Pick the Right Program First

The two Oklahoma Medicaid pathways look similar from the outside but behave differently, and choosing correctly at the start saves months.

Which Relatives Can Be Paid

This is where many families run into a wall. Read these rules before you plan anything else.

Under CD-PASS, several roles are barred from being the paid caregiver: spouses, legal guardians, anyone holding power of attorney for the care recipient, and authorized representatives. Spousal exceptions exist but apply only in what the program calls “the most exceptional situations.” Adult children, siblings, and other relatives can generally be hired if they pass a background check and meet the other qualifications. Under SPPC, the rules are broader. Getting Your Family Member Qualified

Both programs require the care recipient to meet medical and financial criteria, and those criteria differ.

ADvantage Waiver

Your relative must need a nursing facility level of care. The Five-Year Look-Back

Medicaid reviews asset transfers made during the 60 months before the application. Money or property given away in that window can trigger a penalty period that delays coverage. Applying and Enrolling

Background Check and Training

Every prospective caregiver has to pass a fingerprint-based criminal background check. Taxes on Your Wages

Being paid to care for a relative creates a real employment relationship. Your family member (or the program’s fiscal management agent handling their payroll) is a household employer, and you are a household employee.

If you earn $3,000 or more in cash wages during 2026, both sides owe Social Security tax at 6.2% and Medicare tax at 1.45% on those wages. Under $3,000 for the year, neither side owes these taxes. The Difficulty-of-Care Exclusion

IRS Notice 2014-7 offers a significant benefit: if the person you care for lives in your home, the Medicaid waiver payments you receive may be fully excludable from your gross income as “difficulty of care” payments, whether or not you’re related.13Internal Revenue Service.
