In Tennessee, how long after mediation your divorce becomes final depends mostly on when you filed, not when you settled. The court cannot enter a final decree until the complaint has been on file for at least 60 days if you have no minor children, or 90 days if you do.1Justia. Tennessee Code 36-4-101 – Grounds for Divorce From Bonds of Matrimony Once that waiting period has passed and your paperwork is filed, most courts can schedule a brief uncontested hearing within a few days to a few weeks. The judge then signs the Final Decree of Divorce, and a further 30-day appeal window runs before the divorce is settled for every purpose, including remarriage.2Tennessee Courts. The 60- or 90-Day Clock Runs From Filing, Not Mediation
The waiting period starts on the date the divorce complaint was filed with the court clerk. It does not start on the day you reached agreement, signed the Marital Dissolution Agreement, or walked out of your mediator’s office. If you filed in early March and mediated in late March, the earliest a childless couple could finalize is early May. A couple with minor children would wait until early June.1Justia. That timing cuts both ways. If you reached agreement early, you wait out the balance of the 60 or 90 days before anything else can happen. If mediation did not succeed until day 80 and you have no children, the statutory period is already nearly satisfied, and the only remaining delay is getting on the court’s calendar.
What Has to Be Ready Before the Hearing
A successful mediation produces a Marital Dissolution Agreement that spells out how property, debts, and alimony will be handled. Both spouses must sign it, and Tennessee requires it to be notarized.3Tennessee Courts. You also need to complete a state divorce certificate before the hearing.6Tennessee Courts. Form 6 Final Divorce Order If you want your former name restored, ask for that in the divorce proceedings so the judge can include it in the final decree. Handling it separately later means a new petition and new fees.
If you also want your name changed on your marriage license and other paperwork, the final decree works as your legal documentation for updating your driver’s license, Social Security records, and other identification.
Scheduling the Final Hearing
Once the signed, notarized MDA, Parenting Plan if applicable, and divorce certificate are filed with the court clerk, you or your attorney request a date for an uncontested divorce hearing. How quickly that date comes depends on the county. Shelby County, for example, reviews hearing requests within 24 hours on business days and schedules them in the order received.7Shelby County, TN. Uncontested Hearing Request Confirmation Busier counties take longer. Plan on anywhere from a few days to a few weeks between filing your documents and standing in front of the judge.
The hearing itself is short. The judge reviews the MDA and Parenting Plan, confirms the agreement is fair and complies with Tennessee law, and may ask whether both parties entered it voluntarily. Only the spouse who filed the complaint is legally required to attend, though having both spouses present helps if the court has questions. If the judge is satisfied, the court signs the Final Decree of Divorce, which formally ends the marriage and makes the MDA and Parenting Plan enforceable court orders. A spouse who did not attend must be mailed a copy of the signed decree.6Tennessee Courts. Form 6 Final Divorce Order
Filing fees are a county matter. In Nashville’s Circuit Court, as of January 2026, a divorce costs $234.50 without minor children and $309.50 with minor children, including state and county litigation taxes.8Circuit Court Clerk. The 30-Day Appeal Window After the Decree
The judge’s signature is not the last step. Either spouse has 30 days from the date the decree is entered to file a notice of appeal with the appellate court clerk.2Tennessee Courts. Rule 4 Appeal as of Right Time for Filing Notice of Appeal Appeals of agreed divorces are rare, because both parties voluntarily signed the MDA, but during those 30 days Tennessee advises against remarrying or purchasing property. Once the 30 days pass with no appeal, the divorce is fully final and enforceable in every sense. If a wedding is on your calendar, wait out that window.
Putting the Timeline Together
For a childless couple who filed the complaint on day one, finalized mediation quickly, and lives in a county with a responsive clerk, the shortest realistic path looks something like this: 60 days of statutory wait, a week or two to get on the court’s docket, a short hearing, then another 30 days before the decree is beyond appeal. That is roughly three to three and a half months from filing. A couple with minor children adds another 30 days to the front end for a total closer to four to four and a half months. Slow counties, missing paperwork, or a mediation that drags into the back half of the waiting period can all stretch those estimates.
Things That Can Outlast the Decree
A signed decree does not automatically wrap up every financial thread. Two in particular catch people off guard.
If your MDA divides a 401(k), pension, or other employer-sponsored retirement plan, you need a Qualified Domestic Relations Order to actually move the money. A QDRO is a separate court order directing the plan administrator to pay a portion of the account to the other spouse, and it must identify both parties and the exact amount or percentage.9Internal Revenue Service. Retirement Topics – QDRO Qualified Domestic Relations Order Plan administrators have to review a QDRO within a “reasonable period,” with no fixed federal deadline.10U.S. Department of Labor. QDROs – Determining Qualified Status and Paying Benefits FAQs A clean order can clear in a few weeks; a flawed one bounces back for corrections. Start the process soon after finalization rather than letting it sit.
Joint debts also deserve attention. Your MDA can assign a credit card or loan to one spouse, but that assignment binds only the two of you. The original creditor can still collect from either name on the account if payments stop. Your remedy against your former spouse is to go back to court for violating the decree, so closing or freezing joint accounts and including an indemnification clause in the MDA are worth doing before you need them.6Tennessee Courts.
