Highest Workers’ Comp Settlement in California: Pineda’s $13.17M

The highest workers’ compensation settlement in California is $13,169,185.51, secured on April 6, 2022, for Rafael Pineda, an iron worker who suffered severe head and spinal injuries on his way to a job with Casey Industrial. The settlement was structured as a lifetime annuity paying $40,634.93 per month, tax-free, with a projected total payout of $25,857,926.55 over Pineda’s life.1HRO LLP. How the Pineda Record Was Set

Rafael Pineda was riding a motorcycle to his iron worker job at Casey Industrial when he was struck by a car. He sustained severe head trauma and spinal cord injuries. The workers’ compensation insurer initially denied the claim under the Going and Coming Rule, a longstanding doctrine that bars benefits for injuries sustained during an ordinary commute.1HRO LLP. Attorney Michael Ian Rott took the case and researched the exceptions to that rule. He won at trial, then held the win on a post-trial appeal. With liability established, the parties settled on April 6, 2022, for $13,169,185.51. Rather than take a lump sum, Pineda’s settlement was structured as an annuity: $40,634.93 every month, tax-free, for the rest of his life. The projected lifetime payout is $25,857,926.55.1HRO LLP. The structure matters as much as the headline number. Payments from a workers’ comp structured settlement are income-tax-free under IRS Code Section 104(a).4Roy Yang Law. Workers Comp Settlements A lifetime annuity also removes the risk that a catastrophically injured person outlives a lump sum, and it lets the insurer fund the deal through a life insurance company at a present-day cost well below the projected payout.5US Law. The Previous Record: $11.3 Million for an Injured Nanny

Before Pineda, the top reported figure belonged to a 29-year-old nanny catastrophically injured on February 25, 2018, while traveling with her employer’s family on a ski trip to Colorado. She was a passenger in her employer’s Kia Sportage when it was struck by a Roaring Fork Transportation Authority bus after the employer reportedly ran a stop sign, possibly while on a cell phone, according to a Colorado State Patrol report.6Rose Klein and Marias LLP. The nanny suffered a catastrophic traumatic brain injury. She uses a wheelchair and requires round-the-clock care for the rest of her life. The insurer initially denied liability, arguing the injury did not arise in the course of employment, then conceded the point. In 2021, attorney Harry Samarghachian of Rose, Klein and Marias LLP settled the claim for $11.3 million. The insurer also agreed to pay all past medical care to date.2Insurance Business. Other Reported Multi-Million-Dollar Settlements

A handful of other California workers’ comp cases have crossed into the millions. All involve permanent, life-altering injuries.

What the Record Settlements Have in Common

The eight-figure cases don’t look like typical workers’ comp claims, and they don’t resolve like them either. Four features show up again and again.

Catastrophic, lifetime-care injuries. Severe brain trauma, spinal cord damage, paralysis, quadriplegia. Pineda had head and spine injuries. The nanny needs 24-hour care in a wheelchair. The Pacific Workers client is a quadriplegic. The Enriquez case involved a traumatic brain injury with psychiatric sequelae. These injuries drive both the permanent disability rating and the projected cost of future medical care, which is what pushes a Compromise and Release settlement into the millions.3Law Firm of Melinda J. Helbock, A.P.C. California Workers Comp Settlement Chart

Contested liability or denied claims. Pineda was denied under the Going and Coming Rule. The nanny’s insurer initially denied the injury arose from employment. The Pacific Workers case took five years. These settlements don’t exist without someone willing to fight through a denial. The Going and Coming Rule in particular turns on fact-intensive exceptions — whether the employer benefited from the travel, provided the vehicle, or sent the worker on a special mission — and the Pineda victory at trial and on appeal is what unlocked the record payout.1HRO LLP. Aggressive use of rating doctrines. Permanent disability drives value, and the standard AMA Guides rating is not always the final word. Under the 2009 en banc Almaraz/Guzman decision, a physician can rebut the standard impairment number by using an alternative chapter, table, or method within the AMA Guides, as long as detailed medical reasoning supports it.10California WCAB. Almaraz v. Environmental Recovery Services / Guzman v. Milpitas Unified School District RAND found that alternative Almaraz/Guzman ratings run 9.7 to 13.5 impairment points higher than standard ratings and appear in about 20% of disability cases.11RAND Corporation. Effects of the 2012 California Workers Compensation Reforms on Benefits Every added point is more weeks of compensation.

Structured settlements, not lump sums. Pineda’s record is annuitized. Enriquez’s was structured. Lifetime annuities let the deal cover decades of care without the risk a lump sum runs dry, and they stay tax-free under Section 104(a).4Roy Yang Law. Workers Comp Settlements They also make the economics workable for insurers: in a study of 427 claims, lump-sum exposure of $50.6 million was funded through structured settlements for $31.8 million, a 37% savings.5US Law. One more thread runs through several of the biggest cases: a third party caused the injury. A car driver hit Pineda. A bus struck the nanny’s vehicle. When someone outside the employment relationship is at fault, California Labor Code Sections 3852–3856 let the worker pursue a personal injury lawsuit in parallel with the comp claim, recovering damages like pain and suffering that workers’ comp cannot provide.12PI Law. How Far These Numbers Are From Normal

Record settlements get attention precisely because they’re nothing like what most injured workers receive. The median California workers’ comp settlement is roughly $21,800. About 55% of workers receive between $2,000 and $20,000. Only around 8% receive between $60,000 and $100,000. The national average cost per workers’ comp claim, per 2021–2022 National Safety Council data, is $44,179.3Law Firm of Melinda J. Helbock, A.P.C. California Workers Comp Settlement Chart

Averages shift by body part. Head and brain injuries and spine or back injuries carry the highest averages, around $91,844, with the most severe cases running well above $500,000. Neck and cervical injuries average about $65,000, hip and pelvis around $60,000, and shoulder injuries about $55,000. Cause matters too: motor vehicle crashes produce the highest average at $90,914, followed by burns at $63,119 and falls at $51,047.3Law Firm of Melinda J. Helbock, A.P.C. Even those averages are shaped by statutory ceilings. For 2026, the California Division of Workers’ Compensation set the minimum temporary total disability rate at $264.61 per week and the maximum at $1,764.11 per week, based on a state average weekly wage of $1,789.14California Department of Industrial Relations. Why Eight-Figure Workers’ Comp Settlements Stay Rare

California’s workers’ comp system is built for predictability, not for the kind of large verdicts that happen in civil litigation. Weekly disability rates are set by statute. The permanent disability rating formula, which combines a physician’s AMA Guides impairment number with adjustments for age, occupation, and job demands, limits what any single injury can be worth on paper.16California Department of Industrial Relations. Schedule for Rating Permanent Disabilities And because the system is no-fault, there are no pain-and-suffering damages the way there would be in a personal injury case.

The settlements that break through those limits are the ones where future medical care dominates the number. In a Compromise and Release, the insurer buys out all future medical obligations in a single lump payment, which closes the case for good once a workers’ compensation judge approves it.17California Department of Industrial Relations. How Your Workers Compensation Case Is Resolved When that future care means decades of 24-hour nursing, surgeries, equipment, and medication, the buyout alone can run into the millions. Add a disputed liability fight that produces leverage, an Almaraz/Guzman rating that lifts the disability number, and a structured annuity that stretches the payment over a lifetime, and you have the recipe behind the Pineda record. Take any of those pieces away and the number collapses toward the range most injured workers see.
