Gun laws in New York City are governed by a licensing system run entirely by the NYPD License Division, and no firearm permit from any other state or any other New York county is valid inside the five boroughs. If you want to possess a handgun, rifle, or shotgun in the city, you need a license or permit issued by the NYPD itself. Unlicensed possession of a loaded handgun is a violent felony that carries a mandatory minimum of three and a half years in state prison, even for a first offense, so the stakes of getting this wrong are serious.
Who Needs an NYPD License
Everyone. Handguns require a license from the NYPD License Division. Rifles and shotguns require a separate permit through the NYPD’s Rifle and Shotgun Section.1New York City Police Department. Firearms Licensing A Pennsylvania concealed carry license, a Florida non-resident permit, and even a Westchester County pistol license all carry zero legal weight the moment you cross into the city.
Travelers passing through NYC airports have been arrested for declaring firearms in checked luggage without an NYC-specific license. The federal Firearm Owners Protection Act offers limited protection for uninterrupted travel through the city, but stopping overnight or deviating from your route can wipe out that defense. If you are moving to or visiting NYC with a gun, assume your existing permit does nothing for you until you have an NYPD document in hand.
Types of Handgun Licenses
The NYPD issues several categories of handgun license under Title 38, Chapter 5 of the Rules of the City of New York.2American Legal Publishing. Rules of the City of New York – Section 5-01 Types of Handgun Licenses Each comes with different privileges:
- A Premises License (Residence or Business) lets you keep a handgun at one specific address. You cannot carry it in public, and transport is tightly regulated.
- A Carry License permits concealed carry on your person and is available to residents and non-residents. It is the most demanding application.
- Carry Guard and Gun Custodian Licenses are restricted carry permits that are valid only while you are actively working as a licensed security guard or gun custodian.
- A Special Carry License is for people who already hold a valid New York State county carry license. If the underlying county license is revoked or surrendered, the Special Carry License automatically becomes void.
Rifle and shotgun permits run through their own application process and fee schedule.3NYPD License Division. NYPD License Division – Contact Us
What Is Banned Regardless of Any Permit
A license lets you possess certain firearms. It does not override the categorical bans in state law.
New York bans assault weapons, and the definition is broad. A semiautomatic rifle that accepts a detachable magazine becomes an assault weapon if it has even one prohibited feature, such as a pistol grip, folding or telescoping stock, thumbhole stock, flash suppressor, or bayonet mount. Similar one-feature tests apply to semiautomatic pistols and shotguns, and revolving-cylinder shotguns are banned outright.4New York State Senate. New York Penal Code 265.00 – Definitions
Magazines are capped at ten rounds. You cannot buy, sell, or possess a magazine that holds more.5New York Gun Safety. Resources for Gun Owners The limit applies regardless of when the magazine was manufactured. Owners of higher-capacity magazines were required to permanently modify, dispose of, or transfer them out of state by January 15, 2014.
Ghost guns and unserialized firearms are illegal. Every firearm must carry a serial number, and manufacturing or possessing an untraceable firearm is a crime. Legislation has been introduced to specifically criminalize using 3D printers to produce firearms or firearm components.6New York State Senate. Senate Bill S7364A
How to Apply for a Carry License
The concealed carry application is the most involved. New York Penal Law § 400.00 sets the baseline statewide requirements, and the NYPD adds procedures on top.7New York State Senate. New York Penal Code 400.00
Training
You must complete a state-approved firearms safety course of at least sixteen hours of in-person classroom instruction plus two hours of live-fire range training.7New York State Senate. New York Penal Code 400.00 The classroom portion covers safe handling, de-escalation, storage, and the legal standards for use of deadly force. The instructor must be approved by the Division of Criminal Justice Services. Course prices range from about $45 to $350.
References and Background Information
You need at least four character references who can speak to your moral character and confirm you have not made statements or engaged in behavior suggesting a risk of harm to yourself or others.7New York State Senate. New York Penal Code 400.00 The application also requires detailed employment and residence histories going back several years, along with disclosure of any past interactions with law enforcement. Discrepancies can lead to denial.
The Concealed Carry Improvement Act originally required applicants to list their social media accounts from the previous three years, but New York consented to a federal court injunction barring enforcement. The provision still appears in the text of § 400.00 but is not currently being enforced.7New York State Senate. New York Penal Code 400.00 Because this is actively litigated, check the current NYPD License Division portal before you file.
Fees and Timeline
The NYPD charges a non-refundable application fee of $340 for a handgun license and $140 for a rifle or shotgun permit. Fingerprinting adds $88.25 for state and federal background checks.8NYPD License Division. New Application Instructions Combined with the training course, first-time applicants should budget $500 to $700 before purchasing a firearm.
You file digitally through the NYPD’s online portal. The License Division then schedules a mandatory in-person appointment for fingerprinting and an interview with an investigator. Full review routinely takes six months or longer, and anything complicated in your background extends it. If approved, you receive a Notice of Approval and instructions for purchasing. Each individual gun purchase after that requires a separate Purchase Authorization from the NYPD before you can take possession.9NYPD License Division. Forms
If you are denied, you have four months from the final denial to challenge the decision through an Article 78 proceeding in New York State Supreme Court. Courts enforce that deadline strictly.
