Herkimer County Property Tax: Rates, Exemptions, and Appeals

Herkimer County property tax bills combine county, town, school, and special district levies into amounts based on your property’s assessed value, with town and county taxes due by January 31 and school taxes typically due in the fall. Exemption applications go to your local assessor by March 1, and unpaid balances accrue interest of at least 12% per year before the county can begin foreclosure after two years of delinquency.

How Your Bill Is Calculated

Your local town or city assessor sets an assessed value for every parcel. To find the tax owed for any one levy on your bill, divide the assessed value by 1,000 and multiply by the rate per thousand.1New York State Department of Taxation and Finance. How Property Taxes Are Calculated A property assessed at $80,000 in a jurisdiction with a combined rate of $25 per thousand owes $2,000.

A single bill usually layers several levies. The county portion funds sheriff’s patrols, highway maintenance, and social services. Town taxes cover municipal roads, administration, and local parks. Special district charges for fire protection, water, sewer, or street lighting apply based on where your parcel sits. School taxes come on a separate bill later in the year. Each jurisdiction sets its own levy, so a rate change in one layer does not move the others.

The assessment roll ties it all together. Assessors estimate market value for every parcel, and that valuation decides how the total levy is split among owners.2New York State Department of Taxation and Finance. Assessments

When Payments Are Due and Where They Go

Herkimer County property taxes follow two billing cycles. Town and county bills go out at the start of January with a penalty-free window that typically runs through January 31. School district bills are generally mailed in early September.3New York State Department of Taxation and Finance. Property Tax Calendar School deadlines vary by district, so read the exact date printed on each bill.

During the January collection period, pay your local town tax collector, not the county. Every town has its own Receiver of Taxes or Tax Collector, and contact information is listed through the Herkimer County Real Property Tax Service.4Herkimer County, NY. Real Property Tax Service Once the local collection window ends, unpaid balances are turned over to the Herkimer County Treasurer’s Office at 109 Mary Street, 2nd Floor, in Herkimer.

Accepted payment methods vary. Some collectors take only cash and checks; the Town of Herkimer, for example, is cash or check only. Make checks payable to the collector named on your bill, and write your Section-Block-Lot (SBL) number on every payment. That SBL is your parcel’s unique identifier on the county tax map and appears on your bill.

If a mortgage escrow pays your taxes, the lender handles the money, but the assessment and exemption deadlines are still yours to meet.

Exemptions That Lower Your Bill

Several New York exemption programs are available to Herkimer County property owners. Every one of them must be applied for through your local assessor by the March 1 Taxable Status Date. Miss that date and you lose the benefit for the entire upcoming cycle.

STAR (School Tax Relief)

STAR reduces school property taxes on an owner-occupied primary residence. Basic STAR is open to eligible homeowners regardless of age or income. Enhanced STAR gives a larger reduction to homeowners age 65 or older with income of $110,750 or less.7New York State Department of Taxation and Finance. STAR Eligibility

A key split catches new buyers off guard. If you purchased your home after 2015, you cannot receive STAR as an exemption on your bill. You must register with the New York State Tax Department for the STAR credit, which arrives as a check or direct deposit. Homeowners who were already receiving the exemption at the same property before 2015 can keep it. Enhanced STAR applicants file Form RP-425-E with the local assessor.8New York State Department of Taxation and Finance. You May Be Eligible for an Enhanced STAR Exemption

Veterans Exemption

Under Real Property Tax Law 458-a, veterans who served during a recognized period of war can receive a partial exemption on a primary residence. Three tiers stack:9New York State Senate. New York Real Property Tax Law 458-A – Veterans Alternative Exemption

  • Wartime service: 15% of assessed value, up to a $12,000 maximum (adjusted by the equalization rate).
  • Combat zone service: an additional 10% of assessed value, up to an additional $8,000 maximum, for veterans with a qualifying campaign ribbon, service medal, or expeditionary medal.
  • Service-connected disability: an additional exemption equal to half the disability rating multiplied by assessed value, up to an additional $40,000 maximum.

The local municipality must have adopted the exemption. Applicants provide a DD-214 and any VA disability documentation to the assessor.

