You can break a lease without penalty in Colorado if your situation falls into one of a handful of legally protected categories: the unit is uninhabitable, you’re a victim of domestic violence or stalking, you’re entering active military service, a gas appliance in the unit is hazardous and goes unrepaired, or your landlord retaliates against you for exercising a tenant right. Each path has its own notice rules and timelines, and following them exactly is what separates a clean exit from months of disputed charges.
If none of those apply, you still have leverage. Colorado landlords have a duty to try to re-rent the unit, which caps what they can collect from you. And your lease itself may already contain a buy-out clause that costs less than fighting.
Uninhabitable Living Conditions
Every Colorado landlord has to keep a rental fit for human habitation from move-in through the end of the tenancy.1Justia. Colorado Code 38-12-503 – Warranty of Habitability – Notice – Landlord Obligations This is the warranty of habitability. A landlord breaches it when a condition materially interferes with your life, health, or safety.
Common conditions that qualify:
- No running water or hot water in the amounts needed for ordinary use
- Broken heating or other non-functioning essential appliances
- Mold associated with dampness that could affect your health
- Faulty plumbing, gas, or electrical systems
- Broken locks on exterior doors or windows
- Pest infestations the landlord hasn’t addressed
- Building code violations that create dangerous conditions
The statutory list is longer and covers things like waterproofing, stairway maintenance, and garbage removal.2Justia. Colorado Code 38-12-505 – Conditions That Constitute Uninhabitability
The Notice You Have to Give
You cannot just move out the day you spot a problem. Colorado requires written notice to the landlord that identifies the condition, states your intent to terminate, and sets a move-out date at least ten days after delivery. The notice window can run anywhere from ten to sixty days.3Justia. Colorado Code 38-12-507 – Breach of Warranty of Habitability – Remedies If the landlord fixes the problem during that window, the termination can be rescinded by agreement. If they don’t, you leave owing nothing further.
There’s a shorter path for repeat problems. If the same condition returns within six months of being repaired, you can terminate on ten days’ notice, provided you send that notice within thirty days of the recurrence.3Justia. Colorado Code 38-12-507 – Breach of Warranty of Habitability – Remedies
Document everything. Dated photos, copies of every written request, and any responses from the landlord form the core of your evidence if the dispute reaches court.
Domestic Violence, Sexual Assault, and Stalking
Colorado lets victims of domestic violence, domestic abuse, unlawful sexual behavior, or stalking end a lease when they fear imminent danger to themselves or their children.4Justia. Colorado Code 38-12-402 – Protection for Victims of Domestic Violence You notify the landlord in writing and attach supporting documentation.
Acceptable documentation depends on the type of victimization:
- For domestic violence, domestic abuse, or unlawful sexual behavior: a police report filed within the last sixty days, a valid protection order, or a written statement from a medical professional or application assistant confirming your status as a victim.
- For stalking: a police report filed within the last sixty days, a valid protection order, or a written statement from an application assistant. A medical professional’s statement is not accepted for stalking.4Justia. Colorado Code 38-12-402 – Protection for Victims of Domestic Violence
After you vacate, the landlord can require one month’s rent, due within ninety days. But that charge only applies if the landlord actually experienced and documented damages equal to at least one month’s rent as a result of your early termination.4Justia. Colorado Code 38-12-402 – Protection for Victims of Domestic Violence If they re-rent the unit quickly and lose nothing, the obligation may not apply. Your security deposit and the one-month rent can also be offset against each other, so you may not need to write a separate check.
Any lease clause that penalizes you for calling the police or emergency services in response to domestic violence, sexual assault, or stalking is void, and you cannot waive this protection.4Justia. Colorado Code 38-12-402 – Protection for Victims of Domestic Violence
Active Military Service
The federal Servicemembers Civil Relief Act protects military tenants who signed a lease before entering active duty, or who later receive orders for a permanent change of station or a deployment of at least ninety days. Activated reservists and National Guard members on federal active duty are covered too. You deliver written notice along with a copy of your military orders to the landlord.5Office of the Law Revision Counsel. 50 USC 3955 – Termination of Residential or Motor Vehicle Leases
The termination isn’t immediate. For a lease with monthly rent, it becomes effective thirty days after the next rent due date following delivery of your notice. Deliver notice on March 10 with rent due the first of each month, and the lease ends on May 1.5Office of the Law Revision Counsel. 50 USC 3955 – Termination of Residential or Motor Vehicle Leases You owe rent through that date and nothing beyond.
Delivery can be by hand, private carrier, certified mail with return receipt requested, or electronic means such as email to a landlord’s designated address. Use a method that creates proof of delivery.5Office of the Law Revision Counsel. 50 USC 3955 – Termination of Residential or Motor Vehicle Leases
Hazardous Gas Appliance
Colorado has a separate, faster termination path when a gas appliance creates a hazardous condition. After you give the landlord written notice of the hazard, the landlord has seventy-two hours, excluding weekends and legal holidays, to have a licensed professional complete the repair.6Justia. Colorado Code 38-12-104 – Return of Security Deposit – Hazardous Condition – Gas Appliance
If the seventy-two hours pass and the hazard remains, you can vacate and the lease becomes entirely void. The landlord must then return your security deposit and any pro-rated rent within seventy-two hours of your departure.6Justia. Colorado Code 38-12-104 – Return of Security Deposit – Hazardous Condition – Gas Appliance This is one of the cleanest termination paths in Colorado because you owe nothing and recover your money quickly.
