There is no single answer to how long you have to live in Idaho to be a resident, because Idaho sets a different clock for each thing you might want to do. Thirty days makes you a resident for a driver’s license, vehicle registration, and voting. Six weeks lets you file for divorce. Six months qualifies you for a resident hunting or fishing license. A full year is required for in-state college tuition. Income tax residency runs on its own rules entirely.
Domicile Is the Starting Point
Almost every Idaho residency rule sits on top of the concept of “domicile,” which is the place you consider your permanent home and where you intend to stay. You can own property in several states, but you have only one domicile at a time.1Cornell Law School. Idaho Admin Code r 35.01.01.030 – RESIDENT Physical presence alone doesn’t establish it. Idaho looks at where you work, where your family lives, where you bank, where your vehicles are registered, and where you file taxes. The more of those anchors sit in Idaho, the stronger your claim.
Meeting one timeline doesn’t automatically qualify you for the others. A person who has lived in Idaho for 60 days can vote and hold an Idaho license but still cannot buy a resident hunting tag or claim in-state tuition.
30 Days: Driver’s License, Vehicle Registration, and Voting
Once Idaho becomes your principal place of residence, you have 30 days to get an Idaho driver’s license and to title and register any out-of-state vehicles.2Idaho Transportation Department. New Residents and Drivers The clock starts when you settle in, not when you first cross the state line. Vehicle registration applies even if your old plates haven’t expired yet, and the vehicle itself has to come to the DMV for a VIN inspection.
The same 30-day mark opens the door to voting. Idaho law treats you as a “citizen of the state of Idaho” for election purposes once you have lived in the state and in your county for at least 30 days before an election and you intend to stay. Idaho also permits same-day registration at the polls, so a new resident who clears the 30-day threshold can register and cast a ballot on Election Day.
6 Weeks: Filing for Divorce
To file for divorce in Idaho, the person filing must have been a resident of the state for at least six full weeks immediately before submitting the paperwork. A court cannot grant a divorce unless that condition is met.3Idaho State Legislature. Idaho Code 32-701 – Residence Required The six weeks must be continuous, and only the filing spouse has to meet it. The other spouse can live anywhere.
6 Months: Resident Hunting and Fishing Licenses
Resident hunting and fishing licenses are much cheaper than nonresident ones, and Idaho sets a higher bar. You must have been domiciled in Idaho with a genuine intent to make it your permanent home for at least six months immediately before applying.4Idaho State Legislature. Idaho Code 36-202 – Definitions Owning property or paying property taxes in Idaho is not enough on its own.
Idaho Fish and Game also disqualifies you if you have claimed resident privileges somewhere else. Holding a valid driver’s license from another state, being registered to vote elsewhere, or filing resident income taxes in another state will get your Idaho residency claim rejected.4Idaho State Legislature. Idaho Code 36-202 – Definitions Active-duty military members permanently stationed in Idaho, along with their spouse and children under 18, qualify for resident licenses after just 30 days.
12 Months: In-State College Tuition
In-state tuition at Idaho’s public universities carries the strictest requirement: 12 continuous months of domicile in Idaho immediately before the semester begins.5Idaho State Legislature. Idaho Code 33-3717B – Residency Requirements This is also where applicants most often get denied, because the schools actively scrutinize whether the reason you moved was something other than school.
Any student enrolled for more than eight credit hours in a semester during that 12-month window is presumed to be in Idaho primarily for educational purposes.6Boise State University. Idaho Residency – Office of the Registrar You can rebut that presumption, but the burden falls on you. Idaho employment records, filed Idaho income tax returns, vehicle registration, utility bills, and a signed lease all help. Moving to Idaho and enrolling full-time right away will almost always result in a denial.
Military and Veterans
Active-duty military stationed in Idaho on orders qualify for in-state tuition automatically, as do Idaho National Guard members. Veterans who served at least two years and designate Idaho as their intended domicile at separation can enroll at in-state rates if they start at an Idaho institution within one year of discharge; they then have one year of classes to actively establish Idaho domicile.5Idaho State Legislature. Idaho Code 33-3717B – Residency Requirements Dependent children of qualifying active-duty parents also receive in-state rates and keep that status if the parent is later transferred out of Idaho, provided the student stays enrolled.
Income Tax Residency Runs on Its Own Rules
Idaho treats you as a resident for income tax in two situations. The first is being domiciled in Idaho for the entire tax year, in which case Idaho taxes all your income no matter where you earned it.1Cornell Law School. Idaho Admin Code r 35.01.01.030 – RESIDENT
The second catches people who keep a home in Idaho without calling it their domicile. If you maintain a place of abode in Idaho for the entire tax year and spend more than 270 days in the state that year, Idaho classifies you as a resident regardless of what you claim your domicile is. Any part of a calendar day spent in Idaho counts as a full day unless you can show the presence was temporary or transitory.7Idaho State Legislature. What Missing a Deadline Costs
Failing to update your address or transfer your license after the 30-day window is an infraction under Idaho law, and driving on an out-of-state license past that point can lead to a traffic stop and citation.9Idaho State Legislature. Idaho Code 49-320 – Notice of Change of Address Operating an unregistered vehicle is a separate violation, and driving with out-of-state plates after the deadline can also complicate an insurance claim if you’re in an accident.
Tax consequences are more serious. Willfully failing to file or pay Idaho income tax is a misdemeanor punishable by up to six months in jail and a $300 fine. Deliberately evading tax or filing a fraudulent return is a felony carrying up to five years in prison and a $10,000 fine.
