Delaware makes money without a sales tax by relying on personal income tax and corporate franchise tax for roughly 63% of its state revenue, then filling the rest with a gross receipts tax on businesses, unclaimed property, bank franchise taxes, real estate transfer taxes, motor fuel taxes, lottery and gaming proceeds, and federal funding.1Delaware Budget Office. FY26 Governor’s Recommended Operating Budget – Introduction The state’s fiscal year 2026 budget shows how a jurisdiction with fewer than a million residents pulls in billions without ever ringing up a taxable purchase.
One thing to set aside up front: property taxes do exist in Delaware, but they’re collected by counties, municipalities, and school districts, not the state. They don’t fund the state general budget, so they don’t appear in the mix below.
Personal Income Tax Does the Heaviest Lifting
The biggest single source of state revenue is the personal income tax paid by Delaware residents, at 35.8% of the fiscal year 2026 budget.1Delaware Budget Office. FY26 Governor’s Recommended Operating Budget – Introduction Delaware uses a progressive structure with seven brackets:
- First $2,000 of taxable income: 0%
- $2,000 to $5,000: 2.2%
- $5,000 to $10,000: 3.9%
- $10,000 to $20,000: 4.8%
- $20,000 to $25,000: 5.2%
- $25,000 to $60,000: 5.55%
- Over $60,000: 6.6%
The top rate of 6.6% applies only to taxable income above $60,000, not to total income.2Division of Revenue – State of Delaware. Tax Rate Changes The standard deduction is $3,250 for single filers and $6,500 for married couples filing jointly, with an extra $2,500 deduction for each qualifying condition of being age 65 or older or blind.
The practical trade for residents: no tax at the register, but a somewhat larger bite from wages than a sales-tax state would take. The top marginal rate stays moderate compared with the highest-tax states.
Corporate Franchise Tax Turns Incorporations Into Cash
The state’s signature revenue stream is the annual franchise tax paid by every entity incorporated under Delaware law. It contributes about 27.6% of state funds in the fiscal year 2026 budget.1Delaware Budget Office. FY26 Governor’s Recommended Operating Budget – Introduction More than 2.1 million business entities are currently registered in Delaware, and 66.7% of Fortune 500 companies are incorporated there.3Division of Corporations – State of Delaware. The tax isn’t a tax on profits. A company that earns nothing still owes it. Stock corporations calculate what they owe using whichever of two methods yields the lower amount. The authorized shares method starts at $175 for 5,000 shares or fewer and adds $85 for each additional 10,000 shares. The assumed par value capital method charges $400 per million dollars of assumed par value capital, with a $400 minimum. Either way, the franchise tax is never less than $175 and never more than $200,000.4Division of Corporations – State of Delaware. How to Calculate Franchise Taxes

Gross Receipts Tax Substitutes for a Sales Tax
The gross receipts tax is the closest thing Delaware has to a sales tax, but it works from the other side of the counter. Instead of charging the buyer at checkout, Delaware taxes the seller on total business revenue, with no deductions for cost of goods, labor, interest, or any other expense.7Division of Revenue – State of Delaware. Gross Receipts Tax FAQs It accounts for 5.6% of the state budget.1Delaware Budget Office. FY26 Governor’s Recommended Operating Budget – Introduction
Rates vary by industry and are generally low. General retailers pay about 0.75%, service providers about 0.40%, and manufacturers about 0.13%.8Delaware Division of Revenue. Businesses don’t itemize this tax on customer receipts, though some portion inevitably gets built into prices.
Most businesses also get a monthly exclusion before the tax applies at all. Exclusions start at $100,000 per month and can run as high as $1,250,000 depending on the type of business.7Division of Revenue – State of Delaware. Unclaimed Property Is the Surprising Stream
About 5.5% of Delaware’s total state revenue comes from unclaimed property. Every state has this stream. Delaware just gets far more of it because of the incorporation advantage.1Delaware Budget Office. FY26 Governor’s Recommended Operating Budget – Introduction
When a company holds property that belongs to someone else, and that person can’t be located after a set dormancy period, the property “escheats” to a state government. Under Delaware law, the state can claim custody of abandoned property when the holder is domiciled in Delaware and the owner’s last-known address is either unknown or in a jurisdiction that doesn’t claim it.9Delaware Code Online. Delaware Code Title 12 – Chapter 11 For corporations, “domicile” means the state of incorporation. With more than two million entities on the books, an enormous volume of dormant gift cards, uncashed checks, forgotten deposits, and abandoned bank accounts flows to Delaware rather than to the states where the owners actually live.