Where You Still Cannot Carry
A carry license does not let you carry everywhere. The Concealed Carry Improvement Act designates a long list of “sensitive locations” where firearm possession is prohibited even for licensees. Violating this rule is a class E felony under Penal Law § 265.01-e.10New York State Senate. New York Penal Code 265.01-e – Criminal Possession of a Firearm, Rifle or Shotgun in a Sensitive Location The list covers:11New York Gun Safety. Frequently Asked Questions – New Concealed Carry Law
- Government buildings, including courthouses
- Hospitals, behavioral health centers, and chemical dependence treatment facilities
- All public and private schools, nursery schools, preschools, colleges, universities, summer camps, and state-licensed or state-funded childcare facilities
- Parks, playgrounds, zoos, libraries, and public sidewalks or areas restricted for special events or protests
- All public transportation, including subway trains, buses, and transit facilities
- Theaters, stadiums, museums, amusement parks, concert halls, conference centers, banquet halls, gaming facilities, bars, restaurants that serve alcohol, and on-premises cannabis consumption sites
- Houses of worship, except for those specifically designated as responsible for site security
- Polling places
- Times Square, within boundaries set by the city and marked by signage
Between the subway, parks, and any restaurant that serves wine, that list covers most of a typical day in New York City. Licensed carriers have to plan routes carefully.
Private property is also off-limits by default. Under Penal Law § 265.01-d, entering or remaining on private property with a firearm is a class E felony unless the owner has posted clear signage permitting firearms or has given express consent.12New York State Senate. New York Penal Code 265.01-d – Criminal Possession of a Weapon in a Restricted Location Silence from the property owner means no. This flips the rule used in many other states.
Safe Storage and Transport
Under Penal Law § 265.45, any gun owner who lives with someone under eighteen, with a person subject to an extreme risk protection order, or with someone prohibited from possessing firearms must lock each firearm in a safe storage container or render it inoperable with a gun locking device whenever the firearm is not in the owner’s immediate possession or control.13New York State Senate. New York Penal Code 265.45 – Failure to Safely Store Rifles, Shotguns, and Firearms in the First Degree
NYC adds its own layer. Premises license holders must store their handgun in a locked container with a safety locking device whenever it is outside their immediate possession or control, regardless of who else lives in the home.2American Legal Publishing. Rules of the City of New York – Section 5-01 Types of Handgun Licenses
If you hold a premises license, moving the firearm requires the gun to be completely unloaded and placed in a sturdy, locked container with ammunition stored separately and not immediately accessible. These rules apply whether you are driving to an authorized range, moving house, or transporting the gun to a licensed dealer.
New York imposes no statutory duty to inform a police officer that you are carrying during a stop. If you hold a carry license and choose to disclose, handing over the license alongside your identification clarifies your status immediately.
Penalties
Possessing a loaded handgun without an NYPD-issued license is criminal possession of a weapon in the second degree under Penal Law § 265.03, a class C violent felony.14New York State Senate. New York Penal Code 265.03 – Criminal Possession of a Weapon in the Second Degree It carries a mandatory minimum of three and a half years in state prison, even for a first offense with no prior record. The statute applies equally to someone carrying for self-defense who simply did not obtain the right permit.
Possessing a firearm in a sensitive location or on restricted private property is a class E felony with a maximum of four years in state prison.10New York State Senate. New York Penal Code 265.01-e – Criminal Possession of a Firearm, Rifle or Shotgun in a Sensitive Location Conviction typically results in permanent revocation of your license. Safe storage violations under § 265.45 are charged as a criminal offense as well.
License Renewal
All NYPD-issued handgun licenses and rifle/shotgun permits expire after three years. The renewal fee is $340 for handgun licenses and $140 for rifle or shotgun permits.8NYPD License Division. New Application Instructions The NYPD mails renewal instructions before your license expires, and you file the renewal through the same online portal used for new applications. You cannot begin an online renewal until that letter arrives. Carry license renewals require you to complete the firearms safety training course again, including the live-fire component. If your license lapses, you are no longer legally authorized to possess your firearms, so tracking the expiration date matters.
A Note for Retired Law Enforcement
Qualified retired officers sometimes assume the federal Law Enforcement Officers Safety Act (LEOSA) lets them carry concealed anywhere in the country, including NYC. The New York State Police have explicitly warned that relying on LEOSA alone in the city is risky and not recommended.15New York State Police. Law Enforcement Officers Safety Act (LEOSA / HR-218) – Guidance for Retired Officers NYC still requires a local permit for handgun possession, no court decision has definitively resolved the conflict, and arrests of retired officers relying solely on LEOSA credentials have occurred. LEOSA also does not override local magazine capacity or ammunition restrictions. The State Police advise retired officers to either obtain an NYC permit or avoid carrying within city limits.
