Herndon Meals Tax: Rate, Filing, Discount, and Penalties

The Herndon meals tax is a 4.5% local tax on prepared food and beverages sold within town limits, collected by the seller at the point of sale and remitted to the town each month. The rate took effect on July 1, 2025, and sits on top of Virginia’s state sales tax, so a restaurant check in Herndon carries a noticeably higher tax total than a grocery receipt.1Town of Herndon, VA. What the 4.5% Applies To

The tax is calculated on the total price charged for any meal sold or delivered within the Town of Herndon.1Town of Herndon, VA. Meals Tax A “meal” means prepared food intended for immediate consumption, whether eaten on-site, taken out, or delivered. Sandwiches, hot entrees, salad-bar items, single-serving prepackaged salads, and beverages that are not factory-sealed all count. Catered events are taxed at the same rate when the sale happens inside town limits.2Virginia Code Commission. Code of Virginia Article 7.1 – Food and Beverage Tax

Alcoholic drinks served by the glass are part of the taxable total. Factory-sealed alcohol sold for off-premises consumption is not.1Town of Herndon, VA. Meals Tax

Tips sit in a specific zone. Voluntary gratuities are excluded entirely. Mandatory service charges are excluded up to 20% of the sale price; anything a seller imposes above that 20% ceiling becomes taxable.2Virginia Code Commission. Code of Virginia Article 7.1 – Food and Beverage Tax

Sales That Are Exempt

Herndon’s exemption list is broader than many sellers assume. The following are not subject to the meals tax:1Town of Herndon, VA. Meals Tax

  • Unprepared grocery items that qualify under the federal food-stamp definition, such as raw produce, flour, and uncooked meat.
  • Factory-prepackaged candy, gum, and nuts sold in their original packaging, on- or off-premises.
  • Donuts, cookies, chips, ice cream, whole cakes, and factory-sealed beverages sold exclusively for off-premises consumption.
  • Food and drinks dispensed through vending machines.
  • Meals purchased by the Commonwealth of Virginia, its political subdivisions, or the U.S. government.
  • Food served by hospitals, clinics, nursing homes, and extended-care facilities to their patients or residents.
  • Food sold by nonprofit groups or churches for fundraising purposes, with proceeds going to nonprofit use.

Where the exemption gets fuzzy is the border between prepared and unprepared food. The federal food-stamp definition is the dividing line, with specific carve-outs: sandwiches, salad-bar items, and non-factory-sealed drinks are always taxable regardless of where they’re consumed.2Virginia Code Commission. Registering and Filing Monthly Returns

Before collecting any meals tax, a business must register with Herndon’s Revenue Department. The Meals Tax Form goes to revenue@herndon-va.gov, and the town returns a confirmation email with payment details.1Town of Herndon, VA. Meals Tax

Each month, you report the prior month’s taxable sales, calculate the 4.5%, and remit. Filing works three ways: by email to revenue@herndon-va.gov by 4:30 PM on the due date with payment through the town’s online portal; by mail to the Herndon Municipal Center with a check payable to Town of Herndon; or by in-person drop-off at the Municipal Center, including a drop box at the front entrance after hours.1Town of Herndon, VA. One rule catches new owners: a return is required every month, even when taxable sales were zero. The town needs a $0 return on file to keep the account current.1Town of Herndon, VA. Meals Tax

The 20th of the Month and the 6% Discount

Returns and payments are due by the 20th of the month following the reporting period. Taxes collected in March are due by April 20th. When the 20th lands on a weekend, the deadline shifts to the next business day.1Town of Herndon, VA. Meals Tax

File on time and the town lets you keep 6% of the tax collected as a seller’s discount. Collect $900 in a month, remit $846, keep $54. The discount disappears entirely if the form and payment arrive even a day late.1Town of Herndon, VA. Meals Tax Over twelve months, that discount is real money, and treating the 20th as a hard deadline is the only way to keep it.

What a Late Filing Costs

Missing the 20th does two things at once. You lose the 6% discount, and the town adds a flat 10% penalty on the tax owed.1Town of Herndon, VA. Meals Tax

If the balance is still unpaid by the 30th of the month, interest kicks in at 10% per year, running from the original due date until you pay in full.1Town of Herndon, VA. Meals Tax A business that collected $2,000 and let the deadline slide absorbs the lost discount, the 10% penalty, and compounding interest together.

Personal Liability for Collected Tax

The money you collect from customers is not revenue. Virginia law treats meals tax collections as funds held in trust for the town, and spending them on anything other than the tax bill is embezzlement under state law.2Virginia Code Commission. Code of Virginia Article 7.1 – Food and Beverage Tax

Herndon pushes the exposure one step further. Managers and other responsible parties at a food establishment can be held personally liable for delinquent meals taxes, which means the town can pursue the individual, not just the business entity.1Town of Herndon, VA. Meals Tax When a restaurant closes with an unpaid balance, the owner or manager who handled the money still owes it. Keeping collected meals tax in a separate account, apart from operating cash, is the cleanest way to make sure the full amount is there on the 20th.