Dormancy periods depend on the type of property. Demand deposits and customer credits are presumed abandoned after five years, securities after three years, and traveler’s checks after 15 years.9Delaware Code Online. Delaware Code Title 12 – Chapter 11
Bank Franchise Tax Captures the Credit Card Industry
Delaware is a major banking center because federal law lets nationally chartered banks apply their home state’s interest rate rules to customers everywhere. Several of the country’s largest credit card issuers are headquartered there for that reason, and the state taxes them through a dedicated bank franchise tax that brings in about 1.6% of total revenue.1Delaware Budget Office. FY26 Governor’s Recommended Operating Budget – Introduction
The standard bank franchise tax uses graduated rates on taxable income:
- Up to $20 million: 8.7%
- $20 million to $25 million: 6.7%
- $25 million to $30 million: 4.7%
- $30 million to $650 million: 2.7%
- Over $650 million: 1.7%
Banks can alternatively elect a method using three-factor apportionment with a double-weighted receipts factor, applying rates from 7.0% on the first $50 million down to 0.5% on income above $1.3 billion.10Office of the State Bank Commissioner. Bank Franchise Tax The rate structure declines deliberately, giving the largest banks a reason to keep their charters in Delaware and preserving both the tax revenue and the financial-sector employment around Wilmington.
Real Estate Transfer Tax and Motor Fuel Tax
Delaware imposes a realty transfer tax on every sale of real property. Where a county or municipality also levies a transfer tax, the state rate is 2.5% of the sale price, split evenly between buyer and seller at 1.25% each. In areas with no local transfer tax, the state rate rises to 3%.11Division of Revenue – State of Delaware. First-Time Home Buyer Tax Credit The stream is worth roughly 3.6% of the state budget.1Delaware Budget Office. FY26 Governor’s Recommended Operating Budget – Introduction First-time homebuyers get a 0.5% reduction on the buyer’s share, capped at $2,000 and applying only to the first $400,000 of the purchase price.
Motor fuel is taxed at $0.23 per gallon on gasoline and $0.22 per gallon on diesel and other special fuels.12Delaware Division of Motor Vehicles. Motor Fuel Special Fuel Aviation Jet Fuel The rates are among the lower fuel taxes nationally, and the revenue supports transportation infrastructure.
Lottery, Gaming, Federal Funds, and Other Non-Tax Revenue
Delaware operates a state lottery and regulates casino gaming, including video lottery terminals and online casino operations. Together, lottery and gaming proceeds account for about 3.6% of the state budget.1Delaware Budget Office. FY26 Governor’s Recommended Operating Budget – Introduction For scale, the regulated casino market generated about $45.5 million in total gaming revenue in February 2026 alone, producing nearly $12 million in state tax revenue for that single month.
The state also collects federal grants for healthcare, education, transportation, and social services, along with fees for business licenses, professional licenses, and vehicle registrations, plus investment income on managed state funds. The “other non-tax” category alone represents 8.7% of the fiscal year 2026 budget.1Delaware Budget Office. FY26 Governor’s Recommended Operating Budget – Introduction
Why This Structure Works Without a Sales Tax
The model holds together because each piece feeds the others. Favorable corporate law attracts incorporations. Incorporations generate franchise tax revenue and funnel unclaimed property to Delaware. Banking-friendly regulation draws credit card companies, which pay bank franchise tax and employ residents who then pay income tax. The absence of a sales tax becomes a competitive draw in its own right, pulling shoppers from neighboring states and making Delaware more attractive for both businesses and residents. Other states can’t easily copy this because they don’t have the decades-long lead in corporate law that makes Delaware the default place to incorporate.3Division of Corporations – State of Delaware.
