How Does Per Diem Work in California: Rates, Taxes, and Travel Days

In California, per diem works as a flat daily allowance your employer pays to cover lodging, meals, and incidental costs while you travel for work, and it’s the most common way employers meet their legal duty to reimburse job-related expenses. The dollar amount usually tracks the federal General Services Administration (GSA) rate for the city you visit, which for fiscal year 2026 runs from $178 per day in areas without a specific listing up to $364 per day in San Francisco. Whether that money shows up as taxable wages on your W-2 depends on how your employer structures the plan and how quickly you document each trip.

What Your Employer Owes You Under California Law

California Labor Code Section 2802 requires every private employer to reimburse employees for all necessary expenses of doing their job, including hotels, meals, rental cars, and airfare.1California Legislative Information. California Code LAB 2802 Per diem satisfies this obligation, but only if the flat rate actually covers your reasonable costs. If your employer pays $200 a day for a San Francisco trip and your hotel alone runs $275, the employer owes you the difference. A per diem that consistently falls short doesn’t meet the standard.

Unpaid reimbursements aren’t a minor problem for employers. One boundary to know: Section 2802 doesn’t cover public employers. A 2025 California Court of Appeal ruling confirmed the statute doesn’t reach agencies like the California State University system. State and local government workers get their reimbursement rights from other policies.

FY2026 Per Diem Rates for California

Most California employers use GSA rates, which set separate daily amounts for lodging and for meals and incidental expenses (M&IE) in every county. Some employers skip city-by-city lookups and use the IRS high-low method instead. For 2026, the high-cost rate is $319 per day (including $86 for M&IE) and everywhere else is $225 per day (including $74 for M&IE).7Internal Revenue Service. How Travel Days Are Prorated

You don’t get the full M&IE rate on every day of a trip. Is Per Diem Taxable in California?

Under an accountable plan, per diem payments at or below the federal rate are not reported as wages and you owe no tax on them.9Internal Revenue Service. Publication 463, Travel, Gift, and Car Expenses – Section: Reimbursements An accountable plan has to meet three requirements:

  • Business connection: The expenses relate to services you perform for your employer.
  • Adequate accounting: You report the details of each trip within a reasonable time.
  • Return of excess: You give back any amount above what you actually substantiated, within a reasonable time.

If your employer pays more than the federal rate, the excess gets reported in Box 1 of your W-2 and is subject to income tax withholding and payroll taxes. Under a non-accountable plan, meaning one that fails any of those three requirements, the entire per diem payment counts as taxable wages. This is where per diem quietly goes wrong for a lot of workers. If your employer hands you a flat daily allowance and never asks for an expense report, that money is taxable even though every dollar went to legitimate business costs.

What You Have to Do to Keep Per Diem Tax-Free

The paperwork is lighter than traditional expense reimbursement, but you still have to do it. For each trip, record the date, destination, and business purpose.10IRS.gov. If your employer pays per diem for meals only and reimburses lodging separately at actual cost, you do need lodging receipts.

The IRS treats 60 days after an expense as a safe harbor for submitting your expense report. File within that window and the substantiation is timely regardless of your company’s own deadlines.11eCFR. 26 CFR 1.62-2 – Reimbursements and Other Expense Allowance Arrangements Miss it and the entire per diem payment can be reclassified as taxable income, even if the trip was completely legitimate. It’s probably the most common way employees accidentally create a tax problem for themselves.

If your employer advanced per diem before a trip and you traveled fewer days than expected, return the excess promptly. Unreturned overpayments become taxable wages.

When Long Assignments Lose Their Tax-Free Status

Per diem’s tax-free treatment has a built-in expiration. If your assignment at a single location is expected to last more than one year, the IRS treats it as indefinite rather than temporary. The trigger is your realistic expectation when the assignment starts. If you initially expect eight months but it later becomes clear you’ll be on-site for 18, your per diem becomes taxable at the point your expectation changes, not when you actually cross the one-year mark.12Internal Revenue Service. Your employer’s Labor Code 2802 duty to reimburse actual expenses doesn’t disappear when an assignment becomes indefinite. You’re still owed the money. The tax treatment just changes: those payments land on your W-2 as wages.

What Per Diem Doesn’t Cover

The M&IE component covers meals, taxes and tips on meals, and a narrow set of incidental costs. The GSA defines incidentals as fees and tips to porters, baggage carriers, and hotel staff, allocated at $5 per day at every tier.13U.S. General Services Administration.   • Transportation: Airfare, rental cars, rideshares, parking, and mileage are reimbursed separately.
  • Laundry and dry cleaning: Not included in either M&IE or lodging.
  • Spouse or family travel: Generally cannot be reimbursed tax-free unless that person is also an employee with a business purpose for the trip.
  • Daily commuting: Travel between your home and your regular workplace is never reimbursable, even under California law.

The lodging portion covers the room rate only, not hotel occupancy taxes. In California, transient occupancy taxes vary by city and county and can add 10 to 15 percent to your nightly bill. Some employers reimburse those taxes separately; others fold them into a higher overall per diem. Check your company’s policy. A Note for Independent Contractors

Self-employed workers can use the federal per diem rate to calculate their meal deduction on Schedule C, but cannot use per diem for lodging.10IRS.gov. Per Diem Rates – Frequently Asked Questions Actual lodging costs need receipts.

Independent contractors also can’t receive tax-free per diem from clients the way employees can from employers.
