How long a permit is valid for in Illinois depends entirely on which permit you hold. A Firearm Owner’s Identification (FOID) card lasts 10 years. A concealed carry license lasts 5 years. Most National Pollutant Discharge Elimination System (NPDES) environmental permits run 5 years. Building permits are set locally, and six months is a common window before the permit goes void. Each one has its own renewal process, and the penalty for letting the wrong one lapse ranges from a reapplication fee to felony charges.
FOID Card: 10 Years
A FOID card is valid for 10 years from the date of issuance, and the application or renewal fee is $10 plus any electronic processing charges.1Illinois General Assembly. Illinois Code 430 ILCS 65 – Firearm Owners Identification Card Act The Illinois State Police send a renewal notice 180 days before expiration, but the responsibility to renew on time is yours.
If you submit your renewal application before the expiration date, your existing card stays valid while the State Police process it, so there is no gap in coverage. Since January 1, 2023, cardholders who previously submitted fingerprints for their FOID card or concealed carry license get automatic renewal, which eliminates most of the paperwork.2Illinois State Police. Firearm Owner’s Identification (FOID)
Letting a FOID card lapse has real consequences beyond the card itself. Without a valid FOID, you cannot legally possess firearms or ammunition in Illinois. If you also hold a concealed carry license, a lapsed FOID can jeopardize that credential too, because FOID eligibility is a foundational requirement for the concealed carry program.
Concealed Carry License: 5 Years
A concealed carry license in Illinois is valid statewide for five years from the date of issuance.3Illinois General Assembly. Illinois Code 430 ILCS 66 – Firearm Concealed Carry Act To qualify in the first place, you must hold a valid FOID card, meet the eligibility requirements under Section 25, submit the required documentation, and pass a background investigation.4Illinois General Assembly. Illinois Code 430 ILCS 66/10 – Issuance of Licenses
What Renewal Requires
Three things: a completed renewal application with the Illinois State Police, proof of a three-hour firearms training refresher course, and payment of the renewal fee. The fee is $150 for Illinois residents and $300 for non-residents. A renewed license is valid for another five years, measured from the expiration date on your current license rather than the date you file the paperwork.5Illinois General Assembly. Illinois Code 430 ILCS 66/50 – License Renewal
The Timing Trap
The statute does not specify a minimum number of days you must file before expiration. However, under Section 70 of the Act, your license becomes invalid the moment it expires unless you have already submitted a renewal application and remain otherwise eligible.3Illinois General Assembly. Illinois Code 430 ILCS 66 – Firearm Concealed Carry Act Translation: file well before expiration so your license stays active during processing. Waiting until the last week is how people end up carrying illegally without realizing it.
What a Lapse Can Cost
Violating the Firearm Concealed Carry Act is a Class B misdemeanor for a first offense. A second or subsequent violation jumps to a Class A misdemeanor. The Illinois State Police can suspend your license for up to six months after a second violation and must permanently revoke it after three or more violations of Section 65, which governs prohibited areas. A conviction also carries a mandatory $150 fee deposited into the Mental Health Reporting Fund.3Illinois General Assembly. Illinois Code 430 ILCS 66 – Firearm Concealed Carry Act
The stakes escalate sharply if your license has actually expired and you carry anyway. At that point the situation may fall under the unlawful use of weapons statute rather than the Concealed Carry Act. Carrying a concealed firearm without a valid license is a Class A misdemeanor for a first offense, and a second or subsequent offense is a Class 3 felony, which carries two to five years in prison.6Illinois General Assembly. Illinois Code 720 ILCS 5/24-1 – Unlawful Use of Weapons The difference between “I renewed late but before it expired” and “I forgot to renew” is enormous.
Building Permits: Set Locally, Often 6 Months
Building permits in Illinois are not governed by a single statewide validity rule. Illinois has not adopted a statewide building code for existing residential construction, and permit validity periods are set by local municipalities and counties.7Capital Development Board. Frequently Asked Questions about Illinois Codes A permit in Chicago may have completely different expiration rules than one issued in Springfield or a rural county.
