How Does a Fix-It Ticket Work in Florida? Deadlines, Costs, and Fixes

A fix-it ticket in Florida is a citation for a vehicle equipment problem that you can resolve cheaply by repairing the defect, having a law enforcement agency verify the repair, and filing the signed affidavit with the clerk of court within 30 days. Do that and the fine drops from $30 to $14. Ignore it and you are looking at license suspension, bigger penalties, and potentially a bench warrant.1Online Sunshine. What Kinds of Violations Qualify

Florida law makes it an infraction to drive a vehicle in unsafe condition or without required equipment such as working lamps, mirrors, or properly adjusted brakes.2Justia Law. Florida Code 316.610 – Safety of Vehicle; Inspection Common citations that come with an affidavit of compliance include:

  • Broken or missing taillamps. Every vehicle needs at least two rear taillamps visible from 1,000 feet, with nothing covering them that reduces visibility.3Florida Senate. Florida Code 316.221 – Taillamps
  • Illegal window tint. Side windows next to or forward of the driver’s seat must let through at least 28 percent of visible light and reflect no more than 25 percent.4Online Sunshine. Florida Code 316.2953 – Sunscreening Material
  • Defective headlights, brake lights, or turn signals.
  • Excessive exhaust emissions.
  • Missing mirrors, cracked windshields, or worn tires.

One useful detail: these equipment infractions are classified as nonmoving violations. They do not add points to your driving record, which separates them from moving violations like speeding.5Florida Senate. Florida Code 322.27 – Authority of Department to Suspend or Revoke License

How to Resolve It in 30 Days

When an officer writes you a citation under Section 316.610, the officer must also hand you an affidavit-of-compliance form.1Online Sunshine. Florida Code 316.6105 – Violations Involving Operation of Motor Vehicle in Unsafe Condition; Procedure for Disposition That form unlocks the reduced fine, but you have to work through three steps inside the 30-day window.

Fix the Defect

Repair the problem, whether that means swapping a bulb in your driveway or paying a mechanic to replace a muffler. Keep the receipts.

Get the Repair Verified

Bring the vehicle to any local police department or sheriff’s office in Florida. You are not required to return to the agency that cited you. An employee inspects the vehicle, confirms the defect is corrected, and signs the affidavit. You pay the law enforcement agency $4 at this step.6Florida Senate. Florida Code 318.18 – Amount of Penalties

The statute is explicit that this sign-off is not a warranty of your vehicle’s mechanical condition, and neither the inspector nor the agency is liable if something breaks later.1Online Sunshine. File With the Clerk of Court

Take or mail the signed affidavit and the original citation to the clerk of court in the county where you received the ticket. You pay a reduced fine of $10 at that point.6Florida Senate. Florida Code 318.18 – Amount of Penalties All three steps have to happen within 30 days of the citation.

What It Costs

Your out-of-pocket on the citation itself is $14: $4 to the law enforcement agency for the inspection and $10 to the clerk for the fine. Without the affidavit process, the base fine is $30. County-level court costs and surcharges can add to the total, so confirm the full amount with your local clerk before you pay.

What Happens If You Ignore It

This is where a cheap ticket turns expensive. If you do not respond to a noncriminal traffic citation within 30 days, you are deemed to have admitted the infraction and you still owe the full fine.7Online Sunshine. Florida Code 318.14 – Noncriminal Traffic Infractions; Exception; Procedures

From there, the Department of Highway Safety and Motor Vehicles can suspend your driver’s license for failure to pay or failure to appear. For violations that require a mandatory hearing, a designated official can impose a $500 civil penalty on top of other fines and suspend your license for three months; for more serious mandatory appearances, that climbs to $1,000 and six months.7Online Sunshine. Florida Code 318.14 – Noncriminal Traffic Infractions; Exception; Procedures

A court can also issue a bench warrant if you continue to ignore the citation. Driving on a suspended license then becomes a separate criminal offense. A $14 problem becomes hundreds or thousands of dollars, a suspension that affects your job and insurance, and a criminal exposure that was never on the table at the roadside.

When You Might Contest Instead

You can fight a fix-it citation rather than pay it. A few defenses come up often.

The most direct is that the alleged defect did not exist. A mechanic’s inspection report from around the date of the stop, dashcam footage, or a witness showing the equipment was working can support that argument. You can also argue the condition the officer cited does not actually violate Florida’s equipment rules. Chapter 316 is specific about what is required, and cosmetic damage that does not affect any required lamp or safety feature is not a violation of Section 316.610.2Justia Law. Florida Code 316.610 – Safety of Vehicle; Inspection

To contest, you have to elect to appear in court rather than paying or submitting an affidavit of compliance. Both of those count as admitting the infraction and waive your hearing. Weigh the choice: if you contest and lose, you pay the full $30 plus court costs instead of the reduced $14.

Commercial Drivers Are Not Covered

The affidavit-of-compliance process does not apply to commercial motor vehicles or to transit buses operated by a government entity.1Online Sunshine. Florida Code 316.6105 – Violations Involving Operation of Motor Vehicle in Unsafe Condition; Procedure for Disposition If you drive commercially and get cited for an equipment violation, the reduced-fine track is not available and the citation moves through the standard process.
