Hillsborough County Traffic Ticket: Fines, Options, and Deadlines

If you received a Hillsborough County traffic ticket, you have 30 days from the date on the citation to respond, and you have three choices: pay the fine and accept the conviction, elect traffic school to keep points off your record, or request a court hearing to contest it.1Florida Court Clerks & Comptrollers. How Do I Pay A Traffic Ticket? The Hillsborough County Clerk of Court processes every response.2Hillsclerk. Traffic Department Each option carries different consequences for your license, your insurance, and your bank account, and letting the deadline pass is the worst of them all.

Paying the Fine

Paying is the fastest way to close the case, but under Florida law it counts as admitting the infraction and waiving your right to a hearing.3Florida Senate. Florida Statutes 318.14 – Noncriminal Traffic Infractions; Exception; Procedures The admission goes on your driving record as a conviction, and the Florida Department of Highway Safety and Motor Vehicles assesses points.

Most speeding violations add 3 points. Speeding more than 50 mph over the limit adds 4. Insurance companies see those points, and a single speeding conviction can raise premiums by roughly 25 percent. The suspension thresholds compound the risk: 12 points in 12 months suspends your license for 30 days, 18 points in 18 months for three months, and 24 points in 36 months for a full year.4Florida Department of Highway Safety and Motor Vehicles. Electing Traffic School

Electing a basic driver improvement course is usually the smartest move. Under Florida Statute 318.14(9), the court withholds adjudication when you make this election, so no conviction appears on your record, no points attach, and the civil penalty is reduced by 18 percent.5Florida Legislature. Florida Statutes 318.14 – Noncriminal Traffic Infractions; Exception; Procedures You pay the reduced amount to the Clerk when you file the election.

Eligibility has firm limits. You can elect traffic school only once every 12 months and no more than eight times in your lifetime.5Florida Legislature. Florida Statutes 318.14 – Noncriminal Traffic Infractions; Exception; Procedures It is not available if you were clocked 30 or more mph over the limit, and it is not available at all to commercial driver’s license holders. Verify your election history through the FLHSMV website before you file. If the Clerk accepts an election you weren’t actually eligible for, the points still land on your record and your license can be suspended.6Florida Department of Highway Safety and Motor Vehicles. Once the election and payment are processed, you typically have 60 additional days to complete the course at any state-approved school in Florida.1Florida Court Clerks & Comptrollers. How Do I Pay A Traffic Ticket? Missing that completion deadline triggers late fees and possible license suspension.

Requesting a Court Hearing

A hearing is the only path to a full dismissal, and it is the only path with real downside risk. Requesting one gives up both the standard fine amount and the ability to elect traffic school.7Hillsborough County Clerk of Court & Comptroller. Request Court Hearing If the judge rules against you, your total cost can exceed what you would have paid by handling the ticket any other way.

The issuing officer must appear and testify. You can cross-examine the officer and present your own evidence: photographs, witnesses, GPS data. If the officer fails to appear, many judges dismiss the case, though that outcome is never guaranteed. Common grounds for contesting include errors on the citation (wrong vehicle, wrong statute, wrong location), radar or laser calibration problems, and obstructed or missing signage.

To request a hearing, use the Clerk’s online portal or mark the hearing option on the citation and mail it in before the 30 days run out. The Clerk schedules a date and mails you the notice.

