In Florida, you can generally drive without a permanent license plate for up to 30 days on a temporary tag, whether you just bought the car, moved from out of state, or are waiting on paperwork. Order a personalized or specialty plate and the temporary tag runs 90 days instead.1Florida Senate. Florida Code 320.131 – Temporary Tags Drive with no plate and no temporary tag, and you’re exposed to fines, a possible misdemeanor charge on a repeat offense, and vehicle immobilization.
Buying From a Florida Dealer
A licensed Florida dealer issues a temporary tag when you drive off the lot. It’s valid for 30 days from the date of issue, sits in the rear plate bracket, and covers you while the dealer processes title and registration. Florida caps you at two temporary tags per person for the same vehicle, so if the permanent plate is delayed past the first 30 days, you can get one more and no more.1Florida Senate. Florida Code 320.131 – Temporary Tags
The tag fee is $2, with small service charges possible on top from the dealer or tax collector.2Florida Department of Highway Safety and Motor Vehicles. Procedure RS-31 – Temporary License Plate If you ordered a personalized or specialty plate, ask the dealer for the 90-day tag, since manufacturing those plates takes longer than a standard issue.1Florida Senate. Florida Code 320.131 – Temporary Tags
Buying From a Private Seller
Nobody hands you a temporary tag when you buy from another person. You have to visit a county tax collector’s office or license plate agency and get one yourself. Same rules apply: 30 days of legal driving and a two-tag maximum per vehicle.1Florida Senate. Florida Code 320.131 – Temporary Tags
Bring the following to the counter:
- Form HSMV 83091, the application for a temporary license plate.
- A current, valid driver’s license, state ID, or passport.
- Proof of Florida insurance (motorcycles and trailers are exempt).
- A copy of the title or MCO so the office can verify the VIN.
These are FLHSMV’s own requirements for issuing the tag.2Florida Department of Highway Safety and Motor Vehicles. Procedure RS-31 – Temporary License Plate Note the practical problem: you can’t legally drive the unplated car to the office. Most private-sale buyers leave the vehicle with the seller until they can pick up the tag, or they trailer it in.
Moving to Florida With an Out-of-State Vehicle
If you arrive with a vehicle registered in another state, you can continue driving on those plates for a limited time. Florida considers you a resident the moment any of these happens:
- You start a job or begin working in a trade or profession in the state.
- You enroll a child in a Florida public school.
- You register to vote in Florida.
- You file for a homestead tax exemption.
- You’ve lived in Florida for more than six consecutive months.
Once any trigger applies, you’re expected to register the vehicle promptly.3Florida Department of Highway Safety and Motor Vehicles. New Resident – Welcome to Florida If you need time to secure ownership documents from your prior state, Florida allows a 30-day temporary tag while you gather them.1Florida Senate. Florida Code 320.131 – Temporary Tags Registration itself requires proof of ownership, proof of Florida insurance, valid ID, and a VIN verification for out-of-state vehicles, handled at a county tax collector’s office or FLHSMV service center.
Lost, Damaged, or Stolen Plates
If your permanent plate is lost, damaged, or stolen, Florida Statute 320.0607 controls the replacement. You apply at your local tax collector’s office or license plate agency using Form HSMV 83146. The fee is $28 plus applicable service charges, and it’s waived if you supply a copy of a police report for a stolen plate.4The Florida Legislature. Florida Code 320.0607 – Replacement License Plates Validation Decal or Mobile Home Sticker File the police report either way; it protects you if someone else uses your plate number.
The replacement statute doesn’t spell out a temporary tag to drive while the new plate arrives, and FLHSMV’s application form is silent on it too.5Florida Department of Highway Safety and Motor Vehicles. Application for Replacement License Plate Validation Decal or Parking Permit Section 320.131 does give the department discretion to issue a temporary tag “in any case where a permanent license plate cannot legally be issued to an applicant and a temporary license plate is not specifically authorized.”1Florida Senate. Florida Code 320.131 – Temporary Tags Ask the tax collector’s office whether they’ll issue one for your situation.
What Happens if You Drive Past the Window
Once your temporary tag expires or your registration lapses, Florida escalates the penalty with the length of the lapse under Section 320.07:
- Expired six months or less: a noncriminal traffic infraction treated as a nonmoving violation, with a base fine of $30 plus a delinquent fee.6Justia Law. Florida Code 320.07 – Expiration of Registration7Florida Senate. Florida Code 318.18 – Amount of Penalties
- Expired more than six months, first offense: still a noncriminal infraction under Section 318.14’s standard disposition, but heavier than the shorter lapse.6Justia Law. Florida Code 320.07 – Expiration of Registration
- Expired more than six months, second or subsequent offense: a second-degree misdemeanor, punishable by up to 60 days in jail.6Justia Law. Florida Code 320.07 – Expiration of Registration8The Florida Legislature. Florida Code 775.082 – Penalties Applicability of Sentencing Structures
Immobilization is a separate risk. If FLHSMV issues a notice of violation for an unregistered vehicle and you don’t register it or prove an exemption within 30 days, the department is authorized to boot the vehicle. Getting the boot off requires completing the registration or proving the vehicle is exempt.9The Florida Legislature. Florida Code 320.02 – Registration Required The longer the lapse runs, the harder it is to unwind, so treat the 30-day tag as a hard deadline, not a suggestion.