Six months is a common window used by many Illinois municipalities. If construction has not started within that timeframe, the permit typically becomes void and you have to reapply. Some jurisdictions allow extensions or renewals when the project is underway but not complete, usually by submitting updated plans and explaining the delay.
One statewide protection does exist. Under Public Act 103-0510, the building code requirements in effect when you applied for the permit remain the only requirements that apply for the duration of that permit, so a mid-project code change will not invalidate your work.8Illinois General Assembly. Public Act 103-0510
An expired building permit typically triggers a stop-work order from local authorities, halting all construction until the situation is resolved. Depending on the municipality, restarting may require a new application, updated inspections, and additional fees. Those delays routinely cost more than the permit itself.
Environmental Permits: Commonly 5 Years
Environmental permits in Illinois are issued by the Illinois Environmental Protection Agency and vary in duration depending on the activity. NPDES permits, which regulate wastewater discharges, are typically valid for five years. When the Agency issues a renewed general NPDES permit, covered facilities must submit their renewal application within the timeframe specified in that permit.
For other environmental permits, renewal applications should go in well before expiration. The exact lead time depends on the permit type, but 180 days is a common federal benchmark for NPDES permits. Because the review involves updated compliance data and sometimes new environmental impact assessments, starting early is the only way to avoid a gap in coverage.
Penalties If You Operate Without a Valid Permit
Illinois environmental penalties are the steepest in the permit landscape. Under the Illinois Environmental Protection Act, a general violation can result in civil penalties of up to $100,000 per violation plus an additional $25,000 for each day the violation continues.9Illinois General Assembly. Illinois Code 415 ILCS 5/42 – Civil Penalties Specific permit types carry their own daily maximums:
- NPDES permit violations: up to $25,000 per day of violation
- Hazardous waste (RCRA) permit violations: up to $50,000 per day
- Clean air (CAAPP) permit violations: up to $25,000 per day
- Underground injection (UIC) permit violations: up to $5,000 per day for most wells, or up to $25,000 plus $2,000 per day for Class II wells
Starting July 1, 2026, these maximums will be adjusted annually for inflation based on the Consumer Price Index, so the actual caps will climb each year going forward.9Illinois General Assembly. Illinois Code 415 ILCS 5/42 – Civil Penalties Beyond fines, the Agency can seek operational shutdowns and injunctive relief through the courts, which can close a facility entirely until compliance is restored.
If a Renewal Is Denied or You Miss the Window
Each permit type has its own appeal path, and Illinois courts generally require you to exhaust administrative remedies before filing a lawsuit. Skipping the administrative step and going straight to court will usually result in dismissal.
For concealed carry, a denial or revocation notice from the Illinois State Police must state the grounds and inform you of your appeal rights.3Illinois General Assembly. Illinois Code 430 ILCS 66 – Firearm Concealed Carry Act Applicants who complete the administrative appeal can then seek judicial review.
For environmental permits, appeals go to the Illinois Pollution Control Board.10Illinois General Assembly. Illinois Code 415 ILCS 5 – Environmental Protection Act You have 35 days from the Agency’s decision to file a petition, extendable by up to 90 days if both parties agree in writing. The Board must reach a final decision within 120 days of receiving the petition, and if it fails to act, the permit is generally deemed issued by operation of law.11Illinois General Assembly. Illinois Code 415 ILCS 5/40 – Appeal of Permit Denial The burden of proof falls on the applicant challenging the Agency, except where the Agency denies an NPDES permit or imposes limits based on a particular water quality criterion, in which case the Agency must justify its basis.
Building permit disputes are handled locally, usually through the municipality’s zoning board or building appeals board. Procedures and timelines vary from one jurisdiction to the next, so check the local ordinance or contact the issuing authority before the appeal window closes.