What the Fine Actually Costs

Florida Statute 318.18 sets base fines by how far over the limit you were driving:8Florida Legislature. Florida Statutes 318.18 – Amount of Penalties

  • 1–5 mph over: warning, no fine
  • 6–9 mph over: $25
  • 10–14 mph over: $100
  • 15–19 mph over: $150
  • 20–29 mph over: $175
  • 30+ mph over: $250

Those are statutory base amounts. Your real ticket total is significantly higher once court costs, state surcharges, and county fees are added. A ticket for 10–14 mph over frequently totals $250 or more. The Clerk warns that the amount printed on the face of the citation may not match what you actually owe, so verify the total through the Clerk’s online lookup or by calling 813-276-8100 before you pay.9Hillsclerk. Speeding in a school zone doubles the base fine, and 1–5 mph over in a school zone carries a $50 base fine instead of a warning.10Florida Senate. Florida Statutes 318.18 – Amount of Penalties Speeding in a posted construction zone also doubles the fine, but only when workers are actually present or equipment is operating on or immediately adjacent to the roadway.8Florida Legislature. Three methods. Have your citation number and Florida driver’s license ready for any of them.

Appointments can be scheduled through the Clerk’s website.12Hillsclerk. Service Options and Locations

What Happens If You Miss the 30-Day Deadline

Ignoring the ticket is the most expensive thing you can do. When the 30 days pass without a response, the Clerk assesses a delinquency fee and mails you notice that your license will be suspended unless you comply within another 30 days.13Florida Legislature. Florida Statutes 322.245 – Suspension of License Upon Failure to Comply If you still don’t act, the Clerk notifies FLHSMV electronically, which issues a suspension order effective 20 days after it’s mailed.

Driving on a suspended license in Florida is a separate criminal offense that can carry jail time. The suspension also kills the traffic school option on the original ticket. Reinstatement means paying the original fine, the delinquency fee, and a reinstatement fee to FLHSMV. If paying the full amount isn’t possible, the statute allows you to ask the Clerk about a payment plan, and the suspension notice is required to include that information.13Florida Legislature. Florida Statutes 322.245 – Suspension of License Upon Failure to Comply Missing three payments on a plan can send the balance to a collection agency, which may add fees of up to 40 percent of what you owe.

Tickets for Insurance, Registration, or License Issues

Citations for driving without valid insurance, with expired registration, or on a license suspended for non-moving reasons (such as unpaid child support) are handled differently. Florida law allows a nolo contendere plea with proof of compliance: you show the Clerk you’ve fixed the problem — current insurance, renewed registration, cleared suspension — and the court withholds adjudication.3Florida Senate. Florida Statutes 318.14 – Noncriminal Traffic Infractions; Exception; Procedures

This option has a stricter cap than traffic school: three times total in your lifetime, and no more than once every 12 months.3Florida Senate. Florida Statutes 318.14 – Noncriminal Traffic Infractions; Exception; Procedures If you received a compliance ticket alongside a moving violation on the same stop, each one requires its own election.

Commercial Driver’s License Holders

If you hold a CDL, traffic school is not available to you at all. Florida Statute 318.14(9) explicitly excludes CDL and commercial learner’s permit holders from the basic driver improvement election, even if you were driving your personal car when you got the ticket.5Florida Legislature. Florida Statutes 318.14 – Noncriminal Traffic Infractions; Exception; Procedures Federal regulations prohibit any state from masking, deferring, or diverting a conviction so it stays off a CDL holder’s record.14eCFR. 49 CFR 384.226 – Prohibition on Masking Convictions

Two serious traffic violation convictions within three years triggers a minimum 60-day CDL disqualification. A third within that window extends it to at least 120 days.15eCFR. 49 CFR Part 384 – State Compliance With Commercial Drivers License Requirements Serious violations include speeding 15 or more mph over the limit, reckless driving, improper lane changes, and following too closely. For a CDL holder, contesting the ticket is often the only option worth considering.

Out-of-State Drivers

Driving home to another state does not make the ticket go away. Florida belongs to the Nonresident Violator Compact, with 44 member jurisdictions. If you fail to respond, the Hillsborough Clerk reports that failure to your home state’s motor vehicle agency, which then starts its own suspension process as if you’d ignored a ticket at home.16AAMVA. Nonresident Violator Compact Procedures Manual

Florida also belongs to the Driver License Compact, which means a moving violation conviction here gets reported to your home state and treated as though you committed it there.17Ballotpedia.
