An HOV violation in Virginia costs $100 as a flat fine anywhere outside Northern Virginia, and $125 to $1,000 inside Planning District 8 depending on how many prior offenses you have within a five-year window. Repeat offenses in Northern Virginia also carry three demerit points each. The infraction is civil, not criminal, but the escalating structure makes it one of the more expensive non-moving tickets in the state.
What the Fine Will Be
Virginia splits HOV penalties in two based on where the violation happened. Planning District 8 covers Arlington, Fairfax County, Loudoun County, Prince William County, and the cities of Alexandria, Fairfax, Manassas, and Manassas Park. That is where most of the state’s HOV enforcement actually occurs, and where the fines climb.
Outside Planning District 8

Inside Planning District 8
Northern Virginia fines step up with each repeat offense in a rolling five-year period measured from the first offense:
- First offense: $125
- Second offense: $250
- Third offense: $500

The five-year clock matters. If your first offense was more than five years ago, a new violation resets to the first-offense level.
One other fine sits outside this schedule: setting your E-ZPass Flex to HOV mode on an Express Lanes corridor without actually carrying enough passengers can draw a fine up to $1,000 on its own.2Virginia Department of Transportation. HOV Lanes
Demerit Points on Your Record
A first HOV violation carries no demerit points anywhere in Virginia. Second, third, fourth, and subsequent offenses committed inside Planning District 8 within a five-year window each add three demerit points to your driving record.1Virginia Code Commission. That distinction catches people off guard. HOV violations elsewhere in the state, and first offenses everywhere, stay off the point system entirely. Points from Northern Virginia repeats can add up alongside any other moving violations you already have, and at higher totals the DMV may send an advisory letter or require a driver improvement clinic.
The violation itself is a traffic infraction, not a criminal offense, so it does not go on a criminal record. Insurance carriers can still see your driving record, and while one HOV ticket rarely moves premiums, a pattern of them with points attached can signal risk to an underwriter.
What Actually Counts as a Violation
The straightforward version is driving with fewer occupants than the posted minimum during enforcement hours. Most Northern Virginia Express Lanes require three or more people (HOV-3). Every person counts, including infants and children in car seats. A parent driving with two kids meets HOV-3.
On the Express Lanes — I-95, I-395, I-495, I-66, and the 64 Express Lanes — meeting the occupancy count is not enough on its own. Every carpool must also have an E-ZPass Flex transponder switched to HOV mode. Without it, the system charges the posted toll regardless of how many people are in the car.2Virginia Department of Transportation. HOV Lanes A missed toll is not the same as an HOV citation, but on those corridors the two problems tend to overlap.
A few vehicles are exempt from occupancy rules entirely: motorcycles, emergency vehicles, law enforcement, transit and commuter buses designed for 16 or more passengers, public utility vehicles on emergency calls, taxicabs with at least two occupants including the driver, and active duty military in uniform on I-264 and I-64 in Hampton Roads.1Virginia Code Commission. Clean special fuel plates from the Virginia DMV also exempt a vehicle from occupancy requirements, but only on I-64, I-264, I-564, the Dulles Toll Road, and City of Alexandria HOV lanes. The exemption does not apply on any Express Lanes corridor.3Virginia Department of Motor Vehicles. Using mannequins or dummies to fake passengers gets you the standard HOV violation. It does not save anything.
Fighting the Ticket
You have two options once you receive the citation. If the offense is in Virginia’s uniform fine schedule, you can pay the fine before the court date, which counts as a guilty plea and waives your right to a hearing.4Virginia Code Commission. At the hearing, the citing officer presents what they observed, which on Express Lanes corridors may include dashcam footage or automated camera images. You can cross-examine the officer, call your own witnesses, and submit evidence — photos showing your E-ZPass Flex was set correctly, or that passengers were in the vehicle but not visible from outside. Common defenses include arguing the officer miscounted (children in rear-facing car seats are still occupants), that the violation happened outside posted enforcement hours, or that signage was unclear or missing.
If You Don’t Live in Virginia
Virginia participates in the Driver License Compact and reports traffic convictions of out-of-state drivers to their home state’s licensing authority. The report identifies the driver, describes the violation, and notes the court outcome.5Virginia Code Commission. Some ignore minor non-moving infractions, others record them and assess their own points.
Ignoring the ticket because you live somewhere else is a poor plan. Unpaid Virginia fines can lead to registration holds or warrants that surface the next time you cross the state line.
Why Violations Happen by Accident
Most HOV tickets come from confusion rather than deliberate cheating. A few things worth checking:
- Confirm your E-ZPass Flex is switched to HOV mode before you enter an Express Lanes corridor. Forgetting to flip it is the most common way carpoolers end up paying a toll they thought they had earned out of.
- Know which corridor you’re on. Occupancy thresholds, enforcement hours, and the clean fuel plate exemption all change from one road to another.

- Remember every occupant counts. If an officer pulls you over and cannot see a small child from outside, point them out.