Senior Citizen Exemption

Homeowners 65 and older with limited income may qualify for an additional exemption under RPTL 467, separate from Enhanced STAR. The top-end benefit is 50% of assessed value for the lowest-income applicants, sliding down as income rises.10New York State Senate. New York Real Property Tax Law 467 – Persons Sixty-Five Years of Age or Over Each municipality sets its income ceiling anywhere within the statutory $3,000 to $50,000 range, and some that adopt the optional enhanced schedule allow up to 65% at the lowest income levels. Call your assessor for the thresholds adopted locally.

Disability Exemption

Owners with disabilities and limited income may qualify for an exemption under RPTL 459-c regardless of age. The local municipality sets the income ceiling within the same $3,000 to $50,000 statutory range, with a maximum benefit of 50% of assessed value on a sliding scale.11New York State Senate. New York Real Property Tax Law 459-C – Persons With Disabilities and Limited Incomes Proof of disability and annual income go to the assessor.

Agricultural Assessment

Farmland may be valued on its agricultural use rather than full market value. Eligibility generally requires at least seven acres used for crop or livestock production, with gross sales averaging $10,000 or more over the preceding two years. Operations on fewer than seven acres can still qualify with average gross sales of $50,000 or more.12New York State Department of Agriculture and Markets. Agricultural Assessment Program Overview Rented farmland may qualify under a written lease of at least five years when farmed alongside other eligible land.

Challenging an Assessment You Think Is Too High

Start informally with the assessor before Grievance Day. Bring comparable sales or evidence of conditions that reduce value. If that goes nowhere, file Form RP-524 with the Board of Assessment Review.

Your RP-524 must reach the assessor or the Board no later than the day the Board meets, which is the fourth Tuesday in May for most Herkimer County towns.6New York State Department of Taxation and Finance. General Information and Instructions for Filing Complaints on Real Property Assessments Filing fewer than four business days before the meeting lets the assessor request an automatic adjournment, so file early. Be specific about the reduction you want, because you generally will not get a larger reduction than the one requested on the form. You can appear in person or send an authorized representative.

If the Board denies the grievance, owner-occupants of one-, two-, or three-family residences can file a Small Claims Assessment Review (SCAR) petition within 30 days of the final roll being filed. The fee is $30, and the grievance step is a prerequisite.13New York State Senate. New York Real Property Tax Law 730 SCAR is simpler and cheaper than a full Article 7 court proceeding. Properties with an equalized value above $450,000 face added limits on the reduction SCAR can grant.

What Happens If You Do Not Pay

Enforcement in Herkimer County is predictable and expensive. Once the penalty-free collection period ends, interest accrues at a minimum of 1% per month on the unpaid balance. The exact rate is set annually by the state Commissioner of Taxation and Finance, with a statutory floor of 12% per year.14New York State Senate. New York Real Property Tax Law 924-A – Interest Rate on Late Payment of Taxes and Delinquencies

Unpaid school taxes turned over to the county treasurer pick up a 5% charge on top of accrued interest. If those taxes are then relevied onto the next year’s county and town bill, a 7% charge is added. One missed year can grow by 20% or more before the next cycle.

After two years of delinquency, the county can begin in rem tax foreclosure under Article 11 of the Real Property Tax Law.15New York State Senate. New York Real Property Tax Law 1110 – Redemption Notice is mailed to the owner and published in a local newspaper. During the redemption period, paying the full balance with all interest, penalties, and fees stops the process. If you do not redeem before the deadline, the county can take title by court judgment and sell the property at public auction. Once the redemption period expires, the loss is final regardless of equity in the property.

The State Credit on Form IT-214

Separate from local exemptions, New York offers a real property tax credit claimed on Form IT-214 with your state income tax return. Both homeowners and renters can qualify, but the income bar is tight: federal adjusted gross income of $18,000 or less, at least six months of the year lived in the same New York residence, and a property that is not fully exempt from property taxes.16New York State Department of Taxation and Finance. Real Property Tax Credit

The amount is $75 if all household members are under 65, or $375 if anyone in the household is 65 or older. For homeowners, the property must be valued at $85,000 or less. The credit is refundable, so eligible filers receive it even owing no state income tax. Many who qualify never claim it.
