Traffic school eligibility in Tennessee comes down to four things: the class of license you hold, the vehicle you were driving, the violation on your ticket, and whether the judge in the county where you were cited agrees to let you do it. Under Tennessee Code 55-10-301, a court may allow you to complete a driver education course in place of the normal penalty for a moving violation, but the decision is discretionary and the rules vary by county.1Justia. Tennessee Code 55-10-301 – Penalty for Violations of Chapters 8 and 9 and Parts 1-5 of This Chapter When a court grants the option and you finish the course on time, the violation is dismissed and stays off your state driving record.
License and Vehicle: The Automatic Disqualifiers
If you hold a commercial driver’s license (Class A, B, or C), you cannot use traffic school to dismiss any moving violation. The rule applies even if you were off the clock in your personal car when you got the ticket.1Justia. Tennessee Code 55-10-301 – Penalty for Violations of Chapters 8 and 9 and Parts 1-5 of This Chapter Federal and state law require all traffic violations by CDL holders, except parking tickets, to be reported to the Department of Safety.2General Sessions Court of Metropolitan Nashville and Davidson County. Traffic School – Notice to CDL Holders There is no workaround.
Separately, anyone operating a commercial motor vehicle at the time of the violation is ineligible, regardless of license class.1Justia. Tennessee Code 55-10-301 – Penalty for Violations of Chapters 8 and 9 and Parts 1-5 of This Chapter
Everyone else needs a valid Tennessee Class D license and a reasonably clean recent history. Courts set their own rules about how often you can use traffic school. Some counties block you if you completed a course within the past year; others set the lookback at three, four, or five years. Call the clerk in the county where you were cited and ask what their interval is.
Violations That Qualify
Traffic school is reserved for minor moving violations. The eligible list is set locally, but Montgomery County’s program is a representative example of what commonly qualifies:
- Speeding 1 to 20 mph over the limit, outside school and construction zones
- Failure to yield the right-of-way
- Running a stop sign or disobeying a traffic signal
- Following too closely
- Improper passing or turning
- Failure to exercise due care
- First-offense hands-free device violation
- Move-over law violation
- Motorcycle helmet violation
Other counties may run a shorter or longer list, so verify with the local court clerk before assuming your citation qualifies.3Montgomery County Government. Driver Improvement Program Eligibility
Violations That Disqualify You
More serious offenses are categorically excluded. You will not be offered traffic school for:
- Speeding 20 mph or more over the limit
- Speeding in a school zone or construction zone
- Reckless driving
- Any violation involving alcohol or drugs
School and construction zone violations trip up a lot of drivers. Even if you were only 10 over, the zone designation alone can make you ineligible.3Montgomery County Government. The Judge Decides, and the County Sets the Rules
Meeting every eligibility criterion does not guarantee you’ll get traffic school. The statute leaves the decision entirely to the court.1Justia. Tennessee Code 55-10-301 – Penalty for Violations of Chapters 8 and 9 and Parts 1-5 of This Chapter The judge will look at your driving record, the circumstances of the stop, and whether you’ve used traffic school before. If you had a violation dismissed through traffic school a year ago, a different judge may say no the second time.
Procedures also differ substantially between counties. Davidson County handles traffic school through a largely administrative process, where eligible drivers can pay and register by mail or online without appearing in court.4Davidson County Circuit Court Clerk. How to Request It
In most Tennessee courts, you need to appear on the date printed on your citation and ask the judge for traffic school. Do not pay the ticket beforehand. Paying the fine is treated as a guilty plea, the conviction goes on your record, and the chance to attend traffic school is gone. Davidson County and a handful of others let eligible drivers register and pay without a separate court appearance, but that’s the exception.4Davidson County Circuit Court Clerk. Some courts want you to bring a certified copy of your driving record to the hearing. You can request one by mail from the Tennessee Department of Safety and Homeland Security for $5; allow at least two weeks for delivery.5State of Tennessee. Driving Record (MVR)
What It Costs
Traffic school is not free, and the total has two pieces: court administrative fees and the course tuition itself. Both vary by county.
In Davidson County, the administrative court cost is $50 per moving violation and the traffic school fee is $90, for a total of $140 for a single violation.4Davidson County Circuit Court Clerk. One protection worth knowing: the statute says no one can be turned away from the course for inability to pay the tuition.1Justia. Tennessee Code 55-10-301 – Penalty for Violations of Chapters 8 and 9 and Parts 1-5 of This Chapter If the fee is a hardship, raise it with the court or the course provider.
Finishing the Course on Time
Once approved, you enroll in a state-approved driver education course and complete it by the deadline the court gives you. Most courses are four hours. The statute allows both in-person and online formats, but confirm with the clerk that online is acceptable before you register, since not every court takes them.6State of Tennessee. Submit the original certificate of completion to the clerk’s office before your deadline. Once the clerk confirms the certificate and all fees are paid, completion gets reported to the Department of Safety and the violation is dismissed.1Justia. Tennessee Code 55-10-301 – Penalty for Violations of Chapters 8 and 9 and Parts 1-5 of This Chapter
Miss the deadline and you lose everything. You’ll be convicted of the original offense, the violation hits your driving record under the normal reporting timelines (30 days for regular license holders, 5 days for CDL holders), and the court costs and course fees you already paid are typically not refundable.7University of Tennessee Municipal Technical Advisory Service. If You Already Pleaded Guilty: Point Removal Is a Different Program
If your window for court-ordered traffic school has closed because you were convicted of a speeding offense, Tennessee runs a separate point-removal program through the Department of Safety. It is not the same as traffic school and does not erase the conviction. It applies only to speeding, it removes up to five points from your record, you must complete an approved four-hour course within 90 days of the conviction, and you can use it only once every four years. Points matter because accumulating 12 or more within any 12-month period triggers a proposed suspension and a hearing with the Department of Safety.
