How Late Can You Shoot Fireworks in Alabama: 10 PM Cutoff and Exceptions

There is no statewide law that sets an exact hour for how late you can shoot fireworks in Alabama. The cutoff is set by your city or county, and across most Alabama municipalities the answer is 10 PM on ordinary evenings, with an extension to around midnight or 1 AM on New Year’s Eve. If your city bans fireworks outright, no hour is legal. If you’re in an unincorporated area with no local ordinance, general noise rules still apply.

The 10 PM Default and the New Year’s Eve Extension

Alabama law expressly preserves the authority of cities to pass their own fireworks restrictions, including rules tighter than state law.¹ That is why the hour changes with your address.

The common pattern looks like this:

Bay Minette allows fireworks from 8 AM to 10 PM on permitted days, with the window extended to 1 AM on January 1.²
Spanish Fort generally prohibits fireworks but permits them on July 4 from 10 AM to 10 PM and on December 31 from 10 AM to 1 AM on January 1.²
Huntsville asks residents not to shoot fireworks after 10 PM.³
Mobile bans fireworks citywide except on July 3, July 4, December 31, and January 1, and fire officials can suspend even those exceptions during drought.

Note the asymmetry: July 4 usually does not get a late-night extension the way New Year’s Eve does, because there’s no midnight countdown attached to it. If you can’t find your city’s rule in writing, 10 PM is the safest working assumption. Call your city clerk before the holiday to confirm.

Cities Where No Hour Is Legal

Some Alabama municipalities prohibit consumer fireworks entirely. Vestavia Hills bans the sale, possession, use, storage, and distribution of all fireworks and pyrotechnics.⁴ Foley and Daphne restrict fireworks to permitted public displays only.²

In these places, no time of day is legal for personal use. Buying fireworks legally at a stand outside the city does not create a right to set them off inside city limits.

Unincorporated Areas

Outside city limits, restrictions loosen. Without a municipal ordinance, no local hourly curfew applies, and the state code doesn’t set one either. County commissions occasionally pass fireworks rules, but many rural areas fall back on the state framework alone. That said, noise complaints can still bring a law enforcement response, and general nuisance principles still apply. Living in the county doesn’t shield you if you’re launching aerial shells at 3 AM.

Noise Ordinances as a Backstop

Even where no fireworks-specific curfew exists, a general noise ordinance can catch you. Alabama cities commonly enforce quiet hours starting somewhere between 9 PM and 11 PM. Irondale restricts disruptive noise between 10 PM and 7 AM.⁵ Tuscaloosa lowers its residential threshold to 75 decibels after 9 PM.

Consumer fireworks routinely blow past those limits. A typical aerial shell can produce well over 100 decibels at close range, so a single rocket after quiet hours can violate a noise ordinance on its own. Officers don’t need a fireworks-specific rule to write a citation. In areas without a dedicated curfew, this is the regulation that usually reaches people first.

Burn Bans Can Override the Calendar

Fire risk adds a separate layer. The Alabama Forestry Commission issues drought emergencies, often called “no burn orders,” that prohibit outdoor burning across affected counties. Mobile’s ordinance specifically empowers fire officials to suspend fireworks use during drought or dangerous weather, and other cities include similar clauses.

These restrictions override the normal fireworks calendar. You could be within the authorized season and well before any hourly cutoff, and a burn ban still makes discharge illegal. Check the Forestry Commission’s current listings before any holiday, especially in a dry summer.

Penalties and Liability If You Go Too Late

The consequences depend on whether you’re charged under a city ordinance or state law. Municipal violations follow each city’s own penalty schedule; Vestavia Hills, for instance, treats violations of its ban as misdemeanors.⁴ A Class C misdemeanor under state law carries up to three months in the county jail.⁶ Each day a violation continues can count as a separate offense.

Civil exposure matters more than the fine in most cases. If your fireworks damage property or hurt someone, you face a lawsuit on top of the citation. Discharging outside permitted hours, during a burn ban, or in a city that bans fireworks weakens your defense, because violating a safety law raises the standard of care a court will hold you to. Damage that crosses property lines, including fires that spread to a neighbor’s structure or vehicle, is often traceable back to you. Some homeowner’s policies exclude damage caused by illegal activity. Read yours before you light anything.

How to Stay on the Right Side of the Cutoff

Look up your city’s ordinance first. Search the city’s name plus “fireworks ordinance,” or call the city clerk. Rules have changed in several Alabama cities in recent years.
Treat 10 PM as the default. If you can’t confirm anything more generous in writing, stop by 10 PM and you’ll stay clear of both fireworks curfews and most noise ordinances.
Expect a New Year’s Eve extension to around midnight or 1 AM, but confirm before assuming it applies where you live.
Check the Alabama Forestry Commission for burn bans before the holiday.
Get the property owner’s permission before shooting on land that isn’t yours. Some Alabama cities require it in writing.²
Clean up spent debris. Some ordinances require removal within 24 hours, and leaving casings on a neighbor’s lawn generates complaints even where no cleanup rule exists.²
