taxed under the same statute as traditional tobacco, with the rate depending on the product’s design:

  • Closed-system vapor products, meaning pre-filled, non-refillable pods or cartridges: 5 cents per fluid milliliter of consumable liquid.
  • Open-system consumable vapor products, meaning refillable e-liquids sold separately: 7 percent of the wholesale cost price, excluding discounts and promotional allowances.
  • Disposable vapor devices sold pre-filled and not designed for reuse or refilling: 7 percent of the wholesale cost price.

A store that sells both disposable pens and bottled e-liquid is running two different calculations against the same shelf.

How the Tax Gets Paid

Cigarette Stamps

Distributors prepay the cigarette tax by buying official stamps from the Department of Revenue. Every pack must carry a stamp before it reaches a retail shelf.3Justia Law. Georgia Code Title 48 Chapter 11 – Taxes on Tobacco and Vaping Products Unstamped cigarettes are contraband and can be seized on sight.4Justia Law. Georgia Code 48-11-9 – Seizure as Contraband

Licensed distributors who purchase stamps on account must pay in full by the 20th of the month following the purchase.5Justia Law. Georgia Code 48-11-16 – Purchase of Tax Stamps on Account by Licensed Distributors Distributors receive a 4 percent discount on the face value of cigarette stamps as compensation for collecting the tax on the state’s behalf.6Legal Information Institute. Monthly Returns

Licensed businesses file monthly excise tax returns through the Georgia Tax Center. Returns are due by the 10th of each month for the prior month’s activity, with the deadline shifting to the next business day when the 10th falls on a weekend or state holiday.7Georgia Department of Revenue. Distributor Applications

Distributor applications go through the Georgia Tax Center portal. Required documentation includes a current annual registration and letter of good standing from the Secretary of State, a scanned list of the tobacco products you intend to sell, Form ATT-17 (the notarized Georgia Alcohol and Tobacco Personnel Statement, completed by anyone with an ownership interest and, for corporations, all officers),10Georgia Department of Revenue. ATT-17 Georgia Alcohol and Tobacco Personnel Statement a notarized Citizenship Affidavit with a secure and verifiable government-issued photo ID,11Georgia Department of Revenue. Retail Tobacco Renewal and surety bonds. Each document uploads as an individual PDF through the GTC.

Alcohol and Tobacco Bond Form Certain license categories require a $5,000 bond, and nonresident applicants must post a bond of at least $1,000 in an amount determined by the Commissioner.13Georgia Secretary of State. Retail Applications

Retailers also apply through the GTC. Background investigations, tax clearance checks, and fingerprinting may be required depending on the specific license type.9Georgia Department of Revenue. Applying for Tobacco Licenses and Permits Retailers who are not U.S. citizens must resubmit their Citizenship Affidavit and secure identification document every year at renewal.

Annual Renewal

All tobacco licenses renew annually through the GTC.14Georgia Department of Revenue. Tobacco License Renewal A lapsed license removes your legal authority to sell. Continuing to sell during the gap creates both civil and criminal exposure.

Penalties for Noncompliance

Enforcement layers seizure, financial penalties, and license action, and a single violation can trigger more than one.

Contraband Seizure

Possessing or selling unstamped tobacco or vapor products is illegal. The Department can seize the products as contraband, and that seizure does not relieve the violator from fines, imprisonment, or other penalties under the tobacco tax chapter.4Justia Law. Georgia Code 48-11-9 – Seizure as Contraband

Late Filing and Underpayment

Willful failure to file a return or pay tobacco taxes held in trust for the state triggers a civil penalty of 10 percent of the unpaid amount, plus interest.15Justia Law. Georgia Code 48-2-44 – Penalty and Interest on Failure to File or Pay For the 2026 calendar year, the annual interest rate on past-due taxes is 9.75 percent, accruing monthly.16Georgia Department of Revenue. Annual Notice of Interest Rate Adjustment Georgia sets the rate by adding 3 percentage points to the Federal Reserve’s bank prime loan rate, so it shifts year to year.

License Suspension and the Right to a Hearing

If a distributor falls behind on tax obligations, the Department can suspend the license. Reinstatement requires full payment of all outstanding liability, including administrative penalties.17Georgia Department of Revenue. Licensees who receive a citation have the right to dispute the charges before the Department’s Administrative Hearing Officer, with pleas of guilty, not guilty, or no contest. Not guilty requires the Department to prove its case; you can represent yourself or hire an attorney. Failing to respond at all, by neither appearing at the hearing nor submitting a plea, can result in additional penalties on top of the original citation. The Hearing Officer’s decision is delivered through your GTC account.17Georgia Department of Revenue. Administrative Hearing Office Information Package – Alcohol and Tobacco Licensees
