In Michigan, a 16-year-old driving on a Level 2 intermediate license cannot be behind the wheel between 10 p.m. and 5 a.m. unless an exception applies.1Michigan Legislature. It stays in force until the driver moves up to a Level 3 full license, which can’t happen before age 17.
When the Curfew Doesn’t Apply
Michigan law lists three situations where a Level 2 driver can legally be on the road after 10 p.m.1Michigan Legislature. Michigan Compiled Laws 257.310e – Graduated Licensing
The first is riding with a qualifying adult. That means a parent, a legal guardian, or any licensed driver 21 or older who has been designated by the parent or guardian.
The second is employment. Driving to work, home from work, or during work is allowed at any hour.
The third covers authorized activities, and the statute defines these more specifically than families often assume:
- Activities connected to a public, private, or home school
- Official league, club, or association events, and paid programs offered by businesses that specialize in those activities
- Classes offered by a college, community college, nonprofit, government agency, or vocational business
- Events sponsored by a federally tax-exempt religious organization
- Driving someone who needs immediate emergency care or personal protection to a hospital, police station, domestic violence shelter, or similar safety location
The emergency exception is narrower than it sounds. It’s not a general “any emergency” pass; it applies when the destination is a health care professional, hospital, police station, domestic violence shelter, or public safety location and someone needs immediate help.2Michigan Department of State. What Happens if a 16-Year-Old Drives Past Curfew
A curfew violation is a civil infraction that adds two points to the teen’s driving record.3Michigan.gov. A single violation extends the Level 2 period by 12 months, and because advancing to Level 3 requires 12 consecutive months with no violations or at-fault crashes, one infraction resets that clock.4Michigan Department of State. New Drivers Under 18 A teen who picks up a curfew ticket at 16 can easily be 18 before the restrictions come off.
Repeated violations can trigger a driver reexamination by the Michigan Secretary of State, which may lead to a suspension of up to one year or added restrictions on top of the GDL limits.3Michigan.gov. Graduated Driver Licensing Teen Driving Laws Brochure Insurance is a separate hit. A moving violation on a teen’s record can raise the family’s auto premium by 20% to 25%, depending on the insurer and policy.
When the Curfew Finally Ends
The 10 p.m. to 5 a.m. rule disappears at Level 3. To reach Level 3, a driver must be at least 17, have held the Level 2 license for at least six months, and have gone 12 consecutive months without any moving violations or at-fault accidents.4Michigan Department of State. New Drivers Under 18 The earliest possible Level 3 date is a teen’s 17th birthday, and only if the record has stayed clean for the full year. Any violation in that window restarts the count.
Other Rules That Apply Alongside the Curfew
Two related restrictions apply to the same 16-year-old driver and are easy to confuse with the curfew. A Level 2 driver can carry no more than one passenger under age 21 at any hour of the day, with exceptions for immediate family, employment travel, authorized activities, and driving with a qualifying adult in the vehicle.5Michigan.gov.