Landlord Retaliation
If you complain about habitability problems, join a tenants’ association, or exercise any right under the warranty of habitability, your landlord cannot retaliate. Retaliation includes raising rent, decreasing services, threatening eviction, harassment, or charging a new fee or penalty.7Justia. Colorado Code 38-12-509 – Retaliation Prohibited
If retaliation happens, you can terminate the lease outright and recover damages of up to three months’ rent or three times your actual damages, whichever is greater, plus reasonable attorney fees and court costs.7Justia. Colorado Code 38-12-509 – Retaliation Prohibited You don’t have to prove retaliation was the landlord’s only motive, just that your protected activity was a motivating factor.
The paper trail does the work. If you reported a broken heater in January and a non-renewal notice shows up in February, the timeline itself is strong evidence.
Check Your Lease Before Relying on the Statute
Before invoking a statutory right, read your lease. Many Colorado leases include a buy-out or early termination clause that lets you leave by paying a set fee, often one or two months’ rent, with thirty to sixty days’ notice. When one exists, it is usually the fastest and least contentious route out.
While you’re in the lease, watch for provisions that try to strip rights Colorado law guarantees. A clause waiving your right to a habitable unit, blocking you from calling emergency services, or forcing you to give up your right to sue is void regardless of what you signed. Clauses imposing excessive late fees or penalties beyond what Colorado allows are void too. Signing a bad lease doesn’t bind you to its worst terms.
How to Give Written Notice That Holds Up
Every path above requires written notice. A text message or hallway conversation creates no reliable proof. Your notice should include your name, the rental address, the date you intend to vacate, and the specific legal reason you are terminating.
Send it by certified mail with a return receipt requested. For habitability terminations, the notice must describe the uninhabitable condition and set a move-out date at least ten days from delivery.3Justia. Colorado Code 38-12-507 – Breach of Warranty of Habitability – Remedies For an SCRA termination, include a copy of your military orders.5Office of the Law Revision Counsel. 50 USC 3955 – Termination of Residential or Motor Vehicle Leases
Keep copies of everything you send. If you hand-deliver, bring a second copy and ask the landlord to sign and date it as acknowledgment.
If None of the Protections Apply
Even without a legal protection, Colorado courts recognize that landlords have a duty to mitigate damages. Your landlord cannot leave the unit empty and bill you for the remaining months without making reasonable effort to re-rent it.8Colorado Judicial Branch. Colorado Civil Jury Instructions – Chapter 5 Damages – Section: Affirmative Defense – Failure to Mitigate Reasonable effort means advertising the vacancy, showing it, and accepting a qualified applicant. The landlord doesn’t have to drop below market rent or take an unqualified tenant, but has to treat the unit like any other vacancy. Your exposure is capped at the rent lost while the unit sits empty, and ends when a replacement moves in.
If your landlord makes no effort to re-list and then sues for months of unpaid rent, mitigation is your main defense. Screenshots of the landlord’s listings — or the absence of them — can carry a case.
Three practical alternatives often beat walking away:
- Negotiate a mutual termination. Many landlords would rather settle than litigate. Offer to help find a replacement, cover the re-listing cost, or forfeit part of your deposit. Get any agreement in writing.
- Sublet, if your lease allows. You rent to someone else for part of the remaining term while staying on the lease. You remain liable if the subtenant doesn’t pay.
- Assign the lease. You transfer your entire remaining interest to a new tenant, who takes over directly with the landlord. Unlike a sublet, you are generally off the hook once the assignment completes.
Most Colorado leases require written landlord approval for either arrangement, and that restriction is enforceable. Check first.
If you simply break the lease, the balance typically goes to a collection agency after sixty to ninety days. The unpaid rent doesn’t hit your credit report by itself, but once the collector reports it, it can lower your score and stay on your report for up to seven years.9Equifax. Does Breaking a Lease Affect Your Credit Scores? Future landlords routinely pull credit during screening, so a collections mark can follow you into your next application.
Getting Your Security Deposit Back
Colorado landlords must return your security deposit within one month after the lease ends or you surrender the unit, whichever is later. Your lease can extend that deadline to as much as sixty days, but no longer.10Justia. Colorado Code 38-12-103 – Return of Security Deposit The deposit cannot be kept to cover normal wear and tear.
Any withholding has to come with a written statement listing the exact reasons. Miss the deadline, and the landlord forfeits the right to withhold anything. Willful retention in violation of the statute exposes the landlord to triple the wrongfully withheld amount plus attorney fees and court costs. You just have to give seven days’ written notice of your intent to sue before filing.10Justia. Colorado Code 38-12-103 – Return of Security Deposit
The hazardous gas appliance termination is the one exception to the one-month rule: the deposit must come back within seventy-two hours of your departure.6Justia. Colorado Code 38-12-104 – Return of Security Deposit – Hazardous Condition – Gas Appliance
When you hand back keys, do it in person and get a signed, dated receipt. If the landlord isn’t available, send keys by certified mail with return receipt. Disputes about when you actually vacated are common, and this one piece of paper usually settles them.
