Harris County Hotel Occupancy Tax: Rates, Exemptions, and Filing

The Harris County hotel occupancy tax is a 2% charge on the price of any room rented for fewer than 30 consecutive days inside the county, collected by the hotel or short-term rental operator and remitted to the Harris County Tax Office each quarter. A separate 2% Harris County–Houston Sports Authority tax applies on the same transaction in areas it covers, and both sit on top of state and city hotel taxes that the guest also pays.

The Rate and How It Stacks With Other Hotel Taxes

The county’s own levy under Texas Tax Code Chapter 352 is 2% of the room price. The Sports Authority tax, authorized by Texas Local Government Code Chapter 334, is another 2% on the same bill. These are two distinct taxes, even though they are reported together.1Texas Comptroller of Public Accounts. Hotel Occupancy Tax FAQs

A guest at a Houston hotel typically sees four hotel taxes layered on the room rate:

  • State of Texas: 6%
  • City of Houston: 7%
  • Harris County: 2%
  • Harris County–Houston Sports Authority: 2%

The combined 17% is the statutory ceiling Texas allows from all sources. One small threshold matters: if a room costs less than $2 per day, no local hotel tax is due.1Texas Comptroller of Public Accounts. Hotel Occupancy Tax FAQs

Which Properties and Stays Are Covered

Texas Tax Code Chapter 352 defines a hotel broadly: any building where the public pays for sleeping accommodations. That sweeps in traditional hotels, motels, inns, bed-and-breakfasts, rooming houses, tourist courts, and short-term rentals listed on platforms like Airbnb or Vrbo. If you rent out a room or a whole dwelling for fewer than 30 consecutive days and charge at least $2 a night, you are operating a hotel for county tax purposes and must collect the tax.2Texas CIRA. A few places where people sleep are excluded from the definition anyway: hospitals, sanitariums, nursing homes, college dormitories used for educational programs, and oilfield portable units.2Texas CIRA. Texas Tax Code Chapter 352 – County Hotel Occupancy Taxes

Who Is Exempt

Several categories of guests do not owe the tax, but the mechanics differ by category.

Permanent Residents

Any guest who stays 30 or more consecutive days without a break in payment is a permanent resident and owes no hotel occupancy tax for that stay. A guest who gives the property written notice of intent to stay at least 30 days becomes exempt from the date of the notice, as long as they actually remain the full 30. A guest without advance notice pays tax for the first 30 days and stops owing it from day 31 forward. Any gap in payment resets the clock.3Texas Comptroller of Public Accounts. Federal Government Travelers

The United States government, its agencies, and federal employees traveling on official business are fully exempt from state and local hotel occupancy taxes. The employee should present a government ID or travel authorization at check-in.4Justia. Texas Tax Code Chapter 156 – Hotel Occupancy Tax

State Government Travelers

Most Texas state employees and agencies pay the tax at check-in and then request a refund from the Comptroller. A narrow group of designated state officials, mainly judicial officers, agency heads, members of state boards, and the Texas Legislature, carry a special photo ID card that exempts them at check-in. District attorneys and judges obtain their cards directly from the Comptroller.3Texas Comptroller of Public Accounts. Hotel Occupancy Tax Exemptions

Religious, Charitable, and Educational Organizations

A corporation or association organized and operated exclusively for a religious, charitable, or educational purpose is exempt, provided no part of its earnings benefits a private shareholder. The educational exemption is limited to schools qualifying as Texas institutions of higher education under the Education Code.4Justia. Texas Tax Code Chapter 156 – Hotel Occupancy Tax

Exemption Certificates

Every exempt guest other than a permanent resident must complete Form 12-302, the Texas Hotel Occupancy Tax Exemption Certificate, and present proof of exempt status. Operators should keep every certificate on file. That is your documentation in an audit.3Texas Comptroller of Public Accounts. Hotel Occupancy Tax Exemptions

Registering and Filing as an Operator

Every sole proprietorship, partnership, or corporation that owns, operates, manages, or controls a hotel or motel in Harris County must register with the Harris County Tax Office and file quarterly reports. The authority is Texas Tax Code Chapter 352 for the county tax and Chapter 334 for the sports venue tax.5Harris County Tax Office. Hotel/Motel Occupancy Tax

Each quarterly report asks for:

  • Federal Employer Identification Number or Social Security Number
  • Physical address of the property
  • Gross room receipts for the quarter
  • Exempt receipts (permanent residents, qualifying government travelers, qualifying nonprofits)
  • Net taxable amount, which is gross minus exempt, multiplied by the applicable rate

Quarterly Deadlines and How to Pay

Reports and payments are due by the last day of the month following each quarter:

  • First quarter (January–March): due April 30
  • Second quarter (April–June): due July 31
  • Third quarter (July–September): due October 31
  • Fourth quarter (October–December): due January 31

Both the report and the payment must arrive by the deadline. Filing on time without paying, or paying without filing, does not satisfy the requirement.5Harris County Tax Office. Hotel/Motel Occupancy Tax

Online

The county’s online portal lets you file and pay in one session. After you enter receipts and exemptions, the portal calculates the total, routes you to a payment method, submits directly to the bank, and returns a confirmation receipt with a reference number.6Harris County Tax Office. What Happens If You File Late

Missing a quarterly deadline triggers penalties and potential interest. Texas law authorizes counties to impose financial penalties on delinquent hotel tax filings, and the Harris County Tax Office enforces them on overdue accounts. The county auditor periodically reviews hotel tax collections, so operators who fall behind are likely to be flagged.7Harris County Auditor’s Office. Short-Term Rental Hosts and Platform Collection

Short-term rental hosts carry the same obligations as traditional hotels. If you list a room, guesthouse, or whole property and guests stay fewer than 30 consecutive days, you owe the county tax on that revenue.

Airbnb and some other platforms automatically collect and remit certain hotel occupancy taxes on behalf of hosts, but coverage varies by jurisdiction. In some places a platform collects only state or regional taxes and leaves local county taxes to the host. Airbnb’s own guidance warns that hosts “may need to manually collect and remit other applicable taxes” not covered by the platform’s automated system.8Airbnb Help Center. How Tax Collection and Remittance by Airbnb Works Confirm directly with the Harris County Tax Office whether the platform is collecting the county HOT and sports venue tax for your listings. If it is not, you need to register and file quarterly the same as any hotel operator.

Buying a Hotel or Short-Term Rental Business

Buying an existing lodging business in Harris County can mean inheriting the seller’s unpaid hotel occupancy tax. Under Texas Tax Code Section 111.020, a buyer must withhold enough of the purchase price to cover outstanding taxes unless the seller produces a Comptroller receipt showing taxes paid, or the buyer obtains a Certificate of No Tax Due before closing. Without the certificate, the buyer becomes personally liable for the seller’s unpaid tax, up to the full purchase price.9Texas Comptroller of Public Accounts. Buying an Existing Business Requesting the certificate before signing is free and quick.

What the County Can Spend the Revenue On

This money is not general-purpose. State law restricts Harris County to spending hotel occupancy tax revenue on activities that directly promote tourism and the convention and hotel industry, including public facilities such as civic centers, auditoriums, exhibition halls, coliseums, and stadiums; convention support like registration facilities and materials for delegates; and tourism advertising and promotion. Administrative overhead is only allowable to the extent it is tied to these authorized activities.10State of Texas.
