Georgia Verified Answer: When It’s Required and How to File

In Georgia, you need to file a verified answer whenever the plaintiff’s pleading came in sworn under oath, most commonly in suits on an open account, petitions for injunctions or other extraordinary equitable relief, and probate matters. When Verification Is Required

The trigger to watch for is a sworn complaint. Under 9-10-111, whenever the plaintiff’s pleading is backed by an affidavit, the defendant’s answer must be verified in the same way. For a corporate defendant, an officer, agent, or other person whose duties cover the relevant facts can sign the verification on the company’s behalf.1Justia. Open Account Claims

This is the situation most defendants encounter. Under Georgia Code 9-10-112, when a plaintiff sues on an open account and verifies the claim, the defendant’s answer must either deny any debt at all or specify the amount admitted, and it must be verified either way.3Justia. File an unverified answer, and the plaintiff’s sworn affidavit can be treated as sufficient proof of the debt.

Equitable Relief Petitions

Georgia Code 9-10-110 requires petitioners seeking a restraining order, injunction, receivership, or other extraordinary equitable relief to verify the petition.4Justia. Probate Proceedings

Every application to a probate court judge must be made by verified petition.5Justia. Georgia Code 15-9-86 – Verified Petitions Will contests, guardianship disputes, and estate administration objections should be filed with verification to match.

Certain Family Law Filings

Some family law matters require verification by their own statute. Georgia Code 19-9-69, for example, requires a sworn affidavit from the plaintiff in custody-related proceedings. When the initiating pleading is verified, a defendant contesting the allegations should file a verified response.

When Verification Is Not Required

If the complaint is not sworn, your answer generally does not need to be either. Standard negligence, breach of contract, and personal injury cases fall under the default rule in 9-11-11(b).2Justia. Dispossessory cases are the surprise. Despite the stakes, Georgia case law has held that a tenant’s answer to an eviction complaint does not need to be verified. Under Georgia Code 44-7-51, the tenant simply must answer within seven days of service, orally or in writing.6Justia. If the tenant doesn’t respond in time, the court issues a writ of possession immediately, without a hearing, and the landlord is entitled to a default judgment for all rent claimed in the affidavit.7Justia. Drafting the Answer

A verified answer has two working parts: the responsive pleading and the verification affidavit. Both must be right.

Address Every Allegation

Georgia Code 9-11-8(b) requires you to respond to every allegation in the complaint. For each one, you admit it, deny it, or state that you lack knowledge sufficient to form a belief, which counts as a denial.8Justia. Skipping a paragraph because it looked minor is how defendants concede facts they never meant to give up.

The Verification Affidavit

The verification must be sworn before a notary public, magistrate, judge, or any other officer authorized to administer oaths in the state or county where the oath is taken.9Justia. Georgia Code 9-10-113 – When Verification Sufficient The affidavit should state that the person signing has personal knowledge of the facts and swears they are true. A missing notary seal or an incomplete jurat can render the whole verification defective, and courts have rejected filings on that basis.

Watch the language. Courts draw a sharp line between statements made on personal knowledge and statements made “to the best of my knowledge and belief.” A verification that hedges signals uncertainty, and some courts treat a hedged verification as no verification at all where personal knowledge is required. If you personally witnessed or participated in the events, say so plainly. If you’re relying on records or on information from others, identify those sources in the affidavit rather than papering over the difference with vague wording. When an attorney signs the verification for a client, the affidavit should make clear whether the attorney has personal knowledge or is relying on what the client provided.

Deadlines and Filing

Under Georgia Code 9-11-12(a), a defendant has 30 days after service of the summons and complaint to file an answer.10Justia. Magistrate court civil claims run on the same 30-day clock.11Justia. File the verified answer with the clerk of court in the jurisdiction where the case is pending. Many Georgia courts accept electronic filing through PeachCourt; when filing that way, scan and upload the notarized affidavit as part of the submission. Courts that don’t use PeachCourt take in-person or mailed filings. Filing an answer generally doesn’t carry a fee beyond initial filing costs.

What Happens If You Skip Verification

When verification is mandatory and you leave it out, the consequences depend on the case. In an open account suit, an unverified answer may be treated as no answer at all, leaving the plaintiff’s sworn affidavit as the only evidence in front of the court. In equitable relief cases, an unverified response to a verified petition gives the other side’s factual claims significantly more weight.

At worst, a court can strike the unverified pleading entirely, putting the defendant in the same position as someone who never answered and opening the door to default judgment. Some courts will let a defendant fix the problem by refiling with a proper verification before ruling, but that’s a grace, not a right. If there’s any question whether verification applies, verify.

Perjury and Sanctions for a False Verification

A verified answer is sworn under oath, so lying in one is a crime. Under Georgia Code 16-10-70, anyone who knowingly makes a false material statement in a judicial proceeding after taking a lawful oath commits perjury, punishable by a fine of up to $1,000, imprisonment for one to ten years, or both.12Justia. On the civil side, Georgia Code 9-15-14 lets courts impose attorney’s fees and litigation expenses against a party who asserts a claim or defense so lacking in factual or legal basis that no reasonable person could believe a court would accept it. Courts can also sanction parties whose conduct lacked “substantial justification” or was interposed for delay or harassment. Sanctions can hit the party, the attorney, or both.13Justia. Fixing or Amending a Verified Answer

Georgia Code 9-11-15(a) lets you amend a pleading as a matter of course, without asking the court, any time before entry of a pretrial order. After a pretrial order, you need written consent from the other side or leave of court, which courts are directed to grant freely when justice requires.14Justia. An amended answer must be re-verified. Changing the text without re-swearing the verification makes the amendment defective, and the new verification must be executed before a notary or other authorized officer.9Justia. Georgia Code 9-10-113 – When Verification Sufficient If the original had a technical defect, such as a missing seal or an incomplete jurat, some courts allow a nunc pro tunc correction to fix the record retroactively without full resubmission. If the amendment introduces new factual claims rather than fixing a formality, expect the opposing party to challenge it as a material change and expect the court to look more closely.
